Certain Hot-Rolled Carbon Steel Flat Products From India: Final Results of Antidumping Duty Administrative Review

On January 12, 2006, the Department of Commerce (the Department) published the preliminary results of the administrative review of the antidumping duty order on certain hot-rolled carbon steel flat products (HRS) from India. See Certain Hot-Rolled Carbon Steel Flat Products From India: Preliminary Results of Antidumping Duty Administrative Review, 71 FR 2018 (January 12, 2006) (Preliminary Results). This review covers one producer/exporter of HRS, Essar Steel Ltd. (Essar). The period of review (POR) is December 1, 2003, through November 30, 2004. Based on our analysis of the comments received, we made changes to the preliminary dumping margin calculation. Despite these changes, the calculated dumping margin for these final results does not differ from the dumping margin determined in the Preliminary Results. The final weighted-average dumping margin for the reviewed firm is listed below in the section entitled ``Final Results of Review.''

On May 4, 2006, the Department of Commerce (``the Department'') published the preliminary results of new shipper reviews of the antidumping duty order on fresh garlic from the People's Republic of China (``PRC''). See Fresh Garlic from the People's Republic of China: Preliminary Results of 2004-2005 Semi-Annual New Shipper Reviews, 71 FR 26322 (May 4, 2006) (``Preliminary Results''). The merchandise covered by this order is fresh garlic as described in the ``Scope of the Order'' section of this notice. The period of review (``POR'') is November 1, 2004, through April 30, 2005. We invited parties to comment on our Preliminary Results. We received no comments, and no new evidence was placed on the record to cause us to question that determination. Therefore, the final results are unchanged from those presented in the Preliminary Results. The final dumping margins for these reviews are listed in the ``Final Results of the Reviews'' section below.

On May 19, 2006, the Department of Commerce (The Department) published a notice of its intent to rescind the administrative review of the antidumping duty order on stainless steel wire rods from India for Viraj Alloys, Ltd., Viraj Forgings, Ltd., Viraj Impoexpo, Ltd., Viraj Smelting, Viraj Profiles, and VSL Wires, Ltd. (collective, the Viraj entities), and Mukand Limited (Mukand) due to the lack of suspended entries of merchandise subject to the order during the period December 1, 2004, through November 30, 2005. See Stainless Steel Wire Rods from India: Notice of Intent of Rescind Antidumping Duty Administrative Review, 71 FR 29124 (May 19, 2006). The Department received comments from Mukand and rebuttal comments from the petitioner, Carpenter Technology Corporation, regarding Mukand but did not receive any comments from any parties regarding the Viraj entities. We are now rescinding the administrative review with respect to the Viraj entities and Mukand.

On May 11, 2006, the Department of Commerce (``the Department'') published the preliminary results of the antidumping (``AD'') administrative review of certain corrosion-resistant carbon steel flat products (``CORE'') from Japan. The period of review (``POR'') is August 1, 2004, through July 31, 2005. See Certain Corrosion-Resistant Carbon Steel Flat Products from Japan: Preliminary Results of Antidumping Duty Administrative Review, and Preliminary Intent to Rescind, In part, 71 FR 27450 (May 11, 2006) (``Preliminary Results''). This review covers imports of CORE from Kawasaki Steel Corporation (``Kawasaki'') and Nippon Steel Corporation (``Nippon Steel''). We have found that there were no entries of CORE produced by Kawasaki. Therefore, we are rescinding this review with respect to Kawasaki. Because Nippon Steel chose not to participate in this review, we are applying adverse facts available to Nippon Steel. The Department received no comments concerning our preliminary results; therefore, our final results remain unchanged from our preliminary results. The final results are listed in the section ``Final Results of Review'' below.
Certain Preserved Mushrooms from the People's Republic of China: Final Results and Final Partial Rescission of the Sixth Administrative Review

On March 10, 2005, the Department of Commerce (the ``Department'') published in the Federal Register the preliminary results of the administrative review of the antidumping duty order on certain preserved mushrooms from the People's Republic of China (``PRC''). See Certain Preserved Mushrooms from the People's Republic of China: Partial Rescission and Preliminary Results of the Sixth Administrative Review, 70 FR 11183 (March 6, 2006) (``Preliminary Results''). We provided interested parties an opportunity to comment on the Preliminary Results. Based upon our analysis of the comments and information received, we made changes to certain surrogate value calculation which affect the dumping margin calculation for Raoping Yucun Canned Foods Factory (``Raoping Yucun'') in these final results. We find that certain manufacturers/exporters sold subject merchandise at less than normal value during the period of review (``POR'').

