Improving Government Regulations; Unified Agenda of Federal Regulatory and Deregulatory Actions

The Department of Defense (DoD) is publishing this semiannual agenda of regulatory documents, including those that are procurement- related, for public information and comments under Executive Order 12866, ``Regulatory Planning and Review.'' This agenda incorporates the objective and criteria, when applicable, of the regulatory reform program under the Executive Order and other regulatory guidance. It contains DoD issuances initiated by DoD components that may have economic and environmental impact on State, local, or tribal interests under the criteria of Executive Order 12866. Although most DoD issuances listed in the agenda are of negligible public impact, their nature may be of public interest and, therefore, are published to provide notice of rulemaking and an opportunity for public participation in the internal DoD rulemaking process. Members of the public may submit comments on individual proposed and interim final rulemakings at www.regulations.gov during the comment period that follows publication in the Federal Register. This agenda updates the report published on July 7, 2011, and includes regulations expected to be issued and under review over the next 12 months. The next agenda is scheduled to be published in the spring of 2012. In addition to this agenda, DoD components also publish rulemaking notices pertaining to their specific statutory administration requirements as required. Starting with the fall 2007 edition, the Internet became the basic means for disseminating the Unified Agenda. The complete Unified Agenda will be available online at www.reginfo.gov, in a format that offers users the ability to obtain information from the Agenda database. Because publication in the Federal Register is mandated for the regulatory flexibility agendas required by the Regulatory Flexibility Act (5 U.S.C. 602), the Department of Defense's printed agenda entries include only: (1) Rules that are in the Agency's regulatory flexibility agenda, in accordance with the Regulatory Flexibility Act, because they are likely to have a significant economic impact on a substantial number of small entities; and (2) any rules that the Agency has identified for periodic review under section 610 of the Regulatory Flexibility Act. Printing of these entries is limited to fields that contain information required by the Regulatory Flexibility Act's agenda requirements. Draft Environmental Impact Statement for the Clearwater Program

The U.S. Army Corps of Engineers (Corps) in conjunction with the Sanitation Districts of Los Angeles County (Sanitation Districts) has completed a Draft Environmental Impact Statement/Environmental Impact Report (EIS/EIR) for the Clearwater Program. The Clearwater Program is a comprehensive planning effort undertaken by the Sanitation Districts. Its purpose is to develop a long-range Master Facilities Plan for the Joint Outfall System, a regional wastewater management system serving approximately 4.8 million people in 73 cities and unincorporated areas in Los Angeles County. A major component of the Clearwater Program is the evaluation of alternatives for new ocean outfalls and rehabilitation of the existing ocean outfalls. Both activities would entail discharge of dredged and fill material in waters of the United States, work in navigable waters of the United States, and the transport of dredged material for ocean disposal. These activities would require authorization from the Corps pursuant to Section 404 of the Clean Water Act, Section 10 of the Rivers and Harbors Act, and Section 103 of the Marine Protection, Research, and Sanctuaries Act, respectively.
Meeting of the Defense Advisory Committee on Women in the Services (DACOWITS)

Pursuant to Section 10(a), Public Law 92-463, as amended, notice is hereby given of a forthcoming meeting of the Defense Advisory Committee on Women in the Services (DACOWITS). The purpose of the meeting is to receive briefings on sexual harassment programs, health issues in combat zone deployments, leadership accountability in the prevention of sexual assault and harassment, and an update on the Women in Services Restrictions report. The meeting is open to the public, subject to the availability of space. Interested persons may submit a written statement for consideration by the Defense Advisory Committee on Women in the Services. Individuals submitting a written statement must submit their statement to the Point of Contact listed at the address detailed in FOR FURTHER INFORMATION CONTACT no later than 5 p.m., Tuesday, February 28, 2012. If a written statement is not received by Tuesday, February 28, 2012, prior to the meeting, which is the subject of this notice, then it may not be provided to or considered by the Defense Advisory Committee on Women in the Services until its next open meeting. The Designated Federal Officer will review all timely submissions with the Defense Advisory Committee on Women in the Services Chairperson and ensure they are provided to the members of the Defense Advisory Committee on Women in the Services. If members of the public are interested in making an oral statement, a written statement should be submitted. After reviewing the written comments, the Chairperson and the Designated Federal Officer will determine who of the requesting persons will be able to make an oral presentation of their issue during an open portion of this meeting or at a future meeting. Determination of who will be making an oral presentation is at the sole discretion of the Committee Chair and the Designated Federal Officer and will depend on time available and if the topics are relevant to the Committee's activities. Two minutes will be allotted to persons desiring to make an oral presentation. Oral presentations by members of the public will be permitted only on Thursday, March 1, 2012 from 1:45 p.m. to 2:30 p.m. in front of the full Committee. Number of oral presentations to be made will depend on the number of requests received from members of the public.

