Port Access Route Study: Approaches to Galveston Bay and Sabine Pass, Texas and Calcasieu Pass, Louisiana
The Coast Guard is conducting a Port Access Route Study (PARS) to evaluate the adequacy of existing vessel routing measures and determine whether additional vessel routing measures are necessary for port approaches to Galveston Bay and Sabine Pass, Texas, Calcasieu Pass, Louisiana, and international and domestic transit areas in the Eighth Coast Guard District area of responsibility (AOR). The Approaches to Galveston Bay and Sabine Pass, Texas and Calcasieu Pass, Louisiana PARS (TX/LAPARS) will consider whether existing or additional routing measures are necessary to improve navigation safety due to factors such as planned or potential wind energy offshore development, current port capabilities and planned improvements, increased vessel traffic, changing vessel traffic patterns, weather conditions, or navigational difficulty. Vessel routing measures, which include traffic separation schemes, two-way routes, recommended tracks, deep-water routes, precautionary areas, and areas to be avoided, are implemented to reduce risk of marine casualties. The recommendations of the study may subsequently be implemented through rulemakings or in accordance with international agreements.
Safety Zone; Back River, Hampton, VA; Air Show
The Coast Guard is proposing to establish a safety zone for certain waters in the vicinity of the northwest branch of the Back River. This action is necessary to provide for the safety of life on these navigable waters near Langley Air Force Base, Hampton, VA, during an annual airshow. This proposed rulemaking would prohibit persons and vessels from entry in the safety zone unless authorized by the Captain of the Port Virginia or a designated representative. Great Lakes Pilotage Rates-2023 Annual Ratemaking and Review of Methodology
In accordance with the statutory provisions enacted by the Great Lakes Pilotage Act of 1960, the Coast Guard is issuing new base pilotage rates for the 2023 shipping season. This rule adjusts the pilotage rates to account for changes in district operating expenses, an increase in the number of pilots, and anticipated inflation. These changes, when combined, result in a 16-percent net increase in pilotage costs compared to the 2022 season.
Safety Zone; Sabine River, Orange, TX
The Coast Guard is establishing a temporary safety zone for certain navigable waters of the Sabine River, extending the entire width of the river, adjacent to the public boat ramp located in Orange, TX. This action is necessary to protect persons and vessels from hazards associated with a high-speed Jet Ski race competition in Orange, TX. Special Local Regulation; San Diego Fleet Week Veterans Day Boat Parade; San Diego Bay, San Diego, CA
The Coast Guard is amending its special local regulations for recurring marine parades, regattas, and other events in Southern California Annual Marine Events for the San Diego Captain of the Port Zone. This final rule will add one new recurring special local regulation for the San Diego Fleet Week Veterans Day Boat Parade. This action is necessary to provide for the safety of life on the navigable waters during the annual event, and will restrict vessel traffic in the designated areas during the event unless authorized by the Captain of the Port Sector San Diego or a designated representative.
Safety Zone: Tall Ships America; Tampa Bay, St Petersburg, FL
The Coast Guard is establishing a temporary moving safety zone on the waters of Tampa Bay, around a Tall Ships America Parade of sail in St Petersburg, Florida. The safety zone will extend 100 yards from the beam of the ships as they transit from the muster point in approximate position 27[deg]43.54' N 082[deg]36.38' W to the moorings at Port St Pete, St Petersburg, FL in approximate position 27[deg]45.34' N 082[deg]37.15' W. The safety Zone is necessary to protect the public, wooden sailing vessels and their crews from the hazards associated with transiting the area. Persons and vessels are prohibited from entering, transiting through, anchoring in, or remaining within the safety zone unless authorized by the Captain of the Port St. Petersburg or a designated representative.We invite your comments on this proposed rulemaking.
Safety Zone: Macy's July 4th Fireworks, East River, NY
The Coast Guard is removing the safety zone established by the Captain of the Port Sector New York on April 11, 2001, that can be found under [Docket CGD01-00-242], titled ``Safety Zone: Macy's July 4th Fireworks, East River, NY.'' The safety zone was established to protect persons and vessels from potential hazards associated with the annual 4th of July fireworks display and high concentration of spectator vessels. The Coast Guard has since established a Special Local Regulation that regulates marine traffic in conjunction with the annual marine event, eliminating the need for the safety zone established in 2001. This action removes the existing regulations related to the initial safety zone.
