Agency: Department of Energy
This notification announces receipt of and publishes a petition for waiver and interim waiver from Samsung HVAC America LLC (``Samsung''), which seeks a waiver for specified basic models of central air conditioners (``CACs'') and heat pumps (``HPs'') (collectively, ``CAC/HPs'') from the U.S. Department of Energy (``DOE'') test procedure used for determining the efficiency of CAC/ HPs. DOE also gives notification of an Interim Waiver Order that requires Samsung to test and rate the specified CAC/HP basic models in accordance with the alternate test procedure set forth in the Interim Waiver Order. DOE solicits comments, data, and information concerning Samsung's petition and its suggested alternate test procedure to inform DOE's final decision on Samsung's waiver request.

Notice of Intent to Prepare an Environmental Impact Statement for High-Assay Low-Enriched Uranium (HALEU) Availability Program Activities in Support of Commercial Production of HALEU Fuel
Document Number: 2023-11877
Type: Notice
Date: 2023-06-05
Agency: Department of Energy
In the Energy Act of 2020, the Secretary of Energy is charged with establishing and carrying out, through the Office of Nuclear Energy, a program to support the availability of uranium enriched to greater than 5 and less than 20 weight percent uranium-235 (U-235) (i.e., high-assay low-enriched uranium [HALEU]), for civilian domestic research, development, demonstration, and commercial use. Consistent with the objectives of, and direction in the Energy Act of 2020, the Department of Energy (DOE) proposes to take actions to establish a temporary domestic demand for HALEU to stimulate a diverse, domestic commercial HALEU supply that could ultimately lead to a competitive HALEU market and a more certain domestic HALEU demand. To this end, DOE intends to prepare an environmental impact statement (EIS) in accordance with the National Environmental Policy Act (NEPA) and its implementing regulations that will analyze the impacts of DOE's Proposed Action to facilitate the domestic commercialization of HALEU production and to acquire HALEU for ultimate commercial use or demonstration projects.

Energy Conservation Program: Test Procedure for Commercial Warm Air Furnaces
Document Number: 2023-11341
Type: Rule
Date: 2023-06-02
Agency: Department of Energy
The U.S. Department of Energy (DOE) is amending the Federal test procedures for commercial warm air furnaces (CWAFs) to incorporate the latest versions of the industry test standards that are currently incorporated by reference. DOE is also establishing a new metric, Thermal Efficiency Two (TE2), and corresponding test procedure. Use of the newly established test procedure would become mandatory at such time as compliance with amended energy conservation standards based on TE2 is required, should DOE adopt such standards. DOE also is adopting additional specifications for CWAFs with multiple flue outlets or small flue outlets.
Energy Conservation Program: Energy Conservation Standards for Computer Room Air Conditioners
Document Number: 2023-10859
Type: Rule
Date: 2023-06-02
Agency: Department of Energy
The Energy Policy and Conservation Act, as amended (EPCA), prescribes energy conservation standards for various consumer products and certain commercial and industrial equipment, including small, large, and very large commercial package air conditioning and heating equipment, of which computer room air conditioners (CRACs) are a category. EPCA requires the U.S. Department of Energy (DOE or the Department) to consider the need for amended standards each time American Society of Heating, Refrigeration and Air Conditioning Engineers (ASHRAE) Standard 90.1 is amended with respect to the standard levels or design requirements applicable to that equipment, or periodically under a six-year-lookback review provision. In this final rule, DOE is adopting amended energy conservation standards for CRACs that rely on a new efficiency metric and are equivalent to those levels specified in ASHRAE Standard 90.1-2019. DOE has determined that it lacks the clear and convincing evidence required by the statute to adopt standards more stringent than the levels specified in the industry standard.
Energy Conservation Program: Energy Conservation Standards for Air Cooled, Three-Phase, Small Commercial Air Conditioners and Heat Pumps With a Cooling Capacity of Less Than 65,000 Btu/h and Air-Cooled, Three-Phase, Variable Refrigerant Flow Air Conditioners and Heat Pumps With a Cooling Capacity of Less Than 65,000 Btu/h
Document Number: 2023-10181
Type: Rule
Date: 2023-06-02
Agency: Department of Energy
In this final rule, the U.S. Department of Energy (DOE or the Department) is adopting amended energy conservation standards for air cooled, three-phase, small commercial air conditioners and heat pumps with a cooling capacity of less than 65,000 Btu/h and air-cooled, three-phase, variable refrigerant flow air conditioners and heat pumps with a cooling capacity of less than 65,000 Btu/h that rely on new efficiency metrics and align with amended efficiency levels in the industry standard. For the relevant equipment classes, DOE has determined that it lacks clear and convincing evidence required by the statute to adopt standards more stringent than the levels specified in the industry standard.
Energy Conservation Program: Energy Conservation Standards for Electric Motors
Document Number: 2023-10019
Type: Rule
Date: 2023-06-01
Agency: Department of Energy
The Energy Policy and Conservation Act, as amended (``EPCA''), prescribes energy conservation standards for various consumer products and certain commercial and industrial equipment, including electric motors. EPCA also requires the U.S. Department of Energy (``DOE'') to periodically determine whether more-stringent, standards would be technologically feasible and economically justified, and would result in significant energy savings. In this direct final rule, DOE is adopting new and amended energy conservation standards for electric motors. It has determined that the new and amended energy conservation standards for these products would result in significant conservation of energy, and are technologically feasible and economically justified.

Energy Conservation Program: Energy Conservation Standards for Electric Motors
Document Number: 2023-10018
Type: Proposed Rule
Date: 2023-06-01
Agency: Department of Energy
The Energy Policy and Conservation Act, as amended (``EPCA''), prescribes energy conservation standards for various consumer products and certain commercial and industrial equipment, including electric motors. In this document, DOE proposes amended energy conservation standards for electric motors identical to those set forth in a direct final rule published elsewhere in this Federal Register. If DOE receives an adverse comment and determines that such comment may provide a reasonable basis for withdrawing the direct final rule, DOE will publish a notice withdrawing the direct final rule and will proceed with this proposed rule.
