Examination Guidance
The Office of Federal Housing Enterprise Oversight is publishing today an Examination Guidance, ``Conforming Loan Limit Calculations,'' following two requests for public comment on a proposed examination guidance. Material in the guidance does not constitute a regulation.
Changes in Maximum Mortgage Limits for Multifamily Housing
This rule conforms HUD's regulations to a recent statutory increase in the amount by which HUD may increase the dollar amount limitations on insured mortgages for multifamily housing.
Mortgagee Review Board
This proposed rule would make changes to the Department's Mortgagee Review Board (Board) regulations to clarify and better reflect statutory directives and amend current practice. This proposed rule would modify the Board's procedures governing hearings. Additional revisions proposed by this rule would remove provisions that unnecessarily duplicate the authorizing statute and would clarify the authority and duties of the Board in taking administrative action against mortgagees approved by the Federal Housing Administration. This proposed rule would separate and clarify the grounds for administrative action and the factors considered by the Board in evaluating whether to take administrative action, as well as require the mortgagee to address these factors in its response to the Board's notice of violation. Finally, other organizational changes would be made to improve overall clarity.

Appendix A contains the names and addresses of the agencies competitively selected for funding and the award amounts. Notice of Certification and Funding of State and Local Fair Housing Enforcement Agencies Under the Fair Housing Assistance Program; Request for Comments
The regulations implementing the Fair Housing Assistance Program provide that the Assistant Secretary for Fair Housing and Equal Opportunity will periodically publish a list of all interim and certified agencies; and a list of agencies for which withdrawal of certification has been proposed. The purpose of identifying the agencies in the Federal Register is to solicit public comment on the state or local fair housing laws, as well as the performance of the agencies in enforcing these laws. Notice of HUD's Fiscal Year (FY) 2008 Notice of Funding Availability (NOFA); Policy Requirements and General Section to HUD's FY2008 NOFAs for Discretionary Programs
This notice provides prospective applicants for HUD competitive funding with the opportunity to become familiar with the General Section of HUD's FY2008 NOFAs, in advance of publication of any FY2008 NOFAs. HUD plans to publish its annual SuperNOFA in spring 2008. Early publication of the General Section is one of several steps instituted to improve the funding process for the grantee community. Early publication of the General Section gives prospective applicants additional time to become familiar with and address provisions in the General Section, which constitute part of almost every individual program application. HUD will publish as a technical correction any changes to this General Section made after today's publication. HUD will continue to require that applicants submit their applications electronically via Grants.gov. In FY2008, HUD will be using Adobe Forms applications packages, available on Grants.gov. The Adobe Forms packages are compatible with the Windows Vista operating system, Apple Macintosh computers, and Microsoft Office 2007. Please carefully read the instructions in this notice regarding use of Adobe forms. To submit an application via Grants.gov, new users will be required to complete a five-step registration process, which can take 2 to 4 weeks to complete. The process includes ensuring that information provided by your organization to Dun and Bradstreet (D&B) matches information previously provided by your organization and contained in Internal Revenue Service (IRS) records. If there is a discrepancy in the information, the registration cannot be completed until discrepancy issues are resolved. Applicants that have previously completed the registration process merely have to renew their registration in the Central Contractor Registration (CCR). The renewal process confirms that the registration information is still accurate and allows organizations to make any appropriate changes. During the update process, the CCR will check the D&B information against the IRS records for your organization. If there are discrepancies, the update cannot be completed until the discrepancies are resolved. Please allow adequate time to resolve any registration issues. Failure to update the registration in the CCR before the CCR registration expires will result in an applicant having to complete the five steps of the renewal process. If an applicant changes the eBusiness Point of Contact in the CCR registration, it should make sure the new eBusiness Point of Contact has also granted permission to the person submitting the application to be the Authorized Organization Representative (AOR). To submit an application to HUD, the AOR must be able to make a legally binding agreement for the organizational entity. Please see detailed registration instructions in section IV.B. of this notice. HUD recommends that all prospective applicants take the time to carefully read the Notice entitled ``Notice of Opportunity to Register Early and other Important Information for Electronic Application Submission via Grants.gov,'' published on March 10, 2008 (73 FR 12751). Housing Counseling Program-Application for Approval as a Housing Counseling Agency
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. National, regional, Multi-State intermediaries and Local public and private nonprofit agencies that provide housing counseling services directly or through their affiliates or branches regarding home buying, homeownership and rental housing programs submit an application for designation as a HUD-approved housing counseling agency. HUD uses the information to evaluate the agency and populate Agency profile data in the Housing Counseling System (HCS) database. This data populates the HUD's Web site and automated 1-800 Hotline.

Real Estate Settlement Procedures Act (RESPA) Website Complaint Questionnaire
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. The Real Estate Settlement Procedures Act of 1974 (RESPA), 12 U.S.C. 2601 et seq., and the implementing Regulation, codified at 24 CFR 3500, insure that consumers throughout the Nation are provided with greater and more timely information on the nature and costs of the settlement process and are protected from unnecessarily high settlement charges caused by certain abusive practices. The RESPA Website Complaint Questionnaire will provide a common website for consumers and settlement service providers to assist in the enforcement of RESPA, and will create efficiencies in processing complaints.

Alternative Housing Pilot Program Evaluation Baseline Survey
The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. HUD is conducting an evaluation of FEMA's Alternative Housing Pilot Program (AHPP). Due to the immediate need to improve the temporary housing situation for many victims of Hurricanes Katrina and Rita, FEMA is rapidly developing the alternative housing. In order to measure program effectiveness, the evaluation requires that we do a baseline evaluation of households before they receive a housing unit. Because it has taken longer than expected for FEMA's AHPP to be implemented in some States, new households continue to join the program and so there is a need to continue the administration to the baseline survey beyond March 2007 when the original clearance expires.

