Intercountry Adoption-Department Issuance of Certifications in Hague Convention Adoption Cases

The Department of State (the Department) is issuing a final rule to implement the certification and declaration provisions of the 1993 Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption (the Convention) and the Intercountry Adoption Act of 2000 (the IAA) with respect to adoption and custody proceedings taking place in the United States, after review of public comments received in response to the Department's June 16, 2006 issuance of a proposed rule. This final rule governs the application process for Hague Adoption Certificates and Hague Custody Declarations in cases involving emigration of a child from the United States. It also establishes a process for seeking certification, for purposes of Article 23 of the Convention, that an adoption done in the United States following a grant of custody in a Convention country of origin was done in accordance with the Convention.
Notice of Effective Date for Implementation of Five-Year Professor and Research Scholar Exchange Program

By final rule adopted May 19, 2005, 70 FR 28815, the Department of State amended its regulations and extended the permitted program duration from three to five years for professor and researcher participants in the Exchange Visitor Program. This rule also established clear eligibility requirements for repeat participation as a professor or researcher in the Exchange Visitor Program following a two-year bar. Implementation of these changes was delayed until the Department of Homeland Security could complete modifications to the Student and Exchange Visitor Information System (SEVIS) necessary to permit these changes to be reflected in SEVIS. By SEVIS broadcast on October 6th, 2006, The Department of Homeland Security announced its ability to facilitate these changes effective November 4, 2006. Accordingly, as of November 4, 2006, current and future professor and researcher program participants will be eligible for five years of program participation as provided for in the final rule. These participants will also be subject to the eligibility requirements for repeat participation set forth in the final rule. Requirements governing initial eligibility for participation as a professor or researcher are unchanged. The final rule published May 19, 2005 also established a new ``G- 7'' administrative classification for certain program sponsors. The Department will contact directly those sponsors eligible for the classification. No action, inquiry, or request regarding this classification is necessary on the part of existing sponsors. This certification will be published in the Federal Register.

The Office of Academic Exchange Programs of the Bureau of Educational and Cultural Affairs announces an open competition for projects to provide foreign language instruction overseas for American undergraduate and graduate students in the summer of 2007 in support of the National Security Language Initiative (NSLI). Public and private non-profit organizations, or consortia of such organizations meeting the provisions described in Internal Revenue Code section 26 U.S.C. 501(c)(3), may submit proposals to implement six-to ten-week summer institutes overseas for a minimum total of 365 participants in countries where Arabic, Chinese, Korean, Russian and the Indic, Persian, and Turkic language families are widely spoken. These summer institutes should offer U.S. undergraduate and graduate students structured classroom instruction and less formal interactive learning opportunities through a comprehensive exchange experience that primarily emphasizes language learning. Proposals from applicant organizations should clearly indicate the building of new, additional institutional language-teaching capacity overseas for these summer institutesthis program is designed to develop additional language study opportunities for U.S. students.

Notice is hereby given that the Department of State proposes to create a new system of records, STATE-72, pursuant to the provisions of the Privacy Act of 1974, as amended (5 U.S.C. 552a), and Office of Management and Budget Circular No. A-130, Appendix I. The Department's report was filed with the Office of Management and Budget on October 23, 2006. It is proposed that the new system will be named ``Identity Management System.'' This system description is proposed in order to support the Bureau of Diplomatic Security's (DS) administration of the Homeland Security Presidential Directive 12 Program that directs the use of a common identification credential for both logical and physical access to federally controlled facilities and information systems. The system description will reflect the DS personal identity verification (PIV) card record-keeping system, and Department of State identification card issuance activities and operations. The Department of State is proposing to update and amend its regulations on deaths and estates in 22 CFR part 72. The existing regulations were originally issued in 1957. They needed to be redrafted in plain language and changed to reflect changes in State Department statutory authority and current practice. Sections 234 and 235 of the James W. Nance and Meg Donovan Foreign Relations Authorization Act, Fiscal Years 2000 and 2001 made some changes to consular officer and State Department responsibilities with respect to the deaths and personal estates of United States citizens and non-citizen nationals abroad that must be reflected in the regulations.

Establishment of the Advisory Committee on Democracy Promotion

The Advisory Committee on Democracy Promotion was established in March 2006 to advise the Secretary of State and the Administrator of the U.S. Agency for International Development on the consideration of issues related to democracy promotion in the formulation and implementation of U.S. foreign policy and foreign assistance. The Secretary of State will appoint the members of the committee, which will consist of up to 20 non-government members. The committee will follow the procedures prescribed by the Federal Advisory Committee Act (FACA). Section 7209 of the Intelligence Reform and Terrorism Prevention Act of 2004 (IRTPA), Public Law 108-458, 118 Stat. 3638 (Dec. 17, 2004), provides that U.S. citizens and nonimmigrant aliens may enter the U.S. only with passports or such alternative documents as the Secretary of Homeland Security may designate as satisfactorily establishing identity and citizenship. The statute requires that the Secretary of Homeland Security, in consultation with the Secretary of State, develop and implement a plan to require virtually all travelers entering the U.S. to present a passport, other document, or combination of documents, that are ``deemed by the Secretary of Homeland Security to be sufficient to denote identity and citizenship. Section 7209 expressly limits the waiver of documentation requirements for U.S. citizens under section 215 (b) of the Immigration and Nationality Act (INA)\1\ and eliminates the waiver of documentation requirements for categories of individuals for whom documentation requirements have previously been waived (citizens of Canada, Mexico, and Bermuda) under section 212 (d)(4) (B) of the INA.\2\ U.S. citizens and nonimmigrant aliens from Canada, Mexico, and Bermuda will be required to comply with the new document requirements of section 7209.\3\ The legislation also requires that the Department of Homeland Security (DHS) and Department of State seek to facilitate the frequent travel of those living in border communities. This proposed rule addresses the travel facilitation requirement of this legislation. The administration's proposal to address the remainder of the legislative requirements as set forth in section 7209, called the Western Hemisphere Travel Initiative (WHTI), is being addressed in separate rulemakings.

