On May 5, 2009, HUD posted on its Web site its ``Notice of Program Requirements for Community Development Block Grant Program Funding Under the American Recovery and Reinvestment Act of 2009.'' The Notice advised the public of statutory and regulatory waivers granted to grantees under the American Recovery and Reinvestment Act of 2009 (Recovery Act), which made $1 billion in Community Development Block Grant (CDBG) funds available to states and local governments to carry out, on an expedited basis, eligible activities under the CDBG program. The May 5, 2009, Notice also indicated that HUD would establish and publish in the Federal Register criteria for reallocating and awarding CDBG-R funds that are not awarded to any eligible jurisdiction. Only one jurisdiction did not apply to receive its Recovery Act allocation. Today's Notice announces the process HUD will use to reallocate this assistance.

This proposed rule would revise the reporting requirements for the Indian Community Development Block Grant (ICDBG) program. First, the rule would provide for submission of a single annual report on the hiring of minority business enterprises, due to HUD each October. Currently, ICDBG grantees are required to report on these activities on a semi-annual basis, with reports being due to HUD on April 10 and October 10 of each year. Second, the proposed rule would require ICDBG grantees to use the Logic Model form developed as part of HUD's Notice of Funding Availability (NOFA) process. Requiring use of the Logic Model would conform ICDBG reporting requirements to those of other HUD competitive funding programs and would help ensure uniformity in the information provided by ICDBG grantees on performance goals, thereby facilitating the evaluation of grantee performance.

Consistent with Administration policy to review rules issued during the transition from one Administration to another, HUD re-opened the January 27, 2009, final rule for public comment, and specifically solicited public comment on extending the effective date of the rule. This proposed rule would conform HUD's Federal Housing Administration (FHA) multifamily mortgage insurance regulations to a provision in Title VIII of the Housing and Economic Recovery Act of 2008 that prohibits a requirement that tax credit sales proceeds be placed into escrow, at the time of initial endorsement, for assurance of project completion and to pay the initial service charge, carrying charges, and legal and organizational expenses incident to the construction of the project. This rule would not prohibit HUD from requiring escrows of funds for other purposes, such as for working capital. The rule would also make other changes intended to reduce burdens on the use of tax credits.