Navigation and Navigable Waters, and Shipping; Technical, Organizational, and Conforming Amendments
This final rule makes non-substantive technical, organizational, and conforming amendments to existing Coast Guard regulations. This rule is a continuation of our practice of periodically issuing rules to keep our regulations up-to-date and accurate. This rule will have no substantive effect on the regulated public.
Security Zone; San Francisco Bay, Oakland Estuary, Alameda, CA
The Coast Guard is proposing to amend the established security zone extending 50 yards into the navigable waters of the Oakland Estuary, Alameda, California, surrounding the Coast Guard Island Pier. The proposed security zone change would include the entire perimeter of Coast Guard Island and 50 yards on either side of the Coast Guard Island causeway (Dennison Street Bridge). This action is necessary to provide for the continued security of the military service members on board vessels moored at the pier, as well as all military members and government property on Coast Guard Island. This security zone would prohibit all persons and vessels from entering, transiting through or anchoring within a portion of the Oakland Estuary surrounding Coast Guard Island, and prohibit all persons and vessels from loitering within 50 yards of the Coast Guard Island causeway, unless authorized by the Captain of the Port (COTP) or his designated representative. Special Local Regulation; Marine Events Within the Eleventh Coast Guard District-Mark Hahn Memorial 300 Mile PWC Endurance Race.
The Coast Guard will enforce the Mark Hahn Memorial 300 Mile Personal Watercraft (PWC) Endurance Race special local regulation on the waters of Lake Havasu, Arizona from February 25 through February 26, 2023. This special local regulation is necessary to provide for the safety of the participants, crew, sponsor vessels, and general users of the waterway. During the enforcement period, persons and vessels are prohibited from entering, transiting through, or anchoring within this regulated area unless authorized by the Captain of the Port, or his designated representative.

Security Zones; Corpus Christi Ship Channel, Corpus Christi, TX
The Coast Guard is establishing three temporary, 500-yard radius, moving security zones for certain vessels carrying Certain Dangerous Cargoes (CDC) within the Corpus Christi Ship Channel and La Quinta Channel. The temporary security zones are needed to protect the vessels, the CDC cargo, and the surrounding waterway from terrorist acts, sabotage, or other subversive acts, accidents, or other events of a similar nature. Entry of vessels or persons into these zones is prohibited unless specifically authorized by the Captain of the Port Sector Corpus Christi or a designated representative.
Safety Zone; Riverwalk Marketplace/Lundi Gras Fireworks Display, New Orleans, LA
The Coast Guard will enforce a temporary safety zone for the Riverwalk Marketplace/Lundi Gras fireworks display on February 20, 2023, to provide for the safety of life on navigable waterways during this event. Our regulation for annual fireworks displays and other events in the Eighth Coast Guard District requiring safety zones identifies the regulated area for this event on the navigable waters of the Lower Mississippi River between Mile Marker (MM) 93 and MM 96, New Orleans, LA. During the enforcement period, entry into this zone is prohibited unless authorized by the Captain of the Port or a designated representative. All persons and vessels shall comply with the instructions of the Captain of the Port or designated representative. Designated representatives include commissioned, warrant, and petty officers of the U.S. Coast Guard.
Security Zone; Lower Mississippi River, Mile Marker 94 to 97 Above Head of Passes, New Orleans, LA
The Coast Guard will enforce a security zone for all navigable waters within 400 yards of the Left Descending Bank (LDB) of the Lower Mississippi River (LMR) Mile Marker (MM) 94.4 to MM 95.1, Above Head of Passes (AHP), New Orleans, LA. This security zone is necessary to provide security and protection for visiting personnel during the events related to the Mardi Gras celebration. No person or vessel may enter this security zone unless authorized by the Captain of the Port New Orleans (COTP) or a designated representative.
