Pursuant to section 102(2)(C) of the National Environmental Policy Act of 1969, as amended, the Bureau of Reclamation (Reclamation) proposes to prepare a combined Planning Report and Environmental Impact Statement (PR/EIS) on the Yakima River Basin Water Storage Feasibility Study. The Washington Department of Ecology (Ecology) is a joint lead with Reclamation in the preparation of this Environmental Impact Statement which will also be used to comply with requirements of the Washington State Environmental Policy Act (SEPA). The purpose of Reclamation's Yakima River Basin Water Storage Feasibility Study is to evaluate alternatives that would create additional water storage for the Yakima River basin and assess their potential to supply the water needed for ecosystem aquatic habitat, basin-wide agriculture, and municipal demands. The need for the study is based on the existing finite water supply and limited storage capability of the Yakima River basin in low water years. This finite supply and limited storage capacity do not meet the water supply demands in all years and result in significant adverse impact to the Yakima River basin's economy, which is agriculture-based, and to the basin's aquatic habitat, specifically, anadromous fisheries. The study seeks to identify means of increasing water storage available, including storage of Columbia River water, for purposes of improving anadromous fish habitat and meeting irrigation and municipal water supply needs.

The U.S. Fish and Wildlife Service (we, the Service) has received applications for enhancement of survival permits pursuant to section 10(a)(1)(A) of the Endangered Species Act of 1973, as amended (ESA), from four Resource Conservation and Development councils (RC&Ds, Applicants) in the State of Hawaii: Garden Island RC&D, Kauai County; Tri-Isle RC&D, Maui County; Big Island RC&D, Hawaii County; and Oahu RC&D, Honolulu County. The permit applications include a proposed programmatic Safe Harbor Agreement (SHA) between the Applicants and the Service. The proposed SHA provides for voluntary habitat restoration, maintenance, enhancement, or creation activities to enhance the habitat and recovery of Hawaiian goose (Branta sandvicensis), Hawaiian duck (Anas wyvilliana), Hawaiian moorhen (Gallinula chloropus sandvicensis), Hawaiian coot (Fulica alai), and Hawaiian stilt (Himantopus mexicanus knudseni) (collectively ``Covered Species'') on non-Federal lands in the State of Hawaii. The proposed duration of both the SHA and permits is 50 years. The Service believes that the proposed SHA and permit applications may be eligible for categorical exclusion under the National Environmental Policy Act of 1969 (NEPA). The basis for this is contained in a draft Environmental Action Statement, which also is available for public review. The Service and the State of Hawaii's Department of Fish and Wildlife (DOFAW) hold concurrent processes for the review of both Federal and State permit applications and draft Safe Harbor Agreements. As part of the DOFAW process, public meetings will take place to allow for discussion and comment. Dates and locations for which DOFAW has scheduled public meetings are: December 5, 2006, Lanai High School, Lanai City; December 7, 2006, Kalanimoku Building, Room 132, Honolulu; December 12, 2006, Lihue Neighborhood Community Center, Lihue; December 13, 2006: Mitchell Pauole Community Center, Kaunakakai; December 19, 2006, Velma McWayne Santos Community Center, Wailuku; December 21, 2006, Hilo Division of Forestry and Wildlife Office, Hilo. The Secretary of the Interior has designated the U.S. Fish and Wildlife Service (Service) to act on behalf of the U.S. Department of the Interior (DOI) as natural resource trustee (Trustee) with respect to the February 2004 oil spill in the Bradley Beach, NJ, area (the incident). The Service has determined that the impacts of the incident warrant conducting a natural resource damage assessment that will include restoration planning. The incident has been referred to by a number of names, including the Bradley Beach Mystery Spill, the Monmouth County Mystery Spill, the Monmouth and Ocean Counties Mystery Spill, the Brick Township Mystery Spill, and the Brick Township Tarball Mystery Spill. The DOI is hereby providing notice of efforts to plan restoration actions for injuries resulting from the incident. The purpose of this restoration planning is to evaluate potential injuries to natural resources and lost services and use that information to determine the need for and scale of restoration actions.

The U.S. Fish and Wildlife Service (Service), on behalf of the Department of the Interior (DOI) as a natural resource trustee, announces the release to the public of the Natural Resource Damages Preassessment Screen for Onondaga Lake, Onondaga County, New York. Federal regulations at 43 CFR 11.23(a) require Natural Resource Trustees to complete a preassessment screen (PAS) and make a determination as to whether a Natural Resources Damages Assessment (NRDA) shall be carried out at a site, before assessment efforts are undertaken under the regulations. The Onondaga Lake PAS document fulfills that requirement for the Onondaga Lake Superfund Site and follows the structure of Federal Regulations at 43 CFR part 11. The purpose of the PAS is to provide a rapid review of the readily available information on releases of hazardous substances and potential impacts on natural resources in Onondaga Lake and sub-sites for which the DOI may assert trusteeship under section 107(f) of CERCLA.

