The Federal Emergency Management Agency (FEMA) is withdrawing its notice of proposed rulemaking concerning proposed flood elevation determinations for Mercer County, North Dakota and Incorporated Areas.

The Federal Emergency Management Agency (FEMA), in cooperation with other Federal agencies, intends to prepare an environmental impact statement (EIS) evaluating the environmental impacts associated with funding activities to reduce flood impacts and to restore habitat for fish and wildlife within Tillamook County, Oregon. FEMA intends to provide funding for the project, known as the Southern Flow Corridor project, to the Port of Tillamook Bay (Applicant) through FEMA's Public Assistance (PA) grant program. Other funding for the project comes from the National Oceanic and Atmospheric Administration (NOAA) Restoration Center, State of Oregon lottery funds, U.S. Fish and Wildlife Service, Oregon Watershed Enhancement Board, and Tillamook County. Other public and private entities may also provide funding to support the Project.

Base (1% annual-chance) Flood Elevations (BFEs) and modified BFEs are made final for the communities listed below. The BFEs and modified BFEs are the basis for the floodplain management measures that each community is required either to adopt or to show evidence of being already in effect in order to qualify or remain qualified for participation in the National Flood Insurance Program (NFIP).

The Federal Emergency Management Agency (FEMA) is withdrawing its proposed rule concerning proposed flood elevation determinations for Natchitoches Parish, Louisiana, and Incorporated Areas.

This notice lists communities where the addition or modification of Base Flood Elevations (BFEs), base flood depths, Special Flood Hazard Area (SFHA) boundaries or zone designations, or the regulatory floodway (hereinafter referred to as flood hazard determinations), as shown on the Flood Insurance Rate Maps (FIRMs), and where applicable, in the supporting Flood Insurance Study (FIS) reports, prepared by the Federal Emergency Management Agency (FEMA) for each community, is appropriate because of new scientific or technical data. The FIRM, and where applicable, portions of the FIS report, have been revised to reflect these flood hazard determinations through issuance of a Letter of Map Revision (LOMR), in accordance with Title 44, Part 65 of the Code of Federal Regulations (44 CFR Part 65). The LOMR will be used by insurance agents and others to calculate appropriate flood insurance premium rates for new buildings and the contents of those buildings. For rating purposes, the currently effective community number is shown in the table below and must be used for all new policies and renewals.

This Final Rule revises the Federal Emergency Management Agency (FEMA) regulations by changing submission requirements for State Mitigation Plans. This Final Rule reduces the frequency by which States must submit updates to FEMA on their State Mitigation Plans. Previously, these entities prepared and submitted updates with FEMA for review and approval every 3 years. Now, these entities will prepare and submit updates with FEMA for review and approval every 5 years.

This Notice provides guidelines that describe the application process for grants and the criteria for awarding Fire Prevention and Safety (FP&S) grants in the fiscal year (FY) 2013 Assistance to Firefighters Grant (AFG) Program year. FP&S Grants are made available directly to fire departments; national, regional, state, and local organizations; native American tribal organizations, and nonprofit organizations that are recognized for their experience in fire prevention and safety programs and activities. The grant program's authorizing statute requires that a minimum of 10 percent of available grant funds for AFG be expended for the FP&S Grant Program.

If the Federal Emergency Management Agency (FEMA) receives documentation that the community has adopted the required floodplain management measures prior to the effective suspension date given in this rule, the suspension will not occur and a notice of this will be provided by publication in the Federal Register on a subsequent date. The Notice of Intent to prepare an Environmental Impact Statement on the Federal Emergency Management Agency's (FEMA) National Flood Insurance Program (NFIP) was published in the May 16, 2012 Federal Register at 77 FR 28891, and requested public comments no later than July 16, 2012. Thirty-nine comments were received. Due to the extenuating circumstances caused by the passage of a 5- year NFIP reauthorization (See Biggert-Waters Flood Insurance Reform Act of 2012, Pub. L. 112-141, 126 Stat. 405), interested parties requested an extension of the initial comment period. FEMA reopened the comment period for submitting public comments to October 9, 2012, for Docket ID FEMA-2012-0012 through publication in the Federal Register at 77 FR 50706 on August 22, 2012. Two comments were received. The comments received as part of the NOI will be considered in the preparation of this PEIS. This notice sets forth the dates of public scoping meetings FEMA intends to hold online, as Webinars, to inform the public about FEMA's intended PEIS process and receive additional comments from the public.
