This final rule amends HUD's regulations for the Section 8 Management Assessment program (SEMAP), by revising the process by which HUD measures and verifies performance under the SEMAP lease-up indicator. Specifically, HUD amends the existing regulation to reflect that assessment of a public housing agency's (PHA) leasing indicator will be based on a calendar year cycle, rather than a fiscal year cycle, which would increase administrative efficiencies for PHAs. This rule also clarifies that units assisted under the voucher homeownership option or occupied under a project-based housing assistance payments (HAP) contract are included in the assessment of PHA units leased.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The Department of Housing and Urban Development Appropriations Act, as approved on November 18, 2011 (Pub. L. 112-55, 125 Stat. 552) authorizes HUD to award training and technical assistance contracts on a competitive basis. HUD intends to competitively award training and technical assistance contracts to national and regional nonprofit and for profit entities with demonstrated experience and expertise in the Native American Housing Assistance and Self-Determination Act of 1996 (NAHASDA). The purpose of the ONAP Training and Technical Assistance program is to improve the quality and quantity of low-income housing in Native American, Alaska Native, and native Hawaiian communities, as funded by Indian Housing Block Grants (IHBG) and Native Hawaiian Housing Block Grants (NHHBG) and authorized by NAHASDA. The regulations for the IHBG program are at 24 CFR part 1000, and for the NHHBG program at 24 CFR part 1006. Successful applicants will have demonstrated training and technical assistance experience and expertise in NAHASDA; low-income housing development, inspection, maintenance, modernization, and operation; admissions and occupancy; procurement; financial and fiscal management; program income; governance and organizational development; leveraged financing, including Low Income Housing Tax Credits; healthy home environments, including mold and air quality issues; homebuyer education; crime prevention; youth activities, including Boys and Girls Clubs; and other topics responsive to low- income housing issues in native communities. Training and technical assistance services will be provided onsite and remotely, on a one-on- one and classroom basis. Respondents to the NOFA will be required to submit a single proposal regardless of the number of programs or areas of expertise for which they offer to provide training and technical assistance. Factors for award include Factor 1: Capacity and Experience, Factor 2: Soundness of Approach, Factor 3: Leveraging, and Factor 4: Achieving Results and Program Evaluation. Narratives addressing Factors 1-4 must be formatted so that the total number of pages submitted is equal to or no more than 25 single-sided pages. The one-page application summary, organizational chart, budget discussion, and required forms are not included in the 25 page limit. Required forms include HUD-2880 (Applicant/Recipient Disclosure Update), HUD- 2993 (Acknowledgement of Application Receipt), HUD-96011 (HUD Facsimile Transmittal), SF-424 (Application for Federal Assistance), and SF-LLL (Disclosure of Lobbying Activities). Applicants must submit their applications electronically to Grants.Gov or request a waiver from HUD. HUD expects to receive 25 applications and select ten awardees to enter in 24-month cooperative agreements, with a 12-month option period.

In 2010 through 2011, HUD commenced and completed the process of revising regulations applicable to, and closing documents used in, FHA insurance of multifamily rental projects, to reflect current policy and practices in the multifamily mortgage market. The multifamily rental project regulations and closing documents had not been updated in more than 20 years. Through this proposed rule, HUD commences a similar process for its regulations governing insurance of healthcare facilities under section 232 of the National Housing Act, and the closing documents used in such transactions. HUD's Section 232 program insures mortgage loans to facilitate the construction, substantial rehabilitation, purchase, and refinancing of nursing homes, intermediate care facilities, board and care homes, and assisted-living facilities. This rule proposes amendments to update HUD's Section 232 regulations, to reflect current policy and practices, and to improve accountability and strengthen risk management.

Consistent with the Paperwork Reduction Act of 1995 (PRA), HUD is publishing for public comment a comprehensive set of closing and other documents used in connection with transactions involving healthcare facilities (excluding hospitals) that are insured pursuant to section 232 of the National Housing Act (Section 232). In addition to meeting PRA requirements, this notice seeks public comment for the purpose of enlisting input from the lending industry and other interested parties in the development, updating, and adoption of a set of instruments (collectively, healthcare facility documents) that offer the requisite protection to all parties in these FHA-insured mortgage transactions, consistent with modern real estate and mortgage lending laws and practices. The healthcare facility documents, which are the subject of this notice, can be viewed on HUD's Web site: www.hud.gov/232forms. HUD is also publishing today a proposed rule that will submit for public comment certain revisions to FHA's Section 232 regulations for the purpose of ensuring consistency between the program regulations and the revised healthcare facility documents.

The Department of Housing and Urban Development (HUD) proposes to establish a new Privacy Act of 1974 (5 U.S.C. 552a) System of Records Notice (SORN) for the Veterans Homelessness Prevention Demonstration Evaluation Data Files (VHPD Data Files) system. The VHPD Data Files system will involve collaborative efforts needed to evaluate certain HUD homelessness prevention programs. The demonstration evaluation will involve data analysis from particular jurisdictions to assist HUD's Office of Policy Development and Research (PD&R) and its researchers with examining cross-agency coordination, expanding data collection and analysis, conducting comprehensive program evaluations, and enhancing homelessness prevention efforts. This provides notice to the public, agencies, and Indian tribes that the City and County of San Francisco's Mayor's Office of Housing (MOH), as the Responsible Entity in accordance with 24 CFR 58.2(a)(7), intends to prepare a Draft Environmental Impact Report/ Environmental Impact Statement (EIR/EIS) for the HOPE SF Development at the Potrero Terrace and Potrero Annex Public Housing Development (Potrero HOPE SF Master Plan Project). The EIR/EIS will be a joint National Environmental Policy Act (NEPA) and California Environmental Quality Act (CEQA) document. The EIR will satisfy requirements of CEQA (Public Resources Code 21000 et seq.) and the State CEQA Guidelines (14 California Code of Regulations 15000 et seq.), which require that state and local government agencies consider the environmental consequences of projects over which they have discretionary authority before acting on those projects. The proposed action is subject to NEPA, because funding for the project may include HUD funds from programs subject to regulation by 24 CFR part 58; these include, but are not limited to, Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974; Home Investment Partnership Program (HOME) grants under Title II of the Cranston- Gonzales National Affordable Housing Act of 1990 as amended; Project Based Section 8 Vouchers under the United States Housing Act of 1937; and/or Section 8(o)(13) and Public Housing operating subsidies for mixed income developments authorized under the U.S. Housing Act of 1937, Section 35. This notice is in accordance with the Council on Environmental Quality (CEQ) regulations at 40 CFR parts 1500-1508. A Draft EIR/EIS will be prepared for the proposed action described herein. Comments relating to the Draft EIR/EIS are requested and will be accepted by the contact person listed below. When the Draft EIR/EIS is completed, a notice will be sent to individuals and groups known to have an interest in the Draft EIR/EIS and particularly in the environmental impact issues identified therein. Any person or agency interested in receiving a notice and making comment on the Draft EIR/ EIS should contact the person listed below within 30-days after publication of this notice. This EIS will be a NEPA document intended to satisfy requirements of federal environmental statutes. In accordance with specific statutory authority and HUD's regulations at 24 CFR part 58 (Environmental Review Procedures for Entities Assuming HUD Environmental Responsibilities), HUD has provided for assumption of its NEPA authority and NEPA lead agency responsibility by the City and County of San Francisco.
