Request for Extension and Revision of a Currently Approved Information Collection
In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C. chapter 35), this notice announces the Grain Inspection, Packers and Stockyards Administration (GIPSA) intention to request an extension for and revision to a currently approved information collection related to the delivery of services conducted under the official inspection, grading and weighing programs authorized under the United States Grain Standards Act and the Agricultural Marketing Act of 1946. This voluntary survey would give GIPSA customers of the official inspection, grading and weighing programs, who are primarily in the grain, oilseed, rice, lentil, dry pea, edible bean and related agricultural commodity markets, an opportunity to provide feedback on the quality of services they receive and would provide information on new services that customers would like to receive. This feedback would help GIPSA's Federal Grain Inspection Service (FGIS) improve services and service delivery provided by the official inspection, grading, and weighing system.

On September 23, 2008, a Notice of Intent (NOI) to prepare an Environmental Impact Statement for the Wolf Creek Access Project was published in the 73 FR 54786. This NOI is hereby rescinded because the project has been cancelled.
Ravalli County Resource Advisory Committee
The Ravalli County Resource Advisory Committee will be having the routine monthly meeting with project presentations and hold a short public forum (question and answer session). The meeting is being held pursuant to the authorities in the Federal Advisory Committee Act (Pub. L. 110-343) and under the Secure Rural Schools and Community Self- Determination Act of 2000 (Pub. Fresno County Resource Advisory Committee
The Fresno County Resource Advisory Committee will be meeting in Prather, California on March 31st and Clovis, California on April 2nd. The purpose of the meeting on March 31st will be to accept and review project proposals. The purpose of the April 2nd meeting will be to approve and vote on projects.
Notice of New Fee Site; Federal Lands Recreation Enhancement Act (Title VIII, Pub. L. 108-447)
The Plumas National Forest is proposing to charge a new fee for the overnight rental of Black Mountain Lookout. This Lookout has not been available for recreation use prior to this date. Fees are assessed based on the level of amenities and services provided, cost of operation and maintenance, market assessment and public comment. The fee listed is only proposed and final determination will be made upon further analysis and public comment. Rentals of other lookouts on the adjacent National Forests have shown that people appreciate and enjoy the availability of historic rental lookouts. Funds from the rental will be used for the continued operation and maintenance of Black Mountain Lookout, and to develop improvements that benefit visitor's recreation experiences.