Meeting of the U.S. Naval Academy Board of Visitors

The U.S. Naval Academy Board of Visitors will meet to make such inquiry, as the Board shall deem necessary, into the state of morale and discipline, the curriculum, instruction, physical equipment, fiscal affairs, and academic methods of the Naval Academy. The executive session of this meeting from 11 a.m. to 12 p.m. on March 5, 2012, will include discussions of disciplinary matters, law enforcement investigations into allegations of criminal activity, and personnel issues at the Naval Academy, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy. For this reason, the executive session of this meeting will be closed to the public.
Notice of Intent To Prepare a Supplemental Environmental Impact Statement for a Live-Fire Training Range Complex on Guam To Support the Guam Military Relocation

Pursuant to Section 102(2)(c) of the National Environmental Policy Act (NEPA) of 1969, as implemented by the Council on Environmental Quality Regulations (40 CFR parts 1500-1508), the Department of the Navy (DoN) announces its intent to prepare a Supplemental Environmental Impact Statement (SEIS) to evaluate the potential environmental consequences that may result from construction and operation of a live-fire training range complex and associated infrastructure on Guam to support the Guam Military Relocation. The SEIS supplements the Final EIS for the ``Guam and Commonwealth of the Northern Mariana Islands (CNMI) Military Relocation; Relocating Marines from Okinawa, Visiting Aircraft Carrier Berthing, and Army Air and Missile Defense Task Force'' dated July 2010. Pursuant to 40 CFR 1502.9(c), a SEIS is being prepared for the limited purpose of supplementing the 2010 Final EIS regarding the establishment of a live-fire training range complex on Guam. The proposed action that will be analyzed in the SEIS is to construct and operate a live-fire training range complex that allows for simultaneous use of all firing ranges to support training and operations on Guam for the relocated Marines. The DoN has preliminarily identified five alternatives for the range complex: two are adjacent to Route 15 in northeastern Guam, and three are located at or immediately adjacent to the Naval Magazine (NAVMAG), also known as the Naval Munitions Site. The SEIS will also consider the No Action Alternative. The purpose and need for the proposed action is to ensure that the relocated Marines are organized, trained, and equipped as mandated in section 5063 of Title 10 of the United States Code, and to satisfy individual live-fire training requirements as described in the Guam and CNMI Military Relocation Final EIS and associated Record of Decision (ROD). The live-fire training range complex will consist of a Known Distance (KD) rifle range, KD pistol range, Modified Record of Fire Range, nonstandard small arms range, Multipurpose Machine Gun range, and a hand grenade range. The proposed action also includes associated roadways and supporting infrastructure. The DoN encourages government agencies, private-sector organizations, and the general public to participate in the NEPA process for the training range complex. Because the Federal Aviation Administration (FAA) will have to approve airspace associated with the training range complex at any of the five preliminary alternatives being considered, the DoN will invite the FAA to participate as a cooperating agency in the preparation of the SEIS. The DoN invites comments on the proposed scope and content of the SEIS from all interested parties. Comments on the scope of the SEIS may be provided by mail and through the SEIS Web site at: https://bit.ly/ GuamLFTRCSEIS. In addition, the DoN will conduct public open-house scoping meetings on Guam to obtain comments on the scope of the SEIS and to identify specific environmental concerns or topics for consideration in the SEIS.