National Maritime Security Advisory Committee; March 2023 Virtual Meeting
The National Maritime Security Advisory Committee (Committee) will meet virtually to review and discuss on matters relating to national maritime security, including on enhancing the sharing of information related to cybersecurity risks that may cause a transportation security incident, between relevant Federal agencies and State, local, and tribal governments; relevant public safety and emergency response agencies; relevant law enforcement and security organizations; maritime industry; port owners and operators; and terminal owners and operators. Safety Zone; Savannah River, M/V BIGLIFT BAFFIN, Savannah, GA
The Coast Guard is establishing a temporary safety zone for navigable waters of the Savannah River, within a 500-yard radius around M/V BIGLIFT BAFFIN. The safety zone is needed to protect personnel, vessels, and the marine environment from potential hazards created by the transit through the Savannah River to Georgia Port Authority Garden City Terminal Berth No. 1 while carrying large cranes, and for the offload of those cranes to the facility. Entry of vessels or persons into this zone is prohibited unless specifically authorized by the Captain of the Port Savannah or a designated representative.
Safety Zone; Upper Mississippi River Mile Marker 490.2-489.7 Davenport, IA
The Coast Guard is establishing a temporary safety zone for all navigable waters in the Upper Mississippi River at Mile Marker (MM) 490.2 to MM 489.7. The safety zone is needed to protect personnel, vessels, and the marine environment from all potential hazards associated with electrical line work. Entry of vessels or persons into this zone is prohibited unless specifically authorized by the Captain of the Port Sector Upper Mississippi River (COTP) or a designated representative.
Removal of Regulated Navigation Areas Within District 5
The Coast Guard is updating District 5 regulations to remove two regulated navigation areas in Captain of the Port Zone (COTP) North Carolina within District 5 that are no longer needed. These areas were created to address the impacts of extreme shoaling in the Oregon Inlet, but subsequent Army Corps of Engineers dredging activities have alleviated the issue. The Coast Guard is removing these regulated navigation areas (RNAs) from the CFR to prevent confusion and to make the regulations easy to use.
Safety Zone; Pipeline Installation; Anclote River, Tampa Bay, Tarpon Springs, FL
The Coast Guard is establishing a temporary safety zone for navigable waters within the Anclote River, Tampa Bay, Tarpon Springs, FL, within 200 yards from the Dredge DIAMOND 6 and Tug LADY LAFON, effectively closing the waterway to all traffic. The safety zone is needed to protect personnel, vessels, and the marine environment from potential hazards created by dredge work and installation of the pipeline. The bridge owner, Metro-North (MNR), submitted a request on May 5, 2022 to modify the regulation to align with the Metro-North ``WALK'' Bridge train schedule and avoid bridge openings during peak transit hours. It is expected that this change to the regulations will better serve the needs of the community while continuing to meet the reasonable needs of navigation. The zone will be enforced on February 7, 2023 through the early morning hours on February 8, 2023. This action is necessary to protect government officials, mitigate potential terrorist acts and incidents, and enhance public and maritime safety and security immediately before, during, and after this activity. The proposed change is designed to align the coordinates in the regulation with the coordinates needed to properly control traffic in cases of restricted visibility in Tampa Bay. BNSF Railway Bridge Across the Missouri River Between Bismarck and Mandan, North Dakota; Record of Decision
The Coast Guard announces the availability of a Record of Decision (ROD) for the replacement of the BNSF Railway Bridge across the Missouri River between Bismarck and Mandan, North Dakota. This was prepared in compliance with the National Environmental Policy Act (NEPA) of 1969, as amended, and Council on Environmental Quality implementing regulations. The ROD, which concludes the Environmental Impact Statement (EIS) process for the project, explains the Coast Guard's decision, describes the alternatives considered, and discusses the plans for mitigation and monitoring. The Coast Guard's decision is to approve the location and plans for the replacement of the BNSF Railway Bridge using the applicant's preferred alternative: Construct a new bridge with 200-foot spans and piers, 20 feet upstream of the existing bridge, and remove the existing bridge. The Coast Guard is making the ROD available to the public in the docket for this notice.
