Irish Potatoes Grown in Washington; Modification of Special Purpose Shipment Regulations
This rule modifies the special purpose shipment regulations currently prescribed under the Washington potato marketing order. The marketing order regulates the handling of Irish potatoes grown in Washington, and is administered locally by the State of Washington Potato Committee (Committee). This rule modifies the reporting requirements, procedures, and safeguard provisions for making certain special purpose potato shipments. Under the marketing order, such special purpose shipments may be exempted from the quality, assessment, or inspection requirements. The changes include removal of the special purpose exemption for exported potatoes, clarification of the reporting procedures for potatoes diverted to processing, and addition of safeguard provisions for shipments of seed potatoes and shipments to charitable organizations. These changes will help facilitate special purpose shipments, while enhancing the Committee's compliance program.
Sweet Cherries Grown in Designated Counties in Washington; Order Amending Marketing Order No. 923
This rule amends the marketing order (order) for sweet cherries grown in Washington. Sweet cherry growers, voting in a mail referendum held March 1 through March 21, 2005, voted on four amendments proposed by the Washington Cherry Marketing Committee (Committee), which is responsible for local administration of the order, and two amendments proposed by the Agricultural Marketing Service of USDA. Of the six amendments proposed, three were favored, including: Adding authority for the Committee to accept voluntary contributions for research and promotion; establishing tenure limitations for Committee members; and requiring that continuance referenda be conducted every 6 years. The three amendments that failed include: adding authority for promotion, including paid advertising, and production research projects; adding authority for supplemental rates of assessment for individual varieties of cherries; and, adding a public member to the Committee. These amendments will not be implemented.
Nectarines and Peaches Grown in California; Revision of Handling Requirements for Fresh Nectarines and Peaches
The Department of Agriculture (USDA) is adopting, as a final rule, with changes, an interim final rule revising the handling requirements for California nectarines and peaches by modifying the grade, size, maturity, and pack requirements for fresh shipments of these fruits, beginning with 2005 season shipments. This rule also authorizes continued shipments of ``CA Utility'' quality nectarines and peaches, and revises weight-count standards for fruit in volume-filled containers. The marketing orders regulate the handling of nectarines and peaches grown in California and are administered locally by the Nectarine Administrative and Peach Commodity Committees (committees). This rule enables handlers to continue to ship fresh nectarines and peaches in a manner that meets consumer needs, increases returns to producers and handlers, and reflects current industry practices.
Karnal Bunt; Regulated Areas
We are adopting as a final rule, without change, an interim rule that amended the Karnal bunt regulations by adding certain areas in La Paz, Maricopa, and Pinal Counties, AZ, and Riverside County, CA, to the list of regulated areas and by removing certain areas or fields in Maricopa and Pinal Counties, AZ, and Imperial County, CA, from the list of regulated areas. Those actions were necessary to prevent the spread of Karnal bunt to noninfected areas of the United States and to relieve restrictions on certain areas that are no longer necessary
General Administrative Regulations, Submission of Policies, Provisions of Policies, Rates of Premium, and Premium Reduction Plans
The Federal Crop Insurance Corporation (FCIC) amends the General Administrative Regulations, which implement the statutory mandates of the Agricultural Risk Protection Act of 2000 (ARPA) related to the submission of policies for approval for reinsurance and the reimbursement of research and development costs and maintenance costs.
Change in Minimum Quality and Handling Standards for Domestic and Imported Peanuts Marketed in the United States
This rule changes the peanut quality and handling standards (Standards) to require that domestic and imported peanuts be dried to 18 percent moisture or less prior to inspection and to 10.49 percent or less prior to storing or milling. Virginia-type peanuts used for seed must be dried to 18 percent or less prior to inspection and to 11.49 percent or less prior to storing or milling. The Standards and the Peanut Standards Board (Board) were established by the Department of Agriculture (USDA), pursuant to section 1308 of the Farm Security and Rural Investment Act of 2002. The Board suggested changing the peanut quality and handling standards to allow handlers and importers to receive or acquire high moisture peanuts to promote the development of new drying technologies, increase efficiencies, and reduce costs to the industry.

