HUD is seeking comment on moving the timeframe that FHA conducts its pre-endorsement review of loans originated by Direct Endorsement lenders from a time that is prior to the lender closing each loan and before FHA's endorsement of the mortgage for insurance to a period after the loan has been closed. Comment is sought on whether this shift in time, as further described in this document, would reduce the processing time before the loans may be closed, and facilitate loan closing.

Notice of Submission of Proposed Information Collection to OMB: Low Income Housing Tax Credit Database
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. HUD is soliciting public comments on the subject proposal. Section 2835(d) of the Housing and Economic Recovery Act, or HERA, (Pub. L. 110-289, approved July 30, 2008) amends Title I of the U.S. Housing Act of 1937 (42 U.S.C. 1437 et seq.) (1937 Act) to add a new section 36 (to be codified as 42 U.S.C. 1437z-8) that requires each state agency administering tax credits under section 42 of the Internal Revenue Code of 1986 (low-income housing tax credits or LIHTC) to furnish HUD, not less than annually, information concerning the race, ethnicity, family composition, age, income, use of rental assistance under section 8(o) of the U.S. Housing Act of 1937 or other similar assistance, disability status, and monthly rental payments of households residing in each property receiving such credits through such agency. New section 36 requires HUD to establish standards and definitions for the information to be collected by state agencies and to provide states with technical assistance in establishing systems to compile and submit such information and, in coordination with other federal agencies administering housing programs, establish procedures to minimize duplicative reporting requirements for properties assisted under multiple housing programs. In 2010, OMB approved the first collection instrument used for the collection of LIHTC household information (OMB Approval No. 2528-0165, expiration date 05/31/2013). HUD used the previously approved form to collect data on LIHTC tenants in 2009, 2010 and 2011. Renewal of this form is required for HUD to remain in compliance with the statute.
HUD Healthcare Facility Documents: Notice Announcing Final Approved Documents and Assignment of OMB Control Number
This notice announces that the healthcare facility documents have completed the notice and comment processes and review by the Office of Management and Budget (OMB) as required by the Paperwork Reduction Act, and that OMB has assigned a control number to the documents. HUD is soliciting public comments on the subject proposal. HUD's Office of Public and Indian Housing (PIH) provides funding to Public Housing Agencies (PHAs) to administer assisted housing programs. Form HUD-50058 MTW Family Reports solicit demographic, family profile, income and housing information on the entire nationwide population of tenants residing in assisted housing. The information collected through the Form HUD-50058 MTW will be used to monitor and evaluate the Office of PIH's MTW Demonstration program which includes Public Housing, Section 8 Housing Choice Voucher, Section 8 Project Based Certificates and Vouchers, Section 8 Moderate Rehabilitation and MTW Demonstration programs.
Repeal of Disclosure Regulations
The Federal Housing Finance Agency (FHFA) is repealing two obsolete regulations issued by its predecessor agencies, the Office of Federal Housing Enterprise Oversight (OFHEO) and the Federal Housing Finance Board (Finance Board) with respect to the entities regulated by OFHEO and by the Finance Board. The regulations being repealed govern public financial disclosures made by the entities with respect to certain federal securities laws. The Housing and Economic Recovery Act of 2008 obviates the need for these rules, making them obsolete and unnecessary. This final rule repeals the two regulations in their entirety.
Notice of Formula Allocations and Program Requirements for Neighborhood Stabilization Program Formula Grants; Correction
On October 19, 2010, HUD published the ``Notice of Formula Allocations and Program Requirements for Neighborhood Stabilization Program Formula Grants'' (Unified NSP Notice) in the Federal Register, at 75 FR 64322. That notice provided unified program requirements for the NSP1 grantees and NSP3 grantees. The allocation formula, application process and program requirements for NSP1 grantees were originally published in an October 6, 2008 Federal Register Notice at 73 FR 58330 and amended by a June 19, 2009, April 9, 2010, and an August 27, 2010 Federal Register Notice at 74 FR 29223, 75 FR 18228 and 75 FR 52772, respectively. This notice is revising the Unified NSP Notice to include the provision of corrective action(s) or sanctions among HUD's remedial actions for failure of NSP1 grantees to meet the four year expenditure requirement.