Burr Trail Modifications, Final Environmental Impact Statement, Capitol Reef National Park, Utah

Pursuant to Sec. 102(2)(C) of the National Environmental Policy Act of 1969, 83 Stat. 852, 853, codified as amended at 42 U.S.C. 4332(2)(C), the National Park Service announces the availability of the Record of Decision for the Burr Trail Modifications, Capitol Reef National Park, Utah. On October 23, 2006 the Director, Intermountain Region approved the Record of Decision for the project. As soon as practicable, the National Park Service will begin to implement the Preferred Alternative contained in the FEIS issued on July 14, 2006. The following course of action will occur under the preferred alternative. In areas with high bentonite clay content, a gravel surface course will be constructed to increase safety. Geotextile fabric may be used between the aggregate and subbase to prevent gravel loss into the subgrade. Without altering the overhanging rock, a narrow section of the road at mile point 0.65 will be widened by 6 feet to 10 feet. This will be accomplished by moving the northern roadside ditch toward the overhanging rock. A rock embankment will be added to the southern side of the road (the north bank of Sandy Creek) to provide structural stability for a portion of the road as well as slope protection. The road bank in the vicinity of mile points 0.75 and 0.85 will be stabilized using slope protection to reduce erosion and maintain the natural contours of the existing stream channel. Up to 530 linear feet of slope protection will be placed along the base and 6 feet or more up the sides of the road embankment. The base width of the protection will remain aligned with the slope to minimize placement of rock within the existing stream channel. Two paved fords, impassable whenever water flows across the roadway, will be constructed at mile points 0.10 and 0.20. Two vented paved fords will be constructed at mile points 0.50 and 0.60. These crossings will be passable during 2-year storm events; floodwaters will be conveyed through two 24-inch-diameter corrugated metal pipe culverts. The paved fords (vented and unvented) will be relatively consistent with the existing topography, and their length will be sufficient to contain overtopping 10-year storm event floodwaters within the paved area. Each of the fords will include slope protection to protect the upstream and downstream banks and inlet and outlet protection to reduce and minimize erosion and scour. Paved fords, similar to those that will be constructed at mile points 0.10 and 0.20, will be constructed at each of the two minor drainage channels. The upstream channel (i.e., inlet) will be recontoured to direct surface flow over the paved ford, and inlet and outlet protection will be installed to minimize erosion and scour. Slope protection will be added to portions of the downstream road embankment to minimize erosion. A vented paved ford will be constructed to facilitate crossing Halls Creek. This ford will include four 36-inch-diameter corrugated metal pipe culverts. The roadway at the crossing will be shifted a short distance downstream (i.e., to the south) from the Halls Creek/ Burr Canyon drainage confluence so that the culverts in the paved ford can accommodate flows from the two drainages. Inlet and outlet protection will be added to minimize scouring and erosion. Slope protection will also be placed on the stream banks both upstream and downstream of the crossing if necessary to reduce the potential for erosion of the stream banks. An existing culvert near the base of the switchbacks in Burr Canyon will be replaced by three 36-inch-diameter corrugated metal pipe culverts. Inlet protection will be installed while the outlet will use the existing rock channel as erosion protection. An approximately 50-foot length of road just east of the existing culvert will be widened 6 to 10 feet by adding a rock embankment and backfilling to widen the road on the south slope of the Burr Canyon drainage. A cattle guard will be placed at the park boundary by the National Park Service to prevent cattle from entering the park from adjacent Bureau of Land Management-administered lands, and the existing cattle guard at mile point 0.55 will be removed when the current grazing allotment expires. This course of action and three alternatives were analyzed in the Draft and Final Environmental Impact Statements. The full range of foreseeable environmental consequences was assessed, and appropriate mitigating measures were identified. The Record of Decision includes a statement of the decision made, synopses of other alternatives considered, the basis for the decision, a description of the environmentally preferable alternative, a finding on impairment of park resources and values, a listing of measures to minimize environmental harm, and an overview of public involvement in the decision-making process.

43 CFR Subpart 8364Closure and Restrictions, 8364.1 (a) states: ``To protect persons, property, and public lands and resources, the authorized officer may issue an order to close or restrict use of designated public lands.'' In coordination with several livestock grazing permittees and the Idaho Department of Fish and Game, all BLM- administered roads within the Cherry and Frenchie Fires of 2006 will be closed to all motorized vehicle travel (e.g., all-terrain vehicles, pickup trucks, motorcycles, sport utility vehicles, snowmobiles, etc.), including existing roads and two-tracks within the perimeter. This action is necessary for the protection of watershed resources and highly erosive soils to allow adequate time to allow for the rehabilitation of the burned area. No motorized vehicle travel into these areas will be allowed, including motorized travel for purposes of retrieval of big game, unless specifically authorized (in writing) by the authorized officer (BLM Four Rivers Field Office Manager). The following acts are exempt from this action: (1) Access within the area by other means (e.g., foot or horseback); (2) persons with a BLM permit or contract specifically authorizing motor vehicle use; (3) owners or lessees of land in the closed area with written authorization; (4) any BLM employee or livestock grazing permittee providing maintenance to a structure or facility; and (5) any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty. Extension of the closure order may occur if it is determined that the rehabilitation of the burned area has not been successful. Once rehabilitation of the burned area is determined to be successful, motorized vehicle access will resume in accordance with the 1988 Cascade Resource Management Plan (RMP) Record of Decision (ROD), opening the area to off-road vehicle use, providing no resource damage occurs. The Implementation Plan for the National Geological and Geophysical Data Preservation Program submitted to Congress in August 2006 outlines the vision and purpose of the program and makes recommendations for implementation of the program. One of the action items in the FY 2007 implementation plan is to ``begin interactions with State geological surveys and other DOI agencies that maintain geological and geophysical data and samples to address their preservation and data rescue needs.'' As the first step in this process, the USGS is requesting that each state provide an assessment of their current collections resources and data preservation needs. This information will provide a snapshot of the diversity of scientific collections held, supported, or used by state geological surveys. We are requesting comments on the permit application and on the preliminary determination that the proposed Plan qualifies as a ``low- effect'' Habitat Conservation Plan, eligible for a categorical exclusion under the National Environmental Policy Act (NEPA) of 1969, as amended. The basis for this determination is discussed in the Environmental Action Statement (EAS) and the associated Low Effect Screening Form, which are also available for public review.