Notice of Availability of a Document Concerning the Identification of EU Administrative Units
We are advising the public that we are finalizing, with minor changes, a draft document that had been prepared by the Animal and Plant Health Inspection Service to identify the smallest administrative jurisdictions within 11 Member States of the European Union that we would consider ``regions'' in the event of future animal disease outbreaks. The draft document referred to these jurisdictions as ``administrative units'' and also reevaluated the administrative units already identified for Italy.
Notice of Public Meeting on the Proposed Design and Development of an ePermits System
We are advising the public that the Animal and Plant Health Inspection Service is holding a public meeting to introduce, and obtain feedback on, one portion of our proposed ePermits system. This meeting will focus on applications and permits for transiting and importing plants and plant products, including propagative material, fruits and vegetables, logs and lumber, and material listed in the Convention on International Trade in Endangered Species of Wild Fauna and Flora.
Administrative Procedures for Processing Appeals Under 36 CFR, Part 215, for Projects or Activities Implementing Land and Resource Management Plans on National Forest System Lands
The Forest Service is amending Forest Service Handbook 1509.12 to provide guidance to employees for processing appeals covered under Title 36, Code of Federal Regulations, part 215, involving projects or activities implementing land and resource management plans on National Forest System lands. The handbook provides direction on the authority, objectives, policies, and responsibilities of line officers and direction to field personnel on how to set up a notice and comment period, receive and record comments, provide information on decision notification, calculate appeal filing and time periods, process and dispose of an appeal, and instructions regarding the content and management of appeal records. This amendment is issued as amendment number 1509.12-2005-1 to FSH 1509.12.
South Gifford Pinchot National Forest Resource Advisory Committee Meeting Notice
The South Gifford Pinchot National Forest Resource Advisory Committee will meet on Friday, August, 19, 2005 at the Skamania County Public Works Department basement located in the Courthouse Annex, 170 N.W. Vancouver Avenue, Stevenson, WA 98610. The meeting will begin at 9:30 a.m. and continue until 4 p.m. The purpose of the meeting is to review proposals for Title II funding of Forest projects under the Secure Rural Schools and County Self-Determination Act of 2000. All South Gifford Pinchot National Forest Resource Advisory Committee meetings are open to the public. Interested citizens are encouraged to attend. The ``open forum'' provides opportunity for the public to bring issues, concerns, and discussion topics to the Advisory Committee. The ``open forum'' is scheduled to occur at 9:45 a.m. Interested speakers will need to register prior to the open forum period. The committee welcomes the public's written comments on committee business at any time.
National Organic Program; Proposed Amendment to the National List of Allowed and Prohibited Substances (Livestock)
This proposed rule would amend the U.S. Department of Agriculture's (USDA) National List of Allowed and Prohibited Substances (National List) to reflect one recommendation submitted to the Secretary by the National Organic Standards Board (NOSB). Consistent with the recommendation from the NOSB, this proposed rule would revise the annotation of one substance on the National List, Methionine, to extend its use in organic poultry production until October 21, 2008.
Tuberculosis in Cattle and Bison; State and Zone Designations; California
We are adopting as a final rule, without change, an interim rule that amended the bovine tuberculosis regulations regarding State and zone classifications by raising the designation of California from modified accredited advanced to accredited-free. The interim rule was based on our determination that California met the criteria for designation as an accredited-free State.
Revision of Land Management Plan for the National Forests in Mississippi
The National Forests in Mississippi elects to adjust its land management plan revision process from compliance with the 1982 planning regulations, to conformance with new planning regulations adopted in January 2005. This adjustment will have the following effects: (1) The revised forest plan will consist of five components organized into three main parts or sections, making it more strategic and flexible (36 CFR part 219). (2) The Responsible Official who approves the final plan will be the Forest Supervisor instead of the Regional Forester (36 CFR 219.2). (3) The National Forests in Mississippi will establish an environmental management system simultaneously with completion of the revised forest plan (36 CFR 219.5). (4) The National Forests in Mississippi will prepare a comprehensive evaluation for plan revision in conjunction with development of the revised plan (36 CFR 219.6). (5) Pending final rulemaking, the planning and decision-making process may be categorically excluded from analysis and documentation in an environmental impact statement and record of decision (see draft rule at 70 FR 1062, January 5, 2005). (6) Administrative review will consist of a pre-decision objection process (36 CFR 219.13).
