The Department of the Army is announcing withdrawal of its Notice of Intent (NOI) to prepare an Environmental Impact Statement (EIS). The August 4, 2023, notice announced the Army's intention to prepare an EIS under the National Environmental Policy Act (NEPA). The EIS would have addressed potential environmental effects associated with the congressionally-mandated removal of the Confederate Memorial from Arlington National Cemetery (ANC). The Army determined the congressionally-mandated removal action is a non-discretionary action. There would be no reasonably foreseeable significant impacts from any discretionary elements of the proposed action. An EIS is therefore not needed to inform any decision-making for this action. The Army will prepare an Environmental Assessment (EA) to analyze and disclose any effects of the discretionary elements of the proposed action, including how to disassemble the Confederate Memorial.

In accordance with the Privacy Act of 1974, the Department of the Army proposes to establish a new system of records titled, Army Safety Management Program Records (ASMPR)-A0385-1 DAS. It supports the management and prevention of work-related illnesses and injuries by individuals engaged in DoD work-related activities while on or off the worksite. The system automates accidents, mishaps, safety inspections, and workplace hazard investigation data collection, identifies causal factors and potentially unsafe practices or conditions, and makes recommendations for corrective actions to prevent recurrence and reduce hazardous conditions. Additionally, DoD is issuing a Notice of Proposed Rulemaking, which proposes to exempt this system of records from certain provisions of the Privacy Act, elsewhere in today's issue of the Federal Register.

The Department of the Army (Army) announces its intent to conduct public scoping under the National Environmental Policy Act (NEPA) to gather information to prepare an Environmental Impact Statement (EIS) for proposed near-term real property actions and the update of the Real Property Master Plan (RPMP) for Military Ocean Terminal Sunny Point (MOTSU). MOTSU is a 16,435-acre installation located on the banks of the Cape Fear River between the towns of Boiling Spring Lakes and Southport, North Carolina. The scoping process will help identify reasonable alternatives, potential environmental impacts, and key issues of concern to be analyzed in the EIS. The Army intends to comply with the requirements of section 106 of the National Historic Preservation Act in parallel with this NEPA process and invites federally recognized Tribes and the State Historic Preservation Office (SHPO) of North Carolina to participate in the consultation process.

The decedent names are: Edward Upright from the Spirit Lake Tribe, Amos LaFramboise from the Sisseton Wahpeton Oyate of the Lake Traverse Reservation, Beau Neal from the Northern Arapaho Tribe, Edward Spott from the Puyallup Tribe and Launy Shorty from the Blackfeet Nation. In compliance with the Paperwork Reduction Act of 1995, the U.S. Army Corps of Engineers announces a proposed public information collection and seeks public comment on the provisions thereof. Comments are invited on: whether the proposed collection of information is necessary for the proper performance of the functions of the agency, including whether the information shall have practical utility; the accuracy of the agency's estimate of the burden of the proposed information collection; ways to enhance the quality, utility, and clarity of the information to be collected; and ways to minimize the burden of the information collection on respondents, including through the use of automated collection techniques or other forms of information technology.
