The United States Department of Agriculture (USDA), Forest Service, has filed an application with the Department of the Interior, Bureau of Land Management, to extend the duration of Public Land Order (PLO) No. 7174 for an additional 20-year term. PLO No. 7174 withdrew approximately 35 acres of National Forest System lands in the Black Hills National Forest from location and entry under the United States mining laws to protect recreational values and the investment of Federal funds at the Pactola Visitor Information Center, Pactola Marina North, and Pactola Marina South. The withdrawal created by PLO No. 7174 will expire on November 27, 2015, unless extended. This notice also gives the public an opportunity to comment on the proposed withdrawal extension and to request a public meeting.

BOEM has prepared a ROD following the completion of the Final SEIS for CPA Consolidated Lease Sale 216/222, the final lease sale in the 2007-2012 OCS Oil and Gas Leasing Program (Five-Year Program), which is scheduled for June 20, 2012. In preparing the ROD, BOEM considered alternatives to the proposed action and the impacts as presented in the Final SEIS and all comments received throughout the NEPA process. The Final SEIS updates two previous environmental and socioeconomic analyses for CPA Lease Sale 216/222. The GOM OCS Oil and Gas Lease Sales: 2007-2012; Western Planning Area Lease Sales 204, 207, 210, 215, and 218; Central Planning Area Lease Sales 205, 206, 208, 213, 216, and 222, Final Environmental Impact Statement (OCS EIS/EA MMS 2007-018) (Multisale EIS), completed in April 2007, originally analyzed CPA Lease Sale 216/222. The Gulf of Mexico OCS Oil and Gas Lease Sales: 2009-2012; Central Planning Area Lease Sales 208, 213, 216, and 222; Western Planning Area Lease Sales 210, 215, and 218; Final Supplemental Environmental Impact Statement (OCS EIS/EA MMS 2008-041) (2009-2012 Supplemental EIS), completed in September 2008, updated the socioeconomic and environmental analyses for CPA Lease Sale 216/222. BOEM developed the Final SEIS for CPA Lease Sale 216/222 in order to consider new circumstances and information arising from, among other things, the Deepwater Horizon explosion and oil spill. After careful consideration, BOEM has determined that in light of significant safety and environmental reforms since the Deepwater Horizon oil spill and the economic and energy security benefits of exploring and developing the domestic energy resources available in the CPA, including job creation, it is appropriate to hold a sale in this area at this time. BOEM resource assessments for the CPA indicate that the area contains over 30 billion barrels of oil (BBO) and over 133 trillion cubic feet (Tcf) of natural gas which are undiscovered and technically recoverable.

We, the U.S. Fish and Wildlife Service (Service), have received an application for a proposed right-of-way within the Kenai National Wildlife Refuge (Refuge) under the Alaska National Interest Lands Conservation Act (ANILCA). We received the application from Nordaq Energy, Inc. for the Shadura Natural Gas Development Project (Project), which would involve construction and operation of facilities associated with the exploration and production of natural gas from the subsurface estate within the Refuge. We intend to gather information necessary to prepare an environmental impact statement (EIS) under the National Environmental Policy Act (NEPA) and its implementation regulations for the application. We are publishing this notice in compliance with NEPA regulations (40 CFR 1501.7) to advise other agencies and the public of our intentions and to obtain suggestions and information on the scope of issues to be addressed in the EIS.

We are also announcing our 12-month finding on a petition to reclassify San Clemente Island bush mallow is not warranted at this time, and therefore we are not proposing to change the status of this species. We are taking these actions as a result of a petition to reclassify these three species.

We, the U.S. Fish and Wildlife Service (Service), extend the deadline for submission of public comments to help us identify potential changes to our regulations that implement parts of the Endangered Species Act that would create incentives for landowners and others to take voluntary conservation actions to benefit species that may be likely to become threatened or endangered species. In particular, we seek comment on whether and how the Service can assure those who take such voluntary actions that the benefits of their actions will be recognized as offsetting the adverse effects of activities carried out after listing by that landowner or others. The practice of recognizing these actions, sometimes referred to as ``advance mitigation'' or ``prelisting mitigation,'' is intended to encourage early conservation efforts that could reduce or eliminate the need to list species as endangered or threatened. If you have previously submitted comments, please do not resubmit them, because we have already incorporated them into the public record and will fully consider them as we decide how we may propose changes to our regulations or policies.

We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list the eastern diamondback rattlesnake (Crotalus adamanteus) as threatened under the Endangered Species Act of 1973, as amended (Act) and to designate critical habitat. Based on our review, we find that the petition presents substantial scientific or commercial information indicating that listing the eastern diamondback rattlesnake may be warranted. Therefore, with the publication of this notice, we are initiating a review of the status of the species to determine if listing the eastern diamondback rattlesnake is warranted. To ensure that this status review is comprehensive, we are requesting scientific and commercial data and other information regarding this species. Based on the status review, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.
Endangered and Threatened Wildlife and Plants; 12-Month Finding on a Petition To List the Arapahoe Snowfly as Threatened or Endangered

We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to list the Arapahoe snowfly (Capnia arapahoe) as endangered and to designate critical habitat under the Endangered Species Act of 1973, as amended (Act). After review of the best available scientific and commercial information, we find that listing the Arapahoe snowfly as threatened or endangered is warranted. Currently, however, listing the Arapahoe snowfly is precluded by higher priority actions to amend the Lists of Endangered and Threatened Wildlife and Plants. Upon publication of this 12-month petition finding, we will add the Arapahoe snowfly to our candidate species list. We will develop a proposed rule to list the Arapahoe snowfly as our priorities allow. We will make any determination on critical habitat during development of the proposed listing rule. In any interim period, we will address the status of the candidate taxon through our annual Candidate Notice of Review.

In that proposed rule, we propose to increase the maximum term for programmatic permits to 30 years and to increase permit application processing fees for such long-term permits. We, the U.S. Fish and Wildlife Service (Service), announce the availability of a draft environmental impact statement and environmental impact report (EIS/EIR) for the Llano Seco Riparian Sanctuary Unit Restoration and Pumping Plant/Fish Screen Facility Protection Project in Glenn and Butte Counties, California. The proposed project includes riparian restoration and protection of the Princeton-Cordora-Glenn and Provident Irrigation Districts (PCGID-PID) pumping plant and fish screen facility. The draft EIS/EIR, which we prepared in cooperation with the California Department of Fish and Game (CDFG) and now announce in accordance with the National Environmental Policy Act of 1969 (NEPA), describes the alternatives identified to protect the pumping plant and fish screen facility located at river mile 178.5 on the Sacramento River, and to restore the Riparian Sanctuary Unit of the Sacramento River National Wildlife Refuge.