Special Supplemental Nutrition Program for Women, Infants and Children (WIC): Miscellaneous Vendor-Related Provisions
This proposed rule would amend the regulations governing the WIC Program to clarify issues that have arisen subsequent to the publication of the WIC Food Delivery Systems Final Rule on December 29, 2000, and to strengthen further the requirements for State vendor management and infant formula cost-containment systems. The rule contains provisions that would prohibit a State agency from requiring an infant formula manufacturer to provide free formula, services, or other items in its infant formula cost-containment bid solicitation and contract; require that a State agency provide an abbreviated administrative review when a vendor receives a WIC civil money penalty as a result of a Food Stamp Program (FSP) disqualification; and expand the types of vendor information that a State agency may release for general program purposes.
Environmental Statement; Notice of Availability
The Natural Resources Conservation Service (NRCS), has prepared an Environmental Assessment in compliance with the National Environmental Policy Act (NEPA), as amended, the implementing regulations for NEPA (40 CFR parts 1500-1508), and NRCS policy. The St. George and Washington Canal Washington Fields Pipeline Project is a federally assisted action authorized as a Congressional Earmark under the Consolidated Appropriations Act, 2004. The Environmental Assessment was developed in coordination with the Washington County Water Conservancy District and the Bureau of Land Management. Upon review of the Environmental Assessment, the State Conservationist for NRCS, Utah, made a Finding of No Significant Impact (FONSI) and the determination was made that no environmental impact statement is required to support the project. Pursuant to section 102(2)(c) of the National Environmental Policy Act of 1969; the Council on Environmental Quality Regulations (40 CFR part 1500); and the Natural Resources Conservation Service Regulations (7 CFR part 650); the Natural Resources Conservation Service, U.S. Department of Agriculture, gives notice that an environmental impact statement is not being prepared for the St. George and Washington Canal Washington Fields Pipeline Project. For-Profit Center Participation in the Child and Adult Care Food Program
This rule adds a provision to the Child and Adult Care Food Program (CACFP) regulations that authorizes for-profit centers providing child care or outside-school-hours care to participate based on the income eligibility of 25 percent of children in care for free or reduced price meals. This provision, which has been available nationwide on an interim basis through annual appropriation acts since December 2000, was permanently established by the Child Nutrition and WIC Reauthorization Act of 2004. This rule permits the ongoing participation of for-profit centers in the CACFP based on the income eligibility of children in care for free or reduced price meals.

Notice of Invitation for Nominations to the Advisory Committee on Agriculture Statistics
In accordance with the Federal Advisory Committee Act, 5 U.S.C. App. 2, this notice announces an invitation from the Office of the Secretary of Agriculture for nominations to the Advisory Committee on Agriculture Statistics. On November 24, 2004, the Secretary of Agriculture renewed the Advisory Committee charter for another 2 years. The purpose of the Committee is to advise the Secretary of Agriculture on the scope, timing, content, etc., of the periodic censuses and surveys of agriculture, other related surveys, and the types of information to obtain from respondents concerning agriculture. The Committee also prepares recommendations regarding the content of agriculture reports and presents the views and needs for data of major suppliers and users of agriculture statistics.