NMFS received a request from the U.S. Army Corps of Engineers- Jacksonville District (Corps) for an authorization to take marine mammals, by harassment, incidental to expanding and deepening the Port Sutton Navigation Channel in Tampa Harbor, FL (Port Sutton project). On August 18, 2005, NMFS published a Federal Register notice to solicit public comments for the Corps' proposed project and NMFS preliminary determination of issuing an incidental harassment authorization (IHA) to the Corps. Subsequently, the Corps submitted additional information to NMFS on charge weight of the explosives and calculations for impact zones from a similar port construction project that the Corps completed in Miami. Due to the similarity of the geophysical structure and rock substrate between the Port of Miami and Port Sutton, the Corps proposes to modify certain aspects of the proposed project in Port Sutton with the best available scientific information obtained from the Port of Miami project. NMFS is requesting comments on the proposed modifications to the Port Sutton project and its IHA.

NMFS issues a final rule to implement Amendment 21 to the Fishery Management Plan for Bering Sea/Aleutian Islands King and Tanner Crabs (FMP). This action makes changes to the arbitration system in the Bering Sea and Aleutian Islands (BSAI) Crab Rationalization Program (Program) by modifying the timing for harvesters and processors to match harvesting and processing shares and the timing for initiating arbitration proceedings to resolve price and other delivery disputes. This action is necessary to increase resource conservation and economic efficiency in the crab fisheries that are subject to the Program. This action is intended to promote the goals and objectives of the Magnuson- Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act), the FMP, and other applicable law.

NMFS announces that the Director, Office of Sustainable Fisheries, is considering issuing an Exempted Fishing Permit to Limuli Laboratories of Cape May Court House, NJ, to conduct the sixth year of an exempted fishing operation otherwise restricted by regulations prohibiting the harvest of horseshoe crabs in the Carl N. Schuster Jr. Horseshoe Crab Reserve (Reserve) located 3 nautical miles (nm) seaward from the mouth of the Delaware Bay. If granted, the EFP would allow the harvest of 10,000 horseshoe crabs for biomedical purposes and require, as a condition of the EFP, the collection of data related to the status of horseshoe crabs within the Reserve. This notice also invites comments on the issuance of the EFP to Limuli Laboratories.

We have preliminary determined that sales have not been made below normal value by China National Machinery Import & Export Corporation (``CMC''). If these preliminary results are adopted in our final results of this review, we will instruct U.S. Customs and Border Protection (``CBP'') to assess to antidumping duties on entries of subject merchandise exported by CMC during the period of review (``POR''). We are also preliminary rescinding the review with respect to four exporters because none of these respondents made shipments of subject merchandise during the POR. Interested parties are invited to comment on these preliminary results. We intend to issue the final results no later than 120 days from the date of publication of this notice.

The area will be closed to general category vessels until it reopens on June 15, 2007. This action is being taken to prevent the allocation of general category trips in the NLCA from being exceeded during the 2006 fishing year in accordance with the regulations implemented under Framework 18 to the Atlantic Sea Scallop Fishery Management Plan (FMP) and the Magnuson-Stevens Fishery Conservation and Management Act.

