Improve Tracking of Workplace Injuries and Illnesses
OSHA is amending its occupational injury and illness recordkeeping regulation to require certain employers to electronically submit injury and illness information to OSHA that employers are already required to keep under the recordkeeping regulation. Specifically, OSHA is amending its regulation to require establishments with 100 or more employees in certain designated industries to electronically submit information from their OSHA Forms 300 and 301 to OSHA once a year. OSHA will not collect employee names or addresses, names of health care professionals, or names and addresses of facilities where treatment was provided if treatment was provided away from the worksite from the Forms 300 and 301. Establishments with 20 to 249 employees in certain industries will continue to be required to electronically submit information from their OSHA Form 300A annual summary to OSHA once a year. All establishments with 250 or more employees that are required to keep records under OSHA's injury and illness regulation will also continue to be required to electronically submit information from their Form 300A to OSHA on an annual basis. OSHA is also updating the NAICS codes used in appendix A, which designates the industries required to submit their Form 300A data, and is adding appendix B, which designates the industries required to submit Form 300 and Form 301 data. In addition, establishments will be required to include their company name when making electronic submissions to OSHA. OSHA intends to post some of the data from the annual electronic submissions on a public website after identifying and removing information that could reasonably be expected to identify individuals directly, such as individuals' names and contact information.
Personal Protective Equipment in Construction
OSHA is proposing to revise its personal protective equipment standard in construction to explicitly require that the equipment must fit properly. The agency requests comments regarding the proposed revision.

In this notice, OSHA announces an application for modification of a permanent variance and for an interim order submitted by Traylor Bros., Inc. (Traylor). The application seeks to modify a permanent variance relating to work in compressed-air environments previously granted to Traylor to add Traylor-Sundt Joint Venture (SUNDTJV) as an additional employer and to add the Integrated Pipeline Tunnel Project. Traylor also requests an interim order to be effective until OSHA issues a final decision on the application. This notice presents the agency's preliminary findings on Traylor's application and announces the granting of an interim order. OSHA invites the public to submit comments on the variance modification application to assist the agency in determining whether to grant the applicant a modified permanent variance based on the conditions specified in this application.

Maine State Plan for State and Local Government Employees; Approval of Plan Supplements and Certification of Completion of Developmental Steps
The Maine Department of Labor, Bureau of Labor Standards submitted documentation attesting to the completion of all structural and developmental aspects of its State Plan for State and Local Government Employees as approved by OSHA. After extensive review of the submissions and opportunity for correction, the Maine State Plan (MEOSH) submitted updated and revised documents. OSHA is approving the revised State Plan, which documents the satisfactory completion of all structural and developmental aspects of Maine's approved State Plan, and is certifying this completion. This certification attests to the fact that the Maine State Plan now has in place those structural components necessary for an effective State Plan for State and Local Government Employees. (Enforcement of occupational safety and health standards with regard to private sector employers and employees in the State of Maine remains the responsibility of the U.S. Department of Labor, OSHA.)

Procedures for the Handling of Retaliation Complaints Under the Taxpayer First Act (TFA)
On March 7, 2022, the Occupational Safety and Health Administration (OSHA) of the U.S. Department of Labor (Department) issued an interim final rule (IFR) that provided procedures for the Department's processing of complaints under the employee protection (retaliation or whistleblower) provisions of Section 7623(d) of the Taxpayer First Act (TFA or Act). The IFR established procedures and time frames for the handling of retaliation complaints under TFA, including procedures and time frames for employee complaints to OSHA, investigations by OSHA, appeals of OSHA determinations to an administrative law judge (ALJ) for a hearing de novo, hearings by ALJs, review of ALJ decisions by the Administrative Review Board (ARB) (acting on behalf of the Secretary of Labor) and judicial review of the Secretary's final decision. It also set forth the Department's interpretations of the TFA whistleblower provisions on certain matters. This final rule adopts the IFR with one technical change.

This document gives notice of the eligibility of the Oregon State occupational safety and health plan (State Plan) for determination under Section 18(e) of the Occupational Safety and Health Act of 1970 as to whether final approval of the State Plan over temporary labor camps should be granted. This notice of eligibility for an 18(e) determination applies only to coverage of temporary labor camps and does not affect or disturb the previous grant of final approval in 2005 as to all other issues covered by the Oregon State Plan. If an affirmative determination under section 18(e) is made, the Federal standard and enforcement authority will no longer apply to temporary labor camps.
