Brake Rotors From the People's Republic of China: Preliminary Results of Changed Circumstances Antidumping Duty Administrative Review

The Department of Commerce (``the Department'') is currently conducting a changed circumstances administrative review of the antidumping duty order on brake rotors from the People's Republic of China (``PRC''). We have preliminarily determined that Shanxi Fengkun Foundry Ltd., Co. (``Fengkun Foundry'') is not the successor-in- interest to Shanxi Fengkun Metallurgical Ltd., Co. (``Fengkun Metallurgical'') for purposes of determining antidumping liability. Interested parties are invited to comment on these preliminary results. In accordance with 19 CFR 351.216(e), the Department will issue the final results of this antidumping duty changed circumstances review not later than July 11, 2005 (i.e., 270 days after the date on which this review was initiated).

In response to requests from interested parties, the Department of Commerce is conducting administrative reviews of the antidumping duty orders on antifriction bearings (other than tapered roller bearings) and parts thereof from France, Germany, Italy, Japan, Singapore, and the United Kingdom. The merchandise covered by these orders are ball bearings and parts thereof (ball bearings) from France, Germany, Italy, Japan, Singapore, and the United Kingdom and spherical plain bearings and parts thereof from France. The reviews cover 19 manufacturers/exporters. The period of review is May 1, 2003, through April 30, 2004. We have preliminarily determined that sales have been made below normal value by various companies subject to these reviews. If these preliminary results are adopted in our final results of administrative reviews, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on all appropriate entries. We invite interested parties to comment on these preliminary results. Parties who submit comments in these reviews are requested to submit with each argument (1) a statement of the issue and (2) a brief summary of the argument.

The Department of Commerce is issuing final regulations implementing Section 501(e) and Section 504(b) of the Trade and Development Act of 2000 (``the Act''). Section 501(e) requires the President to fairly allocate tariff rate quotas on the import of certain worsted wool fabrics, tariff rate quotas which were established by Sections 501(a) and 501(b) of the Act. Section 504(b) authorizes the President to modify the limitations on worsted wool fabric imports under the tariff rate quotas. The President has delegated to the Secretary of Commerce the authority to allocate the quantity of imports under the tariff rate quotas and to determine whether the limitations on the quantity of imports under the tariff rate quotas should be modified.
President's Export Council: Meeting of the President's Export Council

In response to a request from V&M do Brasil, S.A., the Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on small diameter seamless carbon and alloy steel standard, line and pressure pipe from Brazil (A-351- 826). This administrative review covers imports of subject merchandise from V&M do Brasil, S.A. (VMB). The period of review (POR) is August 1, 2003, through July 31, 2004. We preliminarily determine that sales of subject merchandise by VMB have been made at less than normal value (NV). If these preliminary results are adopted in our final results, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on appropriate entries based on the difference between the constructed export price (CEP) and the NV. In response to a request from United States Steel Corporation, the Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on certain oil country tubular goods (OCTG) from Mexico. The period of review (POR) is August 1, 2003, through July 31, 2004. We preliminarily find that Hylsa, S.A. de C.V (Hylsa) made sales of the subject merchandise at less than normal value (NV). In addition, we are preliminarily rescinding this review with respect to Tubos de Acero de Mexico, S.A. (Tamsa) because Tamsa reported, and we confirmed, that it made no shipments of subject merchandise to the United States during the POR. If these preliminary results are adopted in the final results of this administrative review, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties based on the difference between constructed value (CV) and the NV for Hylsa. The period of review (POR) is August 1, 2003, through July 31, 2004. Silcotub informed the Department that it would not be participating in the review. Accordingly, we preliminarily determine that the application of adverse facts available (AFA) is warranted with respect to Silcotub. In addition, because Silcotub did not satisfy the requirement of selling subject merchandise at not less than normal value for a period of three consecutive years, we also preliminarily determine not to revoke the order in part.

On December 16, 2004, the Department of Commerce (``Department'') published its preliminary determination and postponement of the final determination in this case. On February 24, 2005, the Department published an amended preliminary determination in this case. On April 11, 2005, the Department published its partial affirmative preliminary critical circumstances determination in this case. This investigation covers two exporters of chlorinated isocyanurates that are Mandatory Respondents \1\ and five Section A Respondents.\2\ We invited interested parties to comment on our preliminary determination, amended preliminary determination, and preliminary critical circumstances determination. Based on our analysis of the comments we received, we have made changes to our calculations for the two Mandatory Respondents. As a result of those changes, the rate assigned to the Section A Respondents has also changed.

On the basis of a notice of intent to participate and an adequate substantive response filed on behalf of the interested parties, the Department conducted a full (240-day) sunset review. As a result of this review, the Department finds that revocation of the CVD order would likely lead to continuation or recurrence of subsidies at the levels indicated in the ``Final Results of Review'' section of this notice.

In response to a letter from S.C. Ispat Sidex S.A. notifying the Department of Commerce (``the Department'') that its corporate name has changed to Mittal Steel Galati S.A., the Department is initiating a changed circumstances administrative review of the antidumping duty order on certain cut-to-length carbon steel plate from Romania (see Notice of Antidumping Duty Order: Certain Cut-to-Length Carbon Steel Plate from Romania, 58 FR 44167 (August 19, 1993) (``Order''). We have preliminarily concluded that Mittal Steel Galati S.A. is the successor- in-interest to S.C. Ispat Sidex S.A. On January 9, 2001, in response to its action in FAG Italia S.p.A, Barden Corporation (U.K.) Limited, The Barden Corporation and FAG Bearing Corporation v. the United States, Court No. 98-07-02528, Slip. Op. 00-95 (CIT August 4, 2000), the Court of International Trade (CIT) affirmed the Department of Commerce's (the Department's) remand determination affecting final assessment rates for the administrative review of the antidumping duty order on antifriction bearings (other than tapered roller bearings) and parts thereof from the United Kingdom for the period of review May 1, 1996, through April 30, 1997. The merchandise covered by this review is ball bearings and parts thereof and cylindrical roller bearings and parts thereof. Because the appeals have been dismissed and there is now a final and conclusive court decision in this action, we are amending our final results of the review and we will instruct U.S. Customs and Border Protection to liquidate entries subject to this review.