Notice of Proposed Revision to the Privacy Act System of Records
In accordance with the Privacy Act of 1974, as amended, the U.S. Department of Agriculture (USDA), Office of Inspector General (OIG) is proposing a revision to its system of records, by creating the Office of Audit's Research Aggregated Data Analysis Repository (``RADAR''), USDA/OIG-8. RADAR will house USDA data collected by OIG in order to detect fraud, waste, and abuse by utilizing software to match, merge, and analyze the data. USDA invites public comment on this revision of its records system.
Soybean Promotion, Research, and Information Program: Opportunity To Request a Referendum
The Agricultural Marketing Service (AMS) announces that soybean producers may request a referendum to determine if producers want a referendum on the Soybean Promotion and Research Order (Order), as authorized under the Soybean Promotion, Research, and Consumer Information Act (Act). If at least 10 percent (not in excess of one- fifth of which may be producers in any one State) of the 589,182 eligible producers, as determined by the Department of Agriculture (USDA), participate in the Request for Referendum, a referendum will be held within 1 year from that determination. If results of the Request for Referendum indicate that a referendum is not supported, a referendum would not be conducted. The results of the Request for Referendum will be published in a Notice in the Federal Register.
Walnuts Grown in California; Decreased Assessment Rate
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim final rule which decreased the assessment rate established for the California Walnut Board (Board) for the 2008-09 and subsequent marketing years from $0.0158 to $0.0131 per kernelweight pound of assessable walnuts. The Board locally administers the marketing order which regulates the handling of walnuts grown in California. Assessments upon walnut handlers are used by the Board to fund reasonable and necessary expenses of the program. The marketing year began September 1 and ends August 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Information Collection: Recreation Fee Permit Envelope
In accordance with the Paperwork Reduction Act of 1995, the Forest Service is seeking comments from all interested individuals and organizations on the extension, with revision, of a currently approved information collection, 0596-0106 Recreation Fee Permit Envelope.
Plumas National Forest; Beckwourth Ranger District, California; Beckwourth Ranger District Tall Whitetop Project
On May 9, 2006, Federal Register (Volume 71, Number 89, [Page 26921-26923]), the USDA Forest Service, Plumas National Forest announced its intent to prepare an Environmental Impact Statement (EIS) to eradicate populations of the noxious weed tall whitetop (Lepidium Iatifoliuin), along the Middle Fork of the Feather River. The proposed Federal action in this EIS was to use a three-step process to ensure the successful eradication of tallwhite top. One of the steps involved the use of herbicides. The EIS would have evaluated the environmental effects associated with these actions and any reasonable alternatives. The notice of intent to prepare an EIS is withdrawn. The Plumas National Forest will continue the NEPA process by preparing an Environmental Assessment to evaluate the environmental effects of a new proposed action.
Solicitation of Input From Stakeholders Regarding the Healthy Urban Food Enterprise Development Center Program
The Cooperative State Research, Education, and Extension Service (CSREES) is implementing a new competitive grants program called the Healthy Urban Food Enterprise Development Center Program (the Center) authorized by 7 U.S.C. 2034(h). Soybean Promotion, Research, and Information Program: Amend Procedures To Request a Referendum
This final rule amends the procedures to request a referendum under the Soybean Promotion, Research, and Consumer Information program, commonly known as the soybean checkoff program, by updating the number of soybean producers in the United States. The number of soybean producers, based on information provided by the Department of Agriculture (USDA), Farm Service Agency (FSA), is 589,182. Additionally, this rule amends the regulations pursuant to administrative changes to Web site addresses and office locations made for the USDA's Agricultural Marketing Service (AMS).
Walnuts Grown in California; Changes to Regulations Governing Board Nominations
The Department of Agriculture (USDA) is adopting, as a final rule, with a change, an interim final rule revising the administrative rules and regulations governing nominations for the California Walnut Board (Board). The Board locally administers the marketing order that regulates the handling of walnuts grown in California (order). This rule continues in effect an action that removes references to independent handlers, revises specifications under which groups of growers may submit nominations for certain grower positions on the Board, and corrects numerical references to other sections of the order. These changes are needed to bring the administrative rules and regulations into conformance with recently enacted amendments to the order concerning Board structure and nomination procedures.

Divide Ranger District, Rio Grande National Forest; Colorado; Big Moose Vegetation Management Project
The Rio Grande National Forest proposes to harvest and regenerate timber stands killed by or infested with spruce beetle on the Divide Ranger District of the Rio Grande National Forest, and treat portions of the analysis area to promote aspen regeneration and healthy stands of young aspen. The proposed treatments would ensure moving towards or maintaining Forest Plan Desired Conditions and would contribute to societies need for wood fiber.
Notice: American Recovery and Reinvestment Act of 2009 Broadband Initiatives