Notice of Regulatory Waiver Requests Granted for the Fourth Quarter of Calendar Year 2012

Notice of Single Family Loan Sales (SFLS 2013-1)
This notice announces HUD's intention to competitively sell certain unsubsidized single family mortgage loans, in a sealed bid sale offering called SFLS 2013-1, without Federal Housing Administration (FHA) mortgage insurance. This notice also generally describes the bidding process for the sale and describes certain persons who are ineligible to bid. This first sale of Fiscal Year (FY) 2013 is scheduled for March 2013. FHA also expects to conduct two additional sales in FY 2013 in June and September 2013.
Notice of Submission of Proposed Information Collection to OMB: Community Development Block Grant Recovery (CDBG-R) Program
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. This request identifies the estimated reporting burden associated with the reporting of CDBG-R assisted activities as they are completed and closing out the CDBG-R program. The American Recovery and Reinvestment Act of 2009 (Recovery Act) appropriated $1 Billion in Community Development Block Grant (CDBG) funds to states and local governments that received CDBG funding in Fiscal Year 2008 to carry out, on an expedited basis, eligible activities under the CDBG program. The purpose of the CDBG-R funding was to stimulate the economy through measures that modernized the Nation's infrastructure, improved energy efficiency, and expanded educational opportunities and access to health care. All CDBG-R funds were required to be expended by September 30, 2012. Any CDBG-R funds remaining after that date were recaptured by HUD and returned to Treasury. The Recovery Act did not specify a requirement regarding the date for completion of CDBG-R assisted activities, although grantees were required to give preference to activities that could be started and completed expeditiously. While the CDBG-R expenditure deadline has passed, all CDBG-R assisted activities have not been completed. New activities were added over time when grantees amended their 2008 substantial amendments to add such activities because previously identified activities came in under budget, were identified as imprudent, or did not meet the purposes of the Recovery Act. Once CDBG-R assisted activities meet a national objective and are physically complete, grantees may proceed in closing out their CDBG-R programs. Grantees must complete their final reports in federalreporting.gov before closing out their CDBG-R grants. HUD expects grantees to be ready to begin closing out their grants by March 31, 2013. Once final reports are completed in federalreporting.gov, grantees may begin the process of closing out their CDBG-R grants. This process requires grantees to submit their final federalreporting.gov report and prepare and submit a CDBG-R Program Grantee Closeout Certification, a CDBG-R closeout checklist, Grant Closeout Agreement, and a Federal Financial Report (SF 425) to local HUD Field Offices. The Recovery Act requires that not later than 10 days after the end of each calendar quarter, each recipient that received recovery funds from a federal agency shall submit a report to that agency that contains: (1) The total amount of recovery funds received from that agency; (2) the amount of recovery funds received that were expended or obligated to projects or activities; and (3) a detailed list of all projects or activities for which recovery funds were expended or obligated, including (A) the name of the project or activity; (B) a description of the project or activity; (C) an evaluation of the completion status of the project or activity; (D) an estimate of the number of jobs created and the number of jobs retained by the project or activity; and (E) for infrastructure investments made by State and local governments, the purpose, total cost, and rationale of the agency for funding the infrastructure investment with funds made available under the Recovery Act and name of the person to contact at the agency if there are concerns with the infrastructure investment. An update of the status of activities identified here must be reported quarterly in federalreporting.gov. In addition, not later than 30 calendar days after the end of each calendar quarter, each agency that made Recovery Act funds available to any recipient shall make the information in reports submitted publicly available by posting the information on a Web site. Grantees that have ongoing CDBG-R assisted activities are required to continue reporting quarterly on those activities until they are completed. Information must be submitted using HUD's IDIS system and in federalreporting.gov. Pursuant to Section 1512 of the Recovery Act, CDBG-R grantees must enter the data into IDIS on a quarterly basis for generation of reports by HUD or other entities. In addition, grantees are required to submit reports in federalreporting.gov on a quarterly basis. Grantees will report in IDIS and federalreporting.gov for CDBG-R assisted activities, recordkeeping requirements, and reporting requirements. The Recovery Act imposes additional reporting requirements including, but not limited to, information on the environmental review process, the expected completion of the activity, the type of activity, and the location of the activity.
Notice of Submission of Proposed Information Collection to OMB: Public Housing Reform; Change in Admission and Occupancy Requirements
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The collection of information implements changes to the admission and occupancy requirements for the public housing and Section 8 assisted housing programs made by the Quality Housing and Work Responsibility (QHWRA) Act 1998 (Title V of the FY 1999 HUD appropriations Act, Pub. L. 105-276, 112 Stat. 2518, approved October 21, 1998), which amended the United States Housing Act of 1937. QHWRA made comprehensive changes to HUD's public housing, Section 8 programs. Some of the changes made by the 1998 Act (i.e., QHWRA) affect public housing only and others affect the Section 8 and public housing programs. These changes cover choice of rent, community service and self-sufficiency in public housing; and admission preferences and determination of income and rent in public housing and Section 8 housing assistance programs.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The mission of HUD's Healthy Homes Program is ``To reduce health and safety hazards in housing in a comprehensive and cost effective manner, with a particular focus on protecting the health of children and other sensitive populations in low income households.'' (Leading Our Nation to Healthier Homes: The Healthy Homes Strategic Plan, U.S. Department of Housing and Urban Development Office of Healthy Homes and Lead Hazard Control, 2010, p. 7.) An evaluation and summarization of grants awarded under the program was last completed in 2005 (``An Evaluation of HUD's Healthy Homes Initiative: Current Findings and Outcomes,'' Healthy Housing Solutions, March 5, 2007). The objectives of the Healthy Homes Demonstration (HHD) grants that will be evaluated through the effort described in this notice include: Carrying out direct remediation where housing-related hazards may contribute to injury or illness, with a focus on children's health; Delivering education and outreach activities to protect children from housing-related hazards; and Building capacity to increase the probability that aspects of grant-supported Healthy Homes programs are sustained.