Area Maritime Security Advisory Committee Duluth Vacancies
This notice requests individuals interested in serving on the Western Lake Superior Area Maritime Security Committee to submit their applications for membership to the Captain of the Port Duluth. The Committee assists the Captain of the Port as the Federal Maritime Security Coordinator, Duluth, in developing, reviewing, and updating the Area Maritime Security Plan for their area of responsibility.
Certificate of Alternative Compliance for SHAVER O.N. 1257204, HULL 129
The Coast Guard announces that the Chief, Prevention Division, Thirteenth Coast Guard District has issued a certificate of alternative compliance from the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), for the SHAVER, O.N. 1257204, HULL 129. We are issuing this notice because its publication is required by statute. Due to the construction and placement of the mooring and anchor winches and fittings, placement of the sidelights in this area would be a potential hazard to the crew during vessel operations and may subject them to potential damage during mooring. The SHAVER, O.N. 1257204, HULL 129, cannot fully comply with the light, shape, or sound signal provisions of the 72 COLREGS without interfering with the vessel's design and construction. This notification of issuance of a certificate of alternative compliance promotes the Coast Guard's marine safety mission.
Safety Zones; Coast Guard Sector Ohio Valley Annual and Recurring Safety Zones Update
The Coast Guard is proposing to amend and update its list of recurring safety zone regulations that take place in the Coast Guard Sector Ohio Valley area of responsibility (AOR). Through this rulemaking, the current list of recurring safety zones is proposed to be updated with revisions, additional events, and removal of events that no longer take place. This proposed rule would reduce administrative costs involved in producing separate proposed rules for each individual recurring safety zone and serve to provide notification of the known recurring safety zones throughout the year. The Coast Guard is establishing two temporary safety zones on the waters of the Delaware River in portions of Marcus Hook Range and Anchorage 7, off Marcus Hook Range. The safety zones temporarily restrict vessel traffic from transiting or anchoring in portions of the Delaware River while maintenance dredging is being conducted within the Delaware River. The safety zones are needed to protect personnel, vessels, and the marine environment from hazards created by dredging operations. Entry of vessels or persons into these zones is prohibited unless specifically authorized by the COTP or his designated representatives.
Civil Monetary Penalty Adjustments for Inflation
In this final rule, the Department of Homeland Security (DHS) makes the 2023 annual inflation adjustment to its civil monetary penalties. On November 2, 2015, the President signed into law The Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (the 2015 Act). Pursuant to the 2015 Act, all agencies must adjust their civil monetary penalties annually and publish the adjustment in the Federal Register. Accordingly, this final rule adjusts the Department's civil monetary penalties for 2023 pursuant to the 2015 Act and Executive Office of the President (EOP) Office of Management and Budget (OMB) guidance. The new penalties will be effective for penalties assessed after January 13, 2023 whose associated violations occurred after November 2, 2015.

The Coast Guard requests individuals interested in serving on the Area Maritime Security Committee, Eastern Great Lakes, Northeast Ohio Region sub-committee submit their applications for membership to the U.S. Coast Guard Captain of the Port, Buffalo. The Committee assists the Captain of the Port as the Federal Maritime Security Coordinator, Buffalo, in developing, reviewing, and updating the Area Maritime Security Plan for their area of responsibility.
Safety Zone; Corpus Christi Shipping Channel, Corpus Christi, TX
The Coast Guard is establishing a temporary safety zone for all navigable waters of the Corpus Christi Shipping Channel in a zone defined by the following coordinates; 27[deg]50'31.28'' N, 97[deg]04'17.23'' W; 27[deg]50'31.73'' N, 97[deg]04'15.44'' W; 27[deg]50'29.06'' N, 97[deg]04'16.61'' W; 27[deg]50'29.32'' N, 97[deg]04'14.82'' W. The safety zone is needed to protect personnel, vessels, and the marine environment from potential hazards created by pipelines that will be removed from the floor of the Corpus Christi Shipping Channel. Entry of vessels or persons into this zone is prohibited unless specifically authorized by the Captain of the Port Sector Corpus Christi or a designated representative.
