DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to implement a section of the National Defense Authorization Act for Fiscal Year 2017 that makes amendments regarding the treatment of independent research and development expenditures and requires the Defense Contract Audit Agency to provide an annual report to Congress on independent research and development and bid and proposal expenditures.
Federal Acquisition Regulation: Accelerated Payments Applicable to Contracts With Certain Small Business Concerns
DoD, GSA, and NASA are proposing to amend the Federal Acquisition Regulation (FAR) to implement a section of the National Defense Authorization Act for Fiscal Year 2020 to provide for accelerated payments to small business contractors and subcontractors and a comparable statute applicable only to the Department of Defense.
Federal Register Notice of Request for Written Comments in Support of the Department of Defense's One-Year Response to Executive Order 14017, “America's Supply Chains”
On February 24, 2021, President Biden issued an Executive Order (E.O.) titled America's Supply Chains, which directs six Federal agencies to conduct a review of their respective industrial bases, with the objective to use this assessment to secure and strengthen America's supply chains. One of these directives is for the Secretary of Defense, in consultation with the heads of appropriate agencies, to submit a report on supply chains for the defense industrial base, including key vulnerabilities and potential courses of action to strengthen the defense industrial base. The effort will build on the E.O. report, Assessing and Strengthening the Manufacturing and Defense Industrial Base and Supply Chain Resiliency of the United States (released October 2018) and the Annual Industrial Capabilities Report, which is mandated by the Congress.

The Fiscal Year (FY) 2021 lodging rate review resulted in lodging rate changes in certain locations.

Legislative Environmental Impact Statement Addressing Land Withdrawal Extension at Fort Wainwright, Alaska
The Department of the Army (Army) announces its intent to conduct public scoping under the National Environmental Policy Act (NEPA) and solicit public comments to gather information to prepare a Legislative Environmental Impact Statement (LEIS) to address continued military use of the Yukon Training Area, near Fort Wainwright, and Donnelly Training Area East and Donnelly Training Area West, near Delta Junction, Alaska. The scoping process will help identify reasonable alternatives, potential environmental impacts, and key issues of concern to be evaluated in the LEIS. Information presented in the LEIS will inform proposed legislation presented to Congress and ultimately Congress's decision regarding the proposed action. The current land withdrawal will expire on November 6, 2026, unless Congress enacts legislation to extend it. The Army is requesting identification of potential alternatives, information sources, and analysis relevant to the proposed action. The scoping period will last 30 days and will include a virtual public meeting.

The DoD, acting through SCO and with the United States (U.S.) Department of Energy (DOE) serving as a cooperating agency, announces the availability of the Draft Construction and Demonstration of a Prototype Mobile Microreactor Environmental Impact Statement. SCO is also announcing a public comment period and public hearings on the Draft EIS. SCO prepared the Draft EIS to evaluate the potential environmental impacts of alternatives for constructing and operating a prototype mobile microreactor capable of producing 1 to 5 megawatts of electrical power (MWe).

DoD, GSA, and NASA issued a proposed rule on July 30, 2021, amending the Federal Acquisition Regulation (FAR) to implement an Executive order (E.O.) addressing domestic preferences in Government procurement. The deadline for submitting comments is being extended from September 28, 2021 to October 28, 2021 to provide additional time for interested parties to provide comments on the FAR case.
National Nuclear Security Administration Pay and Performance System
In accordance with the Fiscal Year 2018 National Defense Authorization Act, the DON announces that the NNPP, a joint activity of the DON and the Department of Energy (DOE), NNPP will convert from the General Schedule (GS) Classification and Pay System and the DON Interim Performance Management System (IPMS) to the NNSA pay and performance System, also known as the NNSA Demonstration Project. This conversion will align DON employees of the NNPP with their counterparts in the DOE, NNSA, and bring parity to the pay and performance systems within the Nuclear Propulsion workforce.

The U.S. Army Corps of Engineers (USACE), Seattle District, is announcing its intent to prepare a supplemental environmental impact statement (SEIS) in compliance with the National Environmental Policy Act for the express purpose of addressing updates to the implementation of Howard A. Hanson Dam (HAHD) downstream fish passage to be instituted as part of the Additional Water Storage Project on the Green River in King County, Washington. The SEIS will supplement the HAHD Additional Water Storage Project Final Feasibility Report and Final EIS (August 1998) prepared by USACE.
Privacy Act of 1974; Implementation
The Department of Defense (DoD or Department) is issuing a final rule to amend its regulations to exempt portions of the DoD-0005, Defense Training Records system of records from certain provisions of the Privacy Act of 1974. The U.S. Navy hereby announces that a Certificate of Alternate Compliance has been issued for USS CANBERRA (LCS 30). Due to the special construction and purpose of this vessel, the Deputy Assistant Judge Advocate General (DAJAG) (Admiralty and Maritime Law) has determined it is a vessel of the Navy which, due to its special construction and purpose, cannot comply fully with the navigation lights provisions of the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS) without interfering with its special function as a naval ship. The intended effect of this notice is to warn mariners in waters where 72 COLREGS apply.

The Assistant Secretary of the Army for Civil Works signed the ROD on August 27, 2021.