Notice of Submission of Proposed Information Collection to OMB: FHA Insured Mortgage Loan Servicing Involving the Loss Mitigation Programs
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. FHA insurance is an important source of mortgage credit for low and moderate-income borrowers and neighborhoods. Providing assistance, as needed, to enable families to cure their delinquencies and retain their homes stabilizes neighborhoods that might otherwise suffer from deterioration and problems associated with vacant and abandoned properties. Avoidance of foreclosure and the resultant costs also serve to further stabilize the mortgage insurance premiums charged by FHA and the Federal budget receipts generated from those premiums. Notice of Submission of Proposed Information Collection to OMB: Assisted Living Conversion Program (ALCP) and Emergency Capital Repair Program (ECRP)
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The Assisted Living Conversion Program and the Emergency Capital Repair Program application submission requirements are necessary to assist HUD in determining an applicant's eligibility and the capacity to carry out a successful conversion of a project or make the necessary emergency repairs. A careful evaluation of the application is conducted to ensure that the Federal Government's interest is protected and to mitigate any possibilities of fraud, waste, or misuse of public funds. The purpose of collecting the application submission information is for the Department to assess the applicant's worthiness, whether the projects meet statutory and regulatory requirements, or make sound judgments regarding the potential risk to the Government.

Notice of Proposed Information Collection; Comment Request: Fair Housing Training Survey
The proposed information collection requirement described below will be submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. In 2011, HUD's Office of Fair Housing and Equal Opportunity (FHEO) began an outreach initiative to strengthen FHEO's ties with community- based organizations that work with the public. As part of that initiative, FHEO has held a series of training events around the country to bring together public and private fair housing professionals with community leaders and organizations that work directly with members of the public. By training advocates from organizations that work with underserved communities, FHEO hopes that organizations will be able to recognize and report discrimination in the communities they serve. FHEO would like to survey conference participants to see if they have used knowledge and/or distributed informational material they obtained at these events. This information will allow FHEO to access the success of the outreach and the worth of conducting this type of outreach in the future.

This information collection is required to identify families who no longer participate in a HUD rental assistance program due to adverse termination of tenancy and/or assistance, and owe a debt to a Public Housing Agency (PHA). The information is used by PHAs to determine a family's suitability for rental assistance, and avoid providing limited Federal housing assistance to families who have previously demonstrated an inability to comply with HUD program requirements or who have an unpaid debt to a PHA.

Implementation of the Fair Housing Act's Discriminatory Effects Standard
Title VIII of the Civil Rights Act of 1968, as amended (Fair Housing Act or Act), prohibits discrimination in the sale, rental, or financing of dwellings and in other housing-related activities on the basis of race, color, religion, sex, disability, familial status, or national origin.\1\ HUD, which is statutorily charged with the authority and responsibility for interpreting and enforcing the Fair Housing Act and with the power to make rules implementing the Act, has long interpreted the Act to prohibit practices with an unjustified discriminatory effect, regardless of whether there was an intent to discriminate. The eleven federal courts of appeals that have ruled on this issue agree with this interpretation. While HUD and every federal appellate court to have ruled on the issue have determined that liability under the Act may be established through proof of discriminatory effects, the statute itself does not specify a standard for proving a discriminatory effects violation. As a result, although HUD and courts are in agreement that practices with discriminatory effects may violate the Fair Housing Act, there has been some minor variation in the application of the discriminatory effects standard.

