The Bureau of Industry and Security (BIS) publishes this final rule to amend the Export Administration Regulations (EAR) to implement the understandings reached at the June 2010 plenary meeting of the Australia Group (AG) and to make certain AG-related editorial clarifications and corrections to the EAR. Consistent with the June 2010 AG understandings, this rule amends the chemical manufacturing equipment entry on the Commerce Control List (CCL) of the EAR to reflect the addition of two parenthetical phrases that clarify the description of certain ``materials'' contained in items on the AG ``Control List of Dual-Use Chemical Manufacturing Facilities and Equipment and Related Technology and Software.'' In addition, this rule makes AG-related clarifications and corrections to the EAR. Specifically, this rule amends the human and zoonotic pathogens and toxins entry and the animal pathogens entry on the CCL by making an update and a clarification that are consistent with the description of items on the AG ``List of Biological Agents for Export Control'' and the AG ``List of Animal Pathogens for Export Control,'' respectively. Finally, this rule amends the listing for ``valves'' in the chemical manufacturing equipment entry on the CCL to clarify that it controls ``valves'' for the ``production'' of chemicals, as well as ``valves'' for the ``processing'' or ``containment'' of chemicals. The purpose of this rule is to ensure that the AG-related entries on the CCL conform with the wording in the AG Control Lists (as updated by the understandings reached at the 2010 AG Plenary) and to clarify the meaning of terms used in these entries.

On December 23, 2009, the Department of Commerce (``the Department'') published the notice of initiation of this antidumping duty administrative review naming Mitsubishi HiTec Paper Flensburg GmbH, Mitsubishi HiTec Paper Bielefeld GmbH and Mitsubishi International Corporation (``collectively, Mitsubishi'') and Papierfabrik August Koehler AG (``Koehler'') as respondents. As a result of petitioner's withdrawal of its request for review, we rescinded this review, in part, with respect to Mitsubishi.\1\ On December 14, 2010, the Department published the preliminary results of the first administrative review for the antidumping duty order on lightweight thermal paper from Germany.\2\ The review covers one manufacturer/exporter: Koehler. The period of review (POR) is November 20, 2008, through October 31, 2009.

This notice announces that the Administrator, Northeast Region, NMFS (Regional Administrator) has approved five service providers who applied as eligible to provide dockside and/or at-sea monitoring services to Northeast (NE) multispecies sectors in FY 2011. Amendment 16 to the NE Multispecies Fishery Management Plan (FMP) expanded sector management in the NE multispecies fishery, including a requirement for independent, third-party dockside and at-sea monitoring of sector trips beginning in fishing years (FY) 2010 and 2012, respectively; however, sectors could elect to have an at-sea monitoring program starting in FY 2010. Regulations implementing Amendment 16 require such third-party monitoring service providers to apply to, and be approved by, NMFS in a manner consistent with the Administrative Procedure Act in order to be eligible to provide dockside and/or at-sea monitoring services to sectors. The regulations specify application requirements and criteria for the approval of service providers, which potential providers must demonstrate their compliance with as part of an application for approval by NMFS. Consistent with these regulatory requirements, the Regional Administrator received and reviewed applications from five monitoring service providers for approval to provide dockside and/or at-sea monitoring services to NE multispecies sectors in FY 2011.

This rule amends the Export Administration Regulations (EAR) to implement additional changes to the Entity List (Supplement No. 4 to part 744) on the basis of the annual review of the Entity List conducted by the End-User Review Committee (ERC). The ERC conducts the annual review to determine if any entities on the Entity List should be removed or modified. This rule implements the results of the annual review for entities located in Iran and the United Arab Emirates (U.A.E.). In addition to implementing changes from the annual review, this rule removes one person located in the United Kingdom (U.K.) from the Entity List. This person is being removed from the Entity List as a result of a request for removal submitted by that person, a review of information provided in the removal request in accordance with section 744.16 (Procedure for requesting removal or modification of an Entity List entity), and further review conducted by the End-User Review Committee's (ERC) member agencies. This rule makes a clarification to an existing entry located in China to accurately reflect the relationship between two aliases listed under that entry. The Entity List provides notice to the public that certain exports, reexports, and transfers (in-country) to entities identified on the Entity List require a license from the Bureau of Industry and Security and that availability of license exceptions in such transactions is limited. Lastly, this rule updates the Code of Federal Regulations (CFR) legal authority citations for parts 730 and 744 of the EAR.
Laminated Woven Sacks From the People's Republic of China: Final Results of Second Antidumping Duty Administrative Review

On December 27, 2010, the Department of Commerce (``Department'') published in the Federal Register the preliminary results of the second administrative review of the antidumping duty order on laminated woven sacks from the People's Republic of China (``PRC''). See Laminated Woven Sacks From the People's Republic of China: Preliminary Results of the Second Administrative Review, 75 FR 81218 (December 27, 2010) (``Preliminary Results''). We gave interested parties an opportunity to comment on the Preliminary Results. Based upon our analysis of the comments and information received, no changes have been made for the final results. As a result of the determinations by the Department and the International Trade Commission (ITC) that revocation of the antidumping duty orders on carbon steel butt-weld pipe fittings from Brazil, Japan, Taiwan, Thailand, and the PRC would likely lead to continuation or recurrence of dumping and material injury to an industry in the United States, the Department is publishing a notice of continuation of these antidumping duty orders.

Protective Regulations for Killer Whales in the Northwest Region Under the Endangered Species Act and Marine Mammal Protection Act

We, the National Marine Fisheries Service (NMFS), establish regulations under the Endangered Species Act (ESA) and Marine Mammal Protection Act (MMPA) to prohibit vessels from approaching killer whales within 200 yards (182.9 m) and from parking in the path of whales when in inland waters of Washington State. Certain vessels are exempt from the prohibitions. The purpose of this final rule is to protect killer whales from interference and noise associated with vessels. We identified disturbance and sound associated with vessels as a potential contributing factor in the recent decline of this population during the development of the final rule announcing the endangered listing of Southern Resident killer whales and the associated Recovery Plan for Southern Resident killer whales (Recovery Plan). The Recovery Plan calls for evaluating current guidelines and assessing the need for regulations and/or protected areas. To implement the actions in the Recovery Plan, we developed this final rule after considering comments submitted in response to an Advance Notice of Proposed Rulemaking (ANPR) and proposed rule, and preparing an environmental assessment (EA). This final rule does not include a seasonal no-go zone for vessels along the west side of San Juan Island that was in the proposed rule. We will continue to collect information on a no-go zone for consideration in a future rulemaking.

The National Institute of Standards and Technology (NIST) invites interested parties to attend a pre-consortium meeting on June 2-3, 2011 to be held on the NIST campus. The goal of the one-day meeting is to evaluate industry interest in creating a NIST/industry consortium focused on advanced neutron-based probes for soft materials. The goals of such a consortium would include the development of neutron-based measurements that would address critical needs for manufacturers of soft materials such as polymers, complex fluids, and protein-based materials. Advances in neutron-based measurement science are anticipated through the development of sample environments that closely mimic manufacturing processes, measurement methods to probe and analyze complex mixtures, and data analysis models that support routine measurements with high information content. The consortium would be administered by NIST. Consortium research and development would be conducted by NIST staff members along with at least one technical representative from each participating member company. CRADA contributions for participation in the consortium would be on the order of Twenty Thousand ($20,000) per year. The initial term of the consortium is intended to be three years.