Eldorado National Forest, CA; Kirkwood Meadows Power Line Reliability Project EIS/EIR
Notice is hereby given that the USDA Forest Service, Eldorado National Forest (Forest Service), together with the Kirkwood Meadows Public Utility District (KMPUD), will prepare a joint Environmental Impact Statement/Environmental Impact Report (EIS/EIR) to disclose the impacts associated with authorizing a 50-year term Special Use Permit for the construction, use and maintenance of a Kirkwood Meadows Public Utility District power line connecting the electrical grid near Salt Springs with the community of Kirkwood Meadows, located in Amador, Alpine and El Dorado Counties, California. The new power line would potentially be located along Highway 88 and within the Eldorado National Forest. The power line would connect with an existing 115 kV transmission line near the PG&E hydroelectric facility at Salt Springs Reservoir. The proposed project also includes two substations to be built, one near the Salt Springs hydroelectric facility and the other on KMPUD property within the Kirkwood Meadows valley, as well as ancillary improvements on National Forest System lands needed to maintain this system (e.g., poles, roads, communication equipment).
Shasta County Resource Advisory Committee
The Shasta County Resource Advisory Committee (RAC) will meet at the USDA Service Center in Redding, California, on March 12, 2009 from 8:30 a.m. to 12 noon; April 9, 2009 from 8:30 a.m. to 12 noon; May 27 and 28, 2009 from 8:30 a.m. to 4:30 p.m. The purpose of these meetings is to discuss proposed projects under Title II of the Secure Rural Schools and Community Self-Determination Act of 2008.

Allegheny National Forest, PA; Reserved and Outstanding Oil and Gas Design Criteria
The Allegheny National Forest proposes to apply design criteria included in the Allegheny National Forest Land and Resource Management Plan (Forest Plan), issued in March 2007 to reserved and outstanding oil and gas development on the Forest. The 2007 Forest Plan proposed design criteria are identified on pages 53 through 168. This proposal responds to instructions in the February 15, 2008 decision by the Chief of the Forest Service on appeals of the Allegheny National Forest Revised Land and Resource Management Plan. A Supplement to the Forest Plan Environmental Impact Statement (SEIS) will be prepared for this proposal.
Common Crop Insurance Regulations; Cabbage Crop Insurance Provisions
The Federal Crop Insurance Corporation (FCIC) finalizes the Common Crop Insurance Regulations; Cabbage Crop Insurance Provisions to convert the cabbage pilot crop insurance program to a permanent insurance program for the 2010 and succeeding crop years.
General Administrative Regulations; Submissions of Policies, Provisions of Policies, Rates of Premium and Premium Reduction Plans
The Federal Crop Insurance Corporation (FCIC) amends General Administrative Regulations, Subpart VSubmission of Policies, Provisions of Policies, Rates of Premium and Premium Reduction Plans to remove provisions that allow approved insurance providers (AIP) to offer premium reduction plans. The authority for such premium reductions has been eliminated in the Food, Conservation, and Energy Act of 2008 (2008 Farm Bill).
General Administrative Regulations; Appeal Procedure
The Federal Crop Insurance Corporation (FCIC) is amending the General Administrative Regulation, Appeal Procedure. This final rule incorporates a requirement mandated by the Food, Conservation, and Energy Act of 2008 (2008 Farm Bill) that allows producers to use both mediation and the informal administrative appeal process in their appeals of decisions by FCIC and making minor non-substantive changes for clarity.
Chequamegon-Nicolet National Forest, Wisconsin; Honey Creek-Padus Project
