We, the Bureau of Reclamation (Reclamation), published a final rule in the Federal Register on October 22, 2020, to add a definition for electric bikes (E-bikes) and exclude E-bikes from the regulatory definition of an off-road vehicle. Since the publication of the final rule, an editorial error was discovered in the definitions section. This action makes the necessary correction to the final rule.

Reclamation, as the lead Federal agency, and the New Mexico Interstate Stream Commission (ISC), as joint lead agency, issued a Draft EIS for public review on April 24, 2020. On October 15, 2020, the ISC, Reclamation, and the New Mexico CAP Entity terminated the Interim Advance Funding Agreement, which funded the NM Unit EIS process.

The Bureau of Reclamation (Reclamation) is amending its regulations to add a definition for electric bikes (E-bikes) and exclude E-bikes from the regulatory definition of an off-road vehicle where E-bikes are being used on roads and trails where mechanized, non- motorized use is allowed, where E-bikes are not propelled exclusively by a motorized source, and appropriate Reclamation Regional Directors expressly determine through a formal decision that E-bikes should be treated the same as non-motorized bicycles. This change facilitates increased E-bike use where other types of bicycles are allowed in a manner consistent with existing use of Reclamation land, and increases recreational opportunities for all Americans, especially those with physical limitations.

The proposed action was modified in 2017, and Reclamation determined that an Environmental Assessment (EA) rather than an EIS was the appropriate level of environmental documentation for the modified proposed action. An EA was prepared on an Extension Lease by Reclamation and the Bureau of Indian Affairs (BIA)-Navajo Region as joint lead agencies. Signed Findings of No Signficiant Impact (FONSI) were announced to the public on November 30, 2017.

To provide consistency in Federal policy among agencies with recreational opportunities pertinent to Secretarial Order 3376, the Bureau of Reclamation (Reclamation) is proposing to amend this regulation to add a definition for E-bikes and exempt E- bikes from the regulatory definition of an off-road vehicle where E- bikes are being used on roads and trails where mechanized, non- motorized use is allowed, they are not being propelled exclusively by a motorized source, and the appropriate regional director expressly determines through a formal decision that E-bikes should be treated the same as non-motorized bicycles. This proposed change would facilitate increased E-bike use where other types of bicycles are allowed in a manner consistent with existing use of Reclamation land, and increase recreational opportunities for all Americans, especially those with physical limitations.