Notice of Proposed Information Collection: Comment Request Public Housing Inventory Removal Application

Real Estate Settlement Procedures Act (RESPA): Proposed Rule To Simplify and Improve the Process of Obtaining Mortgages and Reduce Consumer Settlement Costs
This proposed rule presents HUD's proposal to simplify and improve the disclosure requirements for mortgage settlement costs under the Real Estate Settlement Procedures Act of 1974 (RESPA), to protect consumers from unnecessarily high settlement costs. This proposed rule takes into consideration: discussions during HUD's RESPA Reform Roundtables held in July and August 2005; public comments in response to HUD's July 29, 2002, proposed rule that addressed RESPA reform; and comments received and views expressed through congressional hearings; meetings with affected parties; and consultation with other federal agencies, including the Small Business Administration Office of Advocacy. HUD's objective in proposing these revisions is to protect consumers from unnecessarily high settlement costs by taking steps to: Improve and standardize the Good Faith Estimate (GFE) form, to make it easier to use for shopping among settlement service providers; ensure that page one of the GFE provides a clear summary of the loan terms and total settlement charges so that borrowers will be able to use the GFE to comparison shop among loan originators for a mortgage loan; provide more accurate estimates of costs of settlement services shown on the GFE; improve disclosure of yield spread premiums to help borrowers understand how they can affect their settlement charges; facilitate comparison of the GFE and the HUD-1/HUD-1A Settlement Statements (HUD-1 settlement statement or HUD-1); ensure that at settlement borrowers are made aware of final loan terms and settlement costs, by reading and providing a copy of a ``closing script'' to borrowers; clarify HUD-1 instructions; clarify HUD's current regulations concerning discounts; and expressly state when RESPA permits certain pricing mechanisms that benefit consumers, including average cost pricing and discounts, including volume based discounts.
HUD Office of Hearings and Appeals; Conforming Changes To Reflect Organization Regulations
This final rule revises HUD's regulations to reflect the organization of HUD's Office of Hearings and Appeals (OHA). HUD has established the Office of Hearings and Appeals within the Office of the Secretary. As a result of the organization of the OHA, the position of the Chief Administrative Law Judge (Chief ALJ) has been eliminated. This rule makes conforming changes to HUD regulations to reflect this change.

Notice of Fiscal Year (FY) 2008 Opportunity To Register Early and Other Important Information for Electronic Application Submission Via Grants.gov
This notice provides instructions to potential applicants applying for funding under HUD's grant programs available through Grants.gov. This notice does not pertain to applicants who will be applying in Fiscal Year (FY) 2008 for Continuum of Care funds. HUD will publish a separate notice to address the receipt of Continuum of Care applications in FY2008. This notice provides information to help applicants better understand the registration and electronic submission process for HUD applications made available through Grants.gov. Grants.gov is the federal portal for applicants to electronically find and apply for over 1,000 funding opportunities made available by 26 Federal grant-making agencies. Grants.gov offers the applicant community a common Web site where applicants can apply for a variety of federal assistance programs. To date, all 26 Federal grant-making agencies have posted their funding opportunities and electronic application packages to Grants.gov. HUD believes that by facilitating a better understanding of the electronic submission process, applicants will be able to more easily make the transition to electronic application submission. HUD advises potential applicants to carefully read this notice and immediately begin the registration process or renew their registration from prior years. To apply on-line electronically, Grants.gov requires an electronically authorized signature, known as e-Authentication. This requirement for an authenticated electronic signature serves to protect the applicant and the applicant's information, and to assure federal agencies that they are interacting with officials authorized to submit applications on behalf of applicant entities. Through this notice, HUD is encouraging applicants to complete or update their registration, in advance of HUD posting its FY2008 grant opportunities. HUD found that issuing an Early Registration Notice eliminates many last minute registration issues, and allows applicants time to ensure that all steps in the registration process have been completed. This Notice also provides time for applicants to have their questions addressed regarding the registration and submission processes. HUD strongly encourages prospective applicants for FY2008 HUD grants to register or update/renew their registration for application submission via Grants.gov as soon as possible by following the instructions in this notice. HUD anticipates that it will post its funding opportunities in the Spring of 2008.
Multifamily Mortgage Insurance Premiums; Withdrawal of Proposal To Implement Changes in Mortgage Insurance Premiums for FY2008
On October 18, 2007, HUD published, for public comment, a notice announcing proposed changes in the mortgage insurance premiums (MIP) for certain Federal Housing Administration (FHA) multifamily mortgage insurance programs whose commitments will be issued or reissued in Fiscal Year (FY) 2008. Based on consideration of the concerns raised in the public comments, HUD has decided not to proceed with implementation of the proposed MIP increases for FY2008. The MIPs in effect during FY2006 and FY2007 will be the same rates applied to commitments issued or reissued in FY2008.

The Department is soliciting public comments on the subject proposal. HUD-approved agencies are non-profit and government organizations that provide housing services. The information collected allows HUD to monitor and provide oversight for agencies approved to participate in the Housing Counseling Program. Specifically, the information collected is used to ensure that participating agencies comply with program policies and regulations and to determine if agencies remain eligible to maintain an approval status. Housing counseling aids tenants and homeowners in improving their housing conditions and in meeting the responsibilities of tenancy and homeownership.