The Forest Service will prepare an environmental impact statement (EIS) to document the analysis and disclose the environmental impacts of proposed land management activities and corresponding alternatives within the Honey Creek-Padus Project. The purpose of the Honey Creek-Padus Project is to implement land management activities that are consistent with direction in the Chequamegon-Nicolet National Forest 2004 Revised Land and Resource Management Plan and respond to the specific needs identified in the project area. Honey Creek-Padus Project is located on National Forest System lands, administered by the Lakewood-Laona Ranger District, north of Wabeno, WI. The legal description of the project is Township 35 North, Range 14 and 15 East.
Plan Revision for Uwharrie National Forest, NC
The USDA, Forest Service is resuming preparation of the Uwharrie National Forest (UNF) revised land management plan as directed by the National Forest Management Act (NFMA). Preparation of the revised plan was halted when the 2005 Forest Service planning rule was enjoined. A new planning rule (36 CFR Part 219) was implemented on April 21, 2008 allowing the planning process to be resumed. This notice resumes the plan revision process under the new planning rule. Under the 2005 Rule the planning process had proceeded to the point of generating a Proposed Plan for public comment. A 90-day comment period for the Proposed Plan was initiated on February 15, 2007 but was not completed due to enjoinment of the 2005 Planning Rule on March 30, 2007. This notice serves to initiate a new 90-day public comment period on the Proposed Plan. This notice provides: 1. Information on how to view and/or obtain copies of the Proposed Plan and the Comprehensive Evaluation Report. 2. Information on how the public can comment on the Proposed Plan, when those comments are due and, how comments can be submitted. 3. Who to contact for more information.
Tonka Timber Sale Project Environmental Impact Statement
The Department of Agriculture, Forest Service, will prepare an Environmental Impact Statement (EIS) on a proposal to harvest timber for the Tonka Timber Sale EIS on the Lindenberg Peninsula, Kupreanof Island, on the Petersburg Ranger District, Tongass National Forest. The proposed action is to harvest approximately 60 million board feet (mmbf) of timber from about 3,500 acres of forested land. An estimated 11 miles of new road is associated with this proposed action. A range of alternatives, responsive to significant issues, will be developed and will include a no action alternative. The existing marine access facility, (MAF) located along the eastern shore of Lindenberg Peninsula, in the Wrangell Narrows, would be used and further development of the MAF is included in the proposed action. This development would facilitate the transport and scaling of logs for this proposed project and future long-term production of young-growth from the project area. This project is within the MitkofYKupreanof biogeographic province. The Record of Decision will disclose whether and where the Forest Supervisor has decided to provide timber harvest units, roads and associated timber harvesting facilities.
Crescent Ranger District; Deschutes National Forest; Oregon; Three Trails Off Highway Vehicle Project
The USDA, Forest Service, will prepare an Environmental Impact Statement (EIS) on a proposed action to designate an Off Highway Vehicle (OHV) trail system on the Crescent Ranger District of the Deschutes National Forest. In addition, the proposal would close roads, rehabilitate unneeded trails, and develop staging areas within the 77,000-acre project area. The proposed trail system would be located on National Forest lands between Crescent Lake Junction and the boundary of the Winema National Forest, west of Crescent, Oregon. The legal location is Townships 23-26 south and Ranges 6-9 east, Willamette Meridian. The analysis area contains three distinct areas with a focused trail system that will eventually be interconnected: Two Rivers, Walker Mountain, and Crescent Lake Junction. The alternatives will include the proposed action, no action, and additional alternatives that respond to issues generated through the scoping process. The agency will give notice of the full environmental analysis and decision making process so interested and affected people may participate and contribute to the final decision.

