The U.S. Fish and Wildlife Service (Service or we) has prepared a final supplemental environmental impact statement (SEIS) for the issuance of annual regulations permitting the hunting of migratory birds. We published a draft environmental impact statement in July 2010. We considered over 280 public comments in revising the document. The SEIS analyzes a range of management alternatives for addressing the hunting of migratory birds. The analysis provided in the final SEIS is intended to: inform the public of the proposed action and alternatives; address public comments we received on the draft SEIS; and disclose the direct, indirect, and cumulative environmental effects of the proposed action and each of the alternatives.

Land Acquisitions: Appeals of Land Acquisition Decisions

This proposed rule revises a section of regulations governing decisions by the Secretary to approve or deny applications to acquire land in trust under this part. This rule is appropriate to address changes in the applicability of the Quiet Title Act as interpreted by a recent United States Supreme Court decision. This rule revises a regulatory provision the Department added in 1996 to ensure that interested parties had the opportunity to timely seek judicial review of decisions when available under the Administrative Procedure Act. The Department had determined the provision was necessary because, consistent with Federal court decisions at the time, once the Secretary acquired title, the Quiet Title Act precluded judicial review of the Secretary's decision to take the land into trust. The Supreme Court has since held that the Quiet Title Act does not preclude timely Administrative Procedure Act challenges to agency decisions to acquire land in trust unless the aggrieved party claims an ownership interest in the property at issue. This rule revises the regulation to reflect this change in the law and to make other revisions to codify the current process for issuing decisions approving or denying requests to acquire land in trust under this part. It also broadens and clarifies the notice of decisions to acquire land in trust under this part, including broadening notice of any right to file an administrative appeal.

Notice of Availability of the Final Environmental Impact Statement/Environmental Impact Report for Klamath Facilities Removal

The Department of the Interior and the California Department of Fish and Wildlife have prepared a final environmental impact statement and environmental impact report (EIS/EIR) evaluating the potential effects of removing four privately owned dams on the Klamath River in southern Oregon and northern California should the Secretary of the Interior determine that removal will advance restoration of salmonid fisheries in the Klamath Basin and is in the public interest. The Department of the Interior has released the final EIS/EIR pursuant to the requirements of the National Environmental Policy Act and the Klamath Hydroelectric Settlement Agreement. The California Department of Fish and Wildlife is not releasing the document at this time, therefore there is no action under California Environmental Quality Act at this time. Additionally, no decision on the potential removal of these facilities is being made with the release of this document.

We, the U.S. Fish and Wildlife Service (Service), determine endangered status under the Endangered Species Act of 1973 (Act), as amended, for 38 species on the Hawaiian Islands of Molokai, Lanai, and Maui, and reaffirm the listing of 2 endemic Hawaiian plants currently listed as endangered. In this final rule, we are also delisting the plant Gahnia lanaiensis, due to new information that this species is synonymous with G. lacera, a widespread species from New Zealand. The effect of this regulation is to conserve these 40 species under the Endangered Species Act.

Endangered and Threatened Wildlife and Plants; 12-Month Finding on Two Petitions to Delist the Preble's Meadow Jumping Mouse

We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on two petitions to delist the Preble's meadow jumping mouse (Zapus hudsonius preblei) under the Endangered Species Act of 1973, as amended (Act). After review of the best available scientific and commercial information, we find that delisting the Preble's meadow jumping mouse is not warranted at this time. We base our determination on the continued loss and modification of the Preble's meadow jumping mouse's habitat to human development, the inadequacy of existing regulatory mechanisms, and other natural factors, including wildfire and threats associated with global climate change. Although delisting is not warranted at this time, we ask the public to submit to us at any time any new information that becomes available concerning conservation measures or threats to this subspecies or its habitat.
Oil and Gas; Hydraulic Fracturing on Federal and Indian Lands