Almonds Grown in California; Increased Assessment Rate
This rule increases the assessment rate established for the Almond Board of California (Board) for the 2005-06 and subsequent crop years from $0.025 to $0.030 per pound of almonds received. Of the $0.030 per pound assessment, 60 percent (or $0.018 per pound) will be available as credit-back for handlers who conduct their own promotional activities. The Board locally administers the marketing order which regulates the handling of almonds grown in California. Authorization to assess almond handlers enables the Board to incur expenses that are reasonable and necessary to administer the program. The crop year begins August 1 and ends July 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Milk in the Mideast Marketing Area; Tentative Partial Decision on Proposed Amendments and Opportunity To File Written Exceptions to Tentative Marketing Agreement and Order
This tentative partial decision adopts on an interim final and emergency basis proposals that would amend certain features of the pooling standards of the Mideast milk marketing order. Specifically, this decision will: (1) Prohibit the ability to simultaneously pool the same milk on the Mideast Federal milk order and on a marketwide equalization pool administered by another government entity; (2) lower the diversion limit standards; and (3) increase the performance standards for supply plants. A separate decision will be issued that will address proposals to deter the de-pooling of milk, adopt transportation credits and clarify the Producer definition of the order. This decision requires determining if producers approve the issuance of the amended order on an interim basis.
Appeal Procedures
The Farm Service Agency (FSA) is amending the regulations for informal agency appeals to make conforming and clarifying changes regarding FSA procedures.
Onshore Oil and Gas Operations; Federal and Indian Oil and Gas Leases; Onshore Oil and Gas Order Number 1, Approval of Operations
This proposed rule would revise existing Onshore Oil and Gas Order Number 1, which was published in the October 21, 1983, edition of the Federal Register. The Order provides the requirements necessary for the approval of all proposed oil and gas exploratory, development, or service wells on all Federal and Indian (except Osage tribe) onshore oil and gas leases, including leases where the surface is managed by the U.S. Forest Service (FS). It also covers most approvals necessary for subsequent well operations, including abandonment. The revision is necessary due to provisions of the 1987 Federal Onshore Oil and Gas Leasing Reform Act (Reform Act), legal opinions, court cases since the Order was issued, and other policy and procedural changes. The revised Order would address the submittal of a complete Application for Permit to Drill or Deepen package (APD), including a Drilling Plan, Surface Use Plan of Operations, evidence of bond coverage and Operator Certification.

Modoc National Forest, CA; Restoration of the Sagebrush Steppe and Associated Ecosystems in Northeast California and Northwest Nevada Through Improved Management of Western Juniper and Other Natural Resources
The Modoc National Forest and partner agencies including the U.S. Departmentof the Interior's Bureau of Land Management and Modoc County, California, arecooperating to develop a management plan and environmental impact statement to addressrestoration of sagebrush steppe ecosystems that have been impacted by rapidly expandedstands of Western juniper. The management plan will broadly identify appropriate treatment methodologies by soil and range site, provide guidelines for design and implementation ofeffective treatments, and provide a broad prioritization for treatment areas to be analyzedover a 30 year horizon. The ecosystem restoration projects, derived from this managementstructure, will restore biodiversity and productivity to these ecosystems, benefiting sagebrushobligate species such as sage- grouse, improving hydrologic conditions and enhancing theforage base for wildlife and domestic animals. Restoration projects will occur on NationalForest lands and public lands administered by the BLM in parts of Modoc, Lassen, Shastaand Siskiyou counties, California and in Washoe County, Nevada. The planning area coversapproximately 6.5 million acres of public and private land.This management plan will amend the Modoc National Forest Land and Resource ManagementPlan and BLM land use plans for the Alturas, Eagle Lake and Surprise field
National Sheep Industry Improvement Center: Inviting Grant Proposals for the Sheep and Goat Industry Grant Initiative
The National Sheep Industry Improvement Center (NSIIC) announces the availability of approximately $300,000 in competitive grants for product or business development, producer information or education, marketing and promotion for sheep or goats or their products, genetic retention, and animal health. Eligible applicants, including many business structures but excluding individuals (see section III), may apply for up to $50,000 in Federal Funds per proposal. The intent is to fund a variety of proposals that will benefit the U.S. sheep and goat industries.

Increase in Fees and Charges for Egg, Poultry, and Rabbit Grading
The Agricultural Marketing Service (AMS) is increasing the fees and charges for Federal voluntary egg, poultry, and rabbit grading. These fees and charges are being increased to cover the increase in salaries of Federal employees, salary increases of State employees cooperatively utilized in administering the programs, and other increased Agency costs.