This rule decreases the assessment rate established for the California Desert Grape Administrative Committee (Committee) for the 2009 and subsequent fiscal periods from $0.02 to $0.01 per 18-pound lug of grapes handled. The Committee locally administers the marketing order which regulates the handling of grapes grown in a designated area of southeastern California. Assessments upon desert grape handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal period begins January 1 and ends December 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Tart Cherries Grown in the States of Michigan, et al.; Final Free and Restricted Percentages for the 2008-2009 Crop Year for Tart Cherries
This rule establishes final free and restricted percentages for the 2008-2009 crop year tart cherries covered under the Federal marketing order regulating tart cherries grown in seven States (order). The percentages are 73 percent free and 27 percent restricted and will establish the proportion of cherries from the 2008 crop which may be handled in commercial outlets. The percentages are intended to stabilize supplies and prices, and strengthen market conditions. The percentages were recommended by the Cherry Industry Administrative Board (Board), the body that locally administers the marketing order. The order regulates the handling of tart cherries grown in the States of Michigan, New York, Pennsylvania, Oregon, Utah, Washington, and Wisconsin.

Codex Alimentarius Commission: Meeting of the Codex Committee on Contaminants in Foods
The Office of the Acting Deputy Under Secretary for Food Safety, U.S. Department of Agriculture (USDA), and the Food and Drug Administration (FDA), U.S. Department of Health and Human Services (HHS), are sponsoring a public meeting on March 5, 2009. The objective of the public meeting is to provide information and receive public comments on agenda items and draft United States positions that will be discussed at the 3rd Session of the Codex Committee on Contaminants in Foods (CCCF) of the Codex Alimentarius Commission (Codex), which will be held in Rotterdam, The Netherlands, from March 23-27, 2009. The Acting Deputy Under Secretary for Food Safety and FDA recognize the importance of providing interested parties the opportunity to obtain background information on the 3rd Session of the CCCF and to address items that will be on the agenda.
Klamath National Forest, California, Two Bit Vegetation Management
The Klamath National Forest will prepare an environmental impact statement (EIS) to document and publicly disclose the environmental effects of implementing commercial thinning and prescribed burn treatments in the Two Bit project area to provide forest products, restore forest health, and reduce fuel hazard on Klamath National Forest System lands. The project area is north and west of Happy Camp, California. Thinning and understory prescribed burning is proposed on approximately 10,800 acres.

Nectarines and Peaches Grown in California; Changes in Handling Requirements for Fresh Nectarines and Peaches
This rule changes the handling requirements applicable to well matured fruit covered under the nectarine and peach marketing orders (orders). The orders regulate the handling of nectarines and peaches grown in California and are administered locally by the Nectarine Administrative and Peach Commodity Committees (committees). This rule updates the variety-specific size requirements to reflect changes in commercially significant varieties. This will enable handlers to continue to ship fresh nectarines and peaches in a manner that meets consumer needs, increases returns to producers and handlers, and reflects current industry practices.
Ochoco National Forest, Lookout Mountain Ranger District; Oregon; Canyon Fuels and Vegetation Management Project EIS
The Ochoco National Forest is preparing an environmental impact statement (EIS) to analyze the effects of managing fuels and vegetation within the 31,500-acre Canyon project area, which is approximately 20 miles east of Prineville, Oregon. The project area includes National Forest System lands in the Upper Ochoco Creek Watershed. The Fremont and Winema Resource Advisory Committee will meet in Klamath Falls, Oregon, for the purpose of evaluating and recommending resource management projects for funding in FY 2009, under the provisions of Title II of the Secure Rural Schools and Community Self-Determination Act of 2008 (Pub. L. 110-343).
Healthy Forests Reserve Program
On January 14, 2009, NRCS published in the Federal Register a proposed rule for the Healthy Forests Reserve Program (HFRP) with a public comment period closing on February 13, 2009. The proposed rule included changes to address amendments to HFRP associated with enactment of the Food, Conservation, and Energy Act of 2008. NRCS is hereby reopening the public comment period for the HFRP proposed rule and amending the closing date to March 20, 2009.

Ochoco National Forest, Lookout Mountain Ranger District; Oregon; Big Summit Allotment Management Plan EIS
The Ochoco National Forest is preparing an environmental impact statement (EIS) to analyze the effects of changing grazing management in five grazing allotments on the Lookout Mountain Ranger District. These five allotments are: Big Summit, Pringle, Brush Creek, Lost Horse and North Fork. The proposed action will reauthorize term grazing permits, make rangeland improvements, manage livestock use and distribution to facilitate the improvement of riparian conditions, including streambank stability, riparian vegetation, and water temperature, and will conduct riparian restoration activities on some streams in the project area. These actions are needed to achieve and maintain consistency with the Ochoco National Forest Land and Resource Management Plan, as amended.
Ravalli County Resource Advisory Committee
The Ravalli County Resource Advisory Committee will be having the routine monthly meeting along with the public forum. The meeting is being held pursuant to the authorities in the Federal Advisory Committee Act (Pub. L. 110-343) and under the Secure Rural Schools and Community Self-Determination Act of 2000 (Pub. L. 110-343). The meeting is open to the public.