Federal Housing Administration (FHA): PowerSaver Home Energy Retrofit Loan Pilot Program: Extension of Pilot Program
On March 31, 2011, HUD published a notice that announced HUD's FHA Home Energy Retrofit Loan Pilot Program (Retrofit Pilot Program) known as FHA PowerSaver, which is a pilot program conducted for loans originated during a period of two years, commencing on May 2, 2011. The Retrofit Pilot Program is authorized by the Energy Innovation Fund of the 2010 Appropriations Act, which directs HUD to conduct an Energy Efficient Mortgage Innovation pilot program targeted to the single family housing market. The March 31, 2011, notice provided that HUD may extend the duration of the pilot program through Federal Register notice. HUD uses this authority to extend the Retrofit Pilot Program to Title I loan applications dated on or before May 4, 2015.
Notice of Submission of Proposed Information Collection to OMB; Family Self-Sufficiency Program Demonstration
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The Department is conducting this study under contract with MDRC and its subcontractors (Branch Associates and M. Davis and Company, Inc.). The project is an evaluation of the Family Self-Sufficiency Program operated at Public Housing Agencies (PHAs) across the U.S. The study will use random assignment methods to evaluate the effectiveness of the program. FSS has operated since 1992 and serves voucher holders and residents of public housing. The FSS model is essentially case management plus an escrow account. FSS case managers create a plan with families to achieve goals and connect with services that will enhance their employment opportunities. Families accrue money in their escrow accounts as they increase their earnings. To date, HUD has funded two other studies of the FSS program, but neither can tell us how well families would have done in the absence of the program. A random assignment model is needed because participant self-selection into FSS limits the ability to know whether program features rather than the characteristics of the participating families caused tenant income gains. Random assignment will limit the extent to which selection bias is driving observed results. The demonstration will document the progress of a group of FSS participants from initial enrollment to program completion (or exit). The intent is to gain a deeper understanding of the program and illustrate strategies that assist participants to obtain greater economic independence. While the main objective of FSS is stable, suitable employment, there are many interim outcome of interest, which include: Getting a first job; getting a higher paying job; self-employment/small business ownership; no longer needing benefits provided under one or more welfare programs; obtaining additional education, whether in the form of a high school diploma, higher education degree, or vocational training; buying a home; buying a car; setting up savings accounts; or accomplishing similar goals that lead to economic independence. Data collection will include the families that are part of the treatment and control groups, as well as PHA staff. Data will be gathered through a variety of methods including surveys, informational interviews, direct observation, and analysis of administrative records.
Privacy Act of 1974; New System of Records, Office of General Counsel E-Discovery Management System: Republication of System Description and Solicitation of Comment
Pursuant to the provision of the Privacy Act of 1974, HUD is providing notice of its formal adoption of a new system of records for the Office of General Counsel (OGC) E-Discovery Management System (EDMS). The OGC discovery productions typically require the preservation, collection and analysis of massive emails, word processing documents, PDF files, spreadsheets, presentations, database entries, and other documents in a variety of electronic file formats, as well as paper records. EDMS is expected to improve significantly the efficiency of OGC's processing of records during the discovery and processing of litigation requests and will dramatically reduce the time spent on the document review and production process.
Notice of Submission of Proposed Information Collection to OMB HOME Investment Partnerships Program
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The information collected through HUD's Integrated Disbursement and Information System (IDIS) (Sec. 92.502) is used by HUD Field Offices, HUD Headquarters and HOME Program Participating Jurisdictions (PJs). The information on program funds committed and disbursed is used by HUD to track PJ performance and to determine compliance with the statutory 24-month commitment deadline and the regulatory 5-year expenditure deadline (Sec. 92.500(d)). The project-specific property, tenant, owner and financial data is used to compile annual reports to Congress required at Section 284(b) of the Act, as well as to make program management decisions about how well program participants are achieving the statutory objectives of the HOME Program. Program management reports are generated by IDIS to provide data on the status of program participants' commitment and disbursement of HOME funds. These reports are provided to HUD staff as well as to HOME PJs. Management reports required in conjunction with the Annual Performance Report (Sec. 92.509) are used by HUD Field Offices to assess the effectiveness of locally designed programs in meeting specific statutory requirements and by Headquarters in preparing the Annual Report to Congress. Specifically, these reports permit HUD to determine compliance with the requirement that PJs provide a 25% match for HOME funds expended during the Federal fiscal year (Section 220 of the Act) and that program income be used for HOME eligible activities (Section 219 of the Act), as well as the Women and Minority Business Enterprise requirements (Sec. 92.351(b)). Financial, project, tenant and owner documentation is used to determine compliance with HOME Program cost limits (Section 212(e) of the Act), eligible activities (Sec. 92.205), and eligible costs (Sec. 92.206), as well as to determine whether program participants are lenders on their overall program performance. The information collected is used to determine insurance eligibility and claim eligibility.