Pistachios Grown in California; Establishment of Procedures for Exempting Handlers From Minimum Quality Testing
This rule establishes procedures for exempting handlers from quality requirements, including maximum limits for quality defects and minimum size, prescribed under the California pistachio marketing order (order). The order regulates the handling of pistachios grown in California and is administered locally by the Administrative Committee for Pistachios (Committee). These procedures will be used by the Committee in considering handler requests for exemptions from minimum quality testing requirements and when considering revocations of such exemptions. Additionally, this rule establishes an appeals process for handlers who have been denied an exemption or had an approved exemption revoked.

Tuberculosis in Cattle and Bison; State and Zone Designations; New Mexico
We are amending the bovine tuberculosis regulations regarding State and zone classifications by removing New Mexico from the list of modified accredited advanced States, adding portions of two counties in New Mexico to the list of modified accredited advanced zones, and adding the remainder of the State to the list of accredited-free zones. We are taking this action based on our determination that New Mexico meets the requirements of the regulations for zone recognition and that one of the zones meets the criteria for designation as accredited-free.

Buckhorn Mountain Project a Supplement to the Final Environmental Impact Statement or for Crown Jewel Mine, Okanogan and Wenatchee National Forests, Okanogan County, WA.
On September 5, 2003, a Notice of Intent (NOI) to prepare an environmental impact statement (EIS) for the Buckhorn Mountain Project, a Supplement to the final environmental impact statement for the Crown Jewel Mine was published in the Federal Register (68 FR 52736). The Forest Service has decided to cancel the preparation of this EIS. The NOI is hereby rescinded.
Conservation Security Program
The Conservation Security Program (CSP) is authorized by Title XII, Chapter 2, Subchapter A, of the Food Security Act of 1985, as amended by the Farm Security and Rural Investment Act of 2002. The Natural Resources Conservation Service (NRCS) published an amendment to the interim final rule for CSP on March 25, 2005, (70 FR 15201), with a comment period expiring July 25, 2005. By this notice, NRCS is extending the period during which it will accept public comment on the amended interim final rule for CSP to September 9, 2005. This extension is to give the public additional time to comment on key issues that have been raised regarding the implementation of the program under the amended interim final rule.
Syngenta Seeds, Inc.; Determination of Nonregulated Status for Cotton Genetically Engineered for Insect Resistance
We are advising the public of our determination that cotton designated as transformation Event COT102, which has been genetically engineered for insect resistance, is no longer considered a regulated article under our regulations governing the introduction of certain genetically engineered organisms. Our determination is based on our evaluation of data submitted by Syngenta Seeds, Inc., in its petition for a determination of nonregulated status, our analysis of other scientific data, and comments received from the public in response to a previous notice. This notice also announces the availability of our written determination and our finding of no significant impact.
Highly Pathogenic Avian Influenza; Additional Restrictions
We are adopting as a final rule, without change, an interim rule that amended the regulations concerning the importation of animals and animal products to prohibit or restrict the importation of birds, poultry, and unprocessed birds and poultry products from regions that have reported the presence of the H5N1 subtype of highly pathogenic avian influenza and to establish additional permit and quarantine requirements for U.S. origin pet birds and performing or theatrical birds and poultry returning to the United States. The interim rule was necessary to prevent the introduction of highly pathogenic avian influenza subtype H5N1 into the United States.
Vidalia Onions Grown in Georgia; Increased Assessment Rate
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim final rule which increased the assessment rate and changed the assessable unit established for the Vidalia Onion Committee (Committee) for the 2005 and subsequent fiscal periods from $0.12 per 50-pound bag or equivalent to $0.10 per 40-pound carton of Vidalia onions. The assessment rate of $0.10 per 40-pound carton is $0.0001 per pound more than the assessment rate previously in effect. The Committee locally administers the marketing order which regulates the handling of Vidalia onions grown in Georgia. Authorization to assess Vidalia onion handlers enables the Committee to incur expenses that are reasonable and necessary to administer the program. The fiscal period began January 1 and ends December 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
