Implementing Executive Order 13992, Revocation of Certain Executive Orders Concerning Federal Regulation
On November 10, 2020, the U.S. Department of Housing and Urban Development (HUD, or the Department) published an interim final rule that implemented Executive Order 13891, ``Promoting the Rule of Law Through Improved Agency Guidance Documents.'' This order required Federal agencies to publish regulations to codify processes and procedures for issuing guidance documents. HUD created new regulations that outlined HUD policy and procedures for issuing guidance documents. On January 20, 2021, President Biden issued Executive Order 13992, ``Revocation of Certain Executive Orders Concerning Federal Regulation'' which, among other things, revoked Executive Order 13891. After considering the public comments HUD received in response to its interim final rule and given the revocation of Executive Order 13891, this final rule removes the regulations HUD created in January.
Statutorily Mandated Designation of Difficult Development Areas and Qualified Census Tracts: Revision of Effective Date for 2019 and 2020 Designations
This document revises the effective date for designations of ``Difficult Development Areas'' (DDAs) and ``Qualified Census Tracts'' (QCTs) for purposes of the Low-Income Housing Tax Credit (LIHTC) under Internal Revenue Code (IRC) Section 42 (26 U.S.C. 42) published on October 22, 2018, (83 FR 53282) and September 25, 2019, (84 FR 50465) in response to the Presidentially-declared COVID-19 emergency. This notice extends from 730 days to 910 days the period for which the 2019 and 2020 lists of QCTs and DDAs are effective for projects (1) located in an area not on subsequent lists of DDAs or QCTs; and (2) that submitted applications while the area was a 2019 or 2020 QCT or DDA.

Reinstatement of HUD's Discriminatory Effects Standard
In 2020, HUD published a rule titled ``HUD's Implementation of the Fair Housing Act's Disparate Impact Standard'' (``2020 Rule''). Prior to the effective date of the 2020 rule, the U.S. District Court for the District of Massachusetts issued a preliminary injunction in Massachusetts Fair Housing Center v. HUD, staying HUD's implementation and enforcement of the rule. Consequently, the 2020 Rule never took effect. After reconsidering the 2020 Rule, HUD is proposing to recodify its previously promulgated rule titled, ``Implementation of the Fair Housing Act's Discriminatory Effects Standard'' (``2013 Rule''), which, as of the date of publication of this Proposed Rule, remains in effect due to the preliminary injunction. HUD believes the 2013 Rule better states Fair Housing Act jurisprudence and is more consistent with the Fair Housing Act's remedial purposes.

HUD allocated $10.03 billion for the purpose of addressing unmet needs from disasters that occurred in 2017; $2 billion for enhanced or improved electrical power systems in Puerto Rico and the U.S. Virgin Islands; and $15.9 billion for mitigation activities. Restoring Affirmatively Furthering Fair Housing Definitions and Certifications
The Department of Housing and Urban Development (HUD) publishes this interim final rule to restore certain definitions and certifications that have been through notice-and-comment scrutiny and that are grounded in legal precedent to its regulations implementing the Fair Housing Act's requirement to affirmatively further fair housing (AFFH) and reinstate a process by which HUD will provide technical assistance and other support to funding recipients who are engaged in fair housing planning to support their certifications. No program participant will be required to participate in this process, which is for the benefit of those who want assistance in fulfilling their statutory obligations. HUD will provide these services prior to the effective date of this interim final rule. HUD determined that it is necessary for this narrowly focused rule to go into effect on July 31, 2021, because HUD funding recipients must certify compliance with their duty to AFFH on an annual basis and HUD itself has a continuous statutory obligation to ensure that the Fair Housing Act's AFFH obligations are followed. HUD finds that the definitions in the current regulation, which was promulgated in 2020 without notice-and-comment procedures, are at odds with the statutory AFFH duty as described in decades of judicial precedent and agency practice. This risks confusing funding recipients, who are certifying compliance with a regulatory definition that does not in fact satisfy their statutory AFFH obligation. While HUD therefore has determined that this rule will go into effect on July 31, it nonetheless solicits comments on this action so that it may consider public views before the effective date. HUD promulgates this interim final rule to ensure that program participants have regulatory certainty, while delaying the effective date long enough to provide time for HUD to review comments and, if necessary, act on them prior to the effective date.
Notice of Continuation of Demonstration To Test Proposed New Method of Assessing the Physical Conditions of Voucher-Assisted Housing
Through this notice, HUD announces the continuation of HUD's demonstration to test the new method of assessing the physical condition of housing assisted by HUD vouchers (voucher-assisted housing) through October 1, 2022 and renews its call for additional Public Housing Authority (PHA) volunteers (eligible PHAs administering the Housing Choice Voucher (HCV) program). This continuation supports HUD's ability to align the HCV program with the National Standards for the Physical Inspection of Real Estate (NSPIRE) physical inspection model and to assess the HCV program's inspection protocol against this model. Housing Trust Fund: Request for Public Comment on Prior Interim Rule
This document seeks comments regarding the Housing Trust Fund (HTF) program administered by HUD. On January 30, 2015, an interim final rule was published in the Federal Register establishing regulations governing the administration of HTF and the formula that determines how HTF funds are distributed among eligible grantees. In the interim rule, HUD stated its intention to open the interim rule for public comment once funding was made available and the grantees gained experience in administering the HTF program. Since the publication of the interim rule, HTF funds have been allocated to eligible grantees in Federal Fiscal Years 2016 through 2021. Grantees have had adequate time to administer the HTF under the interim rulemaking and gain experience necessary to provide substantive comments on the workability of the HTF program requirements and ways program administration can be improved. In addition to comments on the interim rule, HUD is asking for the public to consider and comment on additional issues that may inform its rulemaking. HUD will consider all comments submitted in undertaking further rulemaking for the HTF.

The Housing and Economic Recovery Act of 2008 (HERA) established the Housing Trust Fund (HTF) to be administered by HUD. Pursuant to the Federal Housing Enterprises Financial Security and Soundness Act of 1992 (the Act), as amended by HERA, Division A, eligible HTF grantees are the 50 states, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, Guam, the Commonwealth of Northern Mariana Islands, and the United States Virgin Islands.