TransCanada Keystone Pipeline, L.P. has applied to the United States Department of State for a Presidential Permit for the proposed construction, connection, operation, or maintenance, at the border of the United States of facilities for the importation of petroleum from a foreign country. The Department of State receives and considers applications for Presidential Permits for such energy-related pipelines pursuant to authority delegated to it by the President under Executive Order 13337 of April 30, 2004 (69 FR 25299). To issue a Permit, the Department of State must find that issuance would serve the national interest. It consults extensively with concerned Federal and State agencies, and invites public comment in arriving at its determination. With respect to the application submitted by TransCanada Keystone Pipeline, L.P., the Department of State has concluded that the issuance of the Presidential Permit would constitute a major Federal action that may have a significant impact upon the environment within the meaning of the National Environmental Policy Act of 1969 (NEPA). For this reason, Department of State intends to prepare an environmental impact statement (EIS) to address reasonably foreseeable impacts from the proposed action and alternatives, to include the proposed Cushing extension. The purpose of this Notice of Intent is to inform the public about the proposed action, announce plans for scoping meetings, invite public participation in the scoping process, and solicit public comments for consideration in establishing the scope and content of the EIS. As the proposed project may involve an action in a floodplain or wetland, the EIS will include a floodplain and wetlands assessment and floodplain statement of findings.
Transitional Application Deadline for Adoption Service Providers Applying for Accreditation, Temporary Accreditation, or Approval Under the Intercountry Adoption Act of 2000

Pursuant to the Intercountry Adoption Act of 2000 (the IAA), the Department of State (the Department) is the Central Authority for the United States for implementation of the 1993 Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption (the Convention). Under the Convention and the IAA, once the Convention enters into force for the United States, agencies and persons that seek to provide adoption services must generally be accredited, temporarily accredited, approved, or otherwise exempt. The United States intends to ratify the Convention once the necessary preparations for its implementation in the United States have been made. In this public notice, the Department is announcing the transitional application deadline (TAD). In order for an agency or person to be accredited or approved as of the time the Convention enters into force for the United States or for an agency to be temporarily accredited, an agency or person must submit an application and the required fee(s) on or before the TAD to an accrediting entity with jurisdiction to evaluate its application. The Department has designated two accrediting entities. They are: The Council on Accreditation (COA) and Colorado's Department of Human Services. The TAD is November 17, 2006. See 22 CFR part 96.19 for further information on the TAD. Agencies or persons that do not seek to be accredited or approved by the time the Convention enters into force for the United States may submit an application and the required fee(s) to an accrediting entity with jurisdiction to evaluate its application at any time after the TAD. Agencies seeking temporary accreditation must apply by the TAD.
Passport Procedures-Amendment to Restriction of Passports Regulation

This final rule amends part 51 at Title 22 of the Code of Federal Regulations to change a ground of denying, revoking or canceling a passport. The final rule amends the existing regulation at section 51.70(a) in Title 22 of the Code of Federal Regulations which requires the Secretary of State to deny a passport to a person who has been certified by the Secretary of Health and Human Services to be in arrears of child support by an amount exceeding $5000 by changing it to $2500 in accordance with Section 7303 of Public Law 109-171, the Deficit Reduction Act of 2005.
Amendment to the International Traffic in Arms Regulations: Partial Lifting of Arms Embargo Against Haiti

The Department of State is amending the International Traffic in Arms Regulations to reflect modifications to the U.S. arms embargo against Haiti. The embargo is revised to permit exports of defense articles and services that are destined for security units under the command of the Government of Haiti, or under the command of the United Nations (UN) and UN- authorized missions, and to allow exports of personal protective clothing, including flak jackets and helmets, for use by personnel from the United Nations and other international organizations, representatives of the media, and development workers and associated personnel.

The Charter of the Advisory Committee on Persons with Disabilities was renewed for a second two-year term on June 26, 2006 and applications are being solicited to fill one vacant position on the Committee. Established on June 23, 2004, and rechartered on June 26, 2006, the Advisory Committee on Persons with Disabilities serves the Secretary and the Administrator in an advisory capacity with respect to the consideration of the interests of persons with disabilities in formulation and implementation of U.S. foreign policy and foreign assistance. The Committee is established under the general authority of the Secretary and the Department of State as set forth in Title 22 of the United States Code, in particular Sections 2656 and 2651a, and in accordance with the Federal Advisory Committee Act, as amended. The Committee is made up of the Secretary of State, the Administrator of the Agency for International Development and an Executive Director (all ex-officio members); and eight members from outside the United States government. The non-government members of the Committee represent a cross section from not-for-profit organizations, public policy organizations, academic institutions, corporations and other experts on foreign policy or development issues related to persons with disabilities. The current non-government members are: Senda Benaissa, Joni Eareckson Tada, Vail Horton, John Kemp, Albert H. Linden, Jr., Kathleen Martinez, and John Register. One non-government position on the Committee is currently vacant, and applications are now being accepted for that position.