In response to requests from respondent Ta Chen Stainless Pipe Co., Ltd. (Ta Chen) and from petitioners Flowline Division of Markovitz Enterprises, Inc. (Flowline Division), Gerlin, Inc., Shaw Alloy Piping Products, Inc., and Taylor Forge Stainless, Inc., (collectively, petitioners), the Department of Commerce (the Department) is conducting an administrative review of the antidumping duty order on certain stainless steel butt-weld pipe fittings (pipe fittings) from Taiwan. Petitioners requested that the Department conduct the administrative review for Ta Chen, Liang Feng Stainless Steel Fitting Co., Ltd. (Liang Feng), Tru-Flow Industrial Co., Ltd. (Tru-Flow), Censor International Corporation (Censor), and PFP Taiwan Co., Ltd. (PFP). With regard to Ta Chen, we preliminarily determine that sales have been made below normal value (NV). On September 1, 2005, Tru-Flow, Liang Feng, Censor, and PFP certified that they had no sales or shipments of subject merchandise to the United States during the period of review (POR). Based on Tru-Flow's, Liang Feng's, Censor's, and PFP's certified statements and on information from U.S. Customs and Border Protection (CBP) indicating that these companies had no shipments to the United States of the subject merchandise during the POR, we hereby give notice that we intend to rescind the review regarding these four companies. For a full discussion of the intent to rescind with respect to Liang Feng, Tru-Flow, Censor and PFP, see the ``Notice of Intent to Rescind in Part'' section of this notice. If these preliminary results of review of Ta Chen's sales are adopted in the final results, we will instruct CBP to assess antidumping duties on appropriate entries based on the difference between the constructed export price (CEP) and the NV. Interested parties are invited to comment on these preliminary results. In response to a request from a domestic interested party, Nucor Corporation (Nucor), the Department of Commerce (the Department) initiated an administrative review of the antidumping duty order on certain hot-rolled carbon steel flat products (hot-rolled steel) from Brazil. This review covers two manufacturer/exporters of the subject merchandise, Companhia Siderurgica Nacional (CSN) and Companhia Siderurgica de Tubarao (CST). The Department is now rescinding this review based on record evidence indicating that the respondents had no entries of subject merchandise during the period of review (POR). The POR is March 1, 2005, through February 28, 2006.

The proposed rule would implement measures adopted by the Commission for the Conservation of Antarctic Marine Living Resources (CCAMLR) to facilitate conservation and management of AMLR. The proposed rule would require the use of the Centralized satellite-linked vessel monitoring system by all U.S. vessels harvesting AMLR and would be a condition of import for all U.S. dealers seeking to import shipments of toothfish (Dissostichus) into the United States. This proposed rule would also exempt all shipments of fresh toothfish from the NMFS preapproval process and allow importers of frozen toothfish to submit the U.S. Customs 7501 entry number subsequent to their initial application for preapproval. The proposed rule would require the use of Electronic Catch Documents, after a 60-day transition period, for all U.S. dealers seeking to import shipments of toothfish into the United States. Paper-based catch documents for toothfish would no longer be accepted. The proposed rule would also require the use of a seal excluder device on krill vessels using trawl gear in the Area of the Convention for the Conservation of Antarctic Marine Living Resources (Convention Area). The proposed rule would add or amend definitions of ``Antarctic marine living resources'', ``export'', ``import'', ``international observer'', ``land or landing'', ``mobile transceiver unit'', ``national observer'', ``Office for Law Enforcement (OLE)'', ``Port State'', ``re-export'', ``seal excluder device'', ``transship or transshipment'', and ``vessel monitoring system (VMS)''. The proposed rule would also expand the list of requirements and prohibitions regarding scientific observers and clarify the duties and responsibilities of the observers on the vessels and of the vessel owners hosting the observers. The proposed rule identifies new information on all vessels licensed by CCAMLR Members to harvest AMLR in the area identified in the Convention on the Conservation of Antarctic Marine Living Resources (Convention). The intent of this rule is to incorporate new conservation measures, to revise procedures to facilitate enforcement, and to fulfill U.S. agreements in CCAMLR.

On March 6, 2006, the Department of Commerce (the ``Department'') published the preliminary results of the administrative review of the antidumping duty order on certain cut-to-length carbon- quality steel plate products (``CTL Plate'') from Italy. See Certain Cut-To-Length Carbon-Quality Steel Plate Products From Italy: Preliminary Results and Partial Rescission of Antidumping Duty Administrative Review, 71 FR 11178 (March 6, 2006) (``Preliminary Results''). This review covers five producers/exporters of CTL Plate. The period of review (``POR'') is February 1, 2004, through January 31, 2005. Based upon our analysis of the record evidence, the Department finds that the application of adverse facts available (``AFA'') is warranted with respect to Palini and Bertoli S.p.A. (``Palini''). Further, the Department is rescinding the review with respect to Trametal S.p.A. (``Trametal'') because there is no entry against which to collect duties. The Department is also rescinding the review for Metalcam S.p.A. (``Metalcam'') and Riva Fire S.p.A. (``Riva Fire'') because they had no shipments during the POR. The Department is also rescinding this review with respect to Ilva S.p.A. (``Ilva'') because Ilva was improperly included in this administrative review.