On May 11, 2012, the Bureau of Land Management (BLM) published in the Federal Register a proposed rule entitled Oil and Gas; Well Stimulation, Including Hydraulic Fracturing, on Federal and Indian Lands. The BLM has used the comments on that draft to make improvements and is now seeking additional comment on a revised proposed rule. Key issues in this updated draft include: the use of an expanded set of cement evaluation tools to help ensure that usable water zones have been isolated and protected from contamination; and more detailed guidance on how trade secrets claims will be handled, modeled on the procedures promulgated by the State of Colorado. The revised proposed rule would also provide opportunities for the BLM to coordinate standards and processes with individual States and tribes to reduce administrative costs and to improve efficiency.

In accordance with the National Environmental Policy Act of 1969, as amended, and the Federal Land Policy and Management Act of 1976, as amended, the Bureau of Land Management (BLM) has prepared a Draft Resource Management Plan (RMP) and Draft Environmental Impact Statement (EIS) for the Dominguez-Escalante National Conservation Area (D-E NCA) and by this notice is announcing the opening of the public comment period. Congress designated the D-E NCA, as well as the Dominguez Canyon Wilderness (Wilderness), through the Omnibus Public Lands Management Act of 2009 (Omnibus Act). The Omnibus Act also established the purpose of the D-E NCA to ``conserve and protect for the benefit and enjoyment of present and future generationsthe unique and important resources and values of the land and the water resources of area streams.''

This order revokes in-part a withdrawal created by a Bureau of Reclamation Order. The revocation affects 185.88 acres of public lands withdrawn on behalf of the Bureau of Reclamation for the O'Neil Unit, Pick-Sloan Missouri River Basin Project. The Bureau of Reclamation has determined that it no longer needs the lands for reclamation purposes. This order also transfers administrative jurisdiction of the lands to the National Park Service for management under the provisions of the Wild and Scenic Rivers Act and the Niobrara Scenic River Designation Act of 1991.

Pursuant to Sec. 102(2)(C) of the National Environmental Policy Act of 1969 (Pub. L. 91-190, as amended) and the regulations promulgated by the Council on Environmental Quality (40 CFR Part 1505.2), the Department of the Interior, National Park Service, in collaboration with the City and County of San Francisco, the San Francisco Municipal Transportation Agency (SFMTA), the Presidio Trust, and the Federal Transit Administration, has prepared the Record of Decision for the Final Environmental Impact Statement (Final EIS) for extending the F-Line historic streetcar service to Fort Mason Center. The requisite no-action ``wait period'' was initiated on February 24, 2012, with the Environmental Protection Agency's Federal Register notification of the filing and public release of the Final EIS. Decision: Golden Gate National Recreation Area and San Francisco Maritime National Historic Park intend to authorize SFMTA to construct, maintain, and operate an extension of the F-Line historic streetcar service onto National Park Service (NPS) property. The actions to be authorized by NPS include: retrofitting of the historic State Belt Railroad tunnel for single track streetcar use; constructing a turnaround terminus at the Fort Mason Center; and installing appurtenant features such as signals, crossings, wires and poles, and new platforms and designated stops. The complete Project elements and resource stewardship strategies are identified and analyzed in the Preferred Alternative (Alternative 2 and Turnaround Option 2A) presented in the Final EIS (available on-line at https:// parkplanning.nps.gov/streetcar). The full range of foreseeable environmental consequences was assessed, and appropriate mitigation measures identified. The selected alternative was deemed to be the ``environmentally preferred'' course of action. Under the authority of the Endangered Species Act of 1973, as amended (Act), we, the U.S. Fish and Wildlife Service (Service), remove the Magazine Mountain shagreen (Inflectarius magazinensis) from the Federal List of Endangered and Threatened Wildlife (delist). This determination is based on a thorough review of the best available scientific and commercial data, which indicate that the threats to this species have been eliminated or reduced to the point that the species has recovered and no longer meets the definition of threatened or endangered under the Act.
