Bureau of Land Management 2017 – Federal Register Recent Federal Regulation Documents

On March 26, 2015, the Bureau of Land Management (BLM) published in the Federal Register a final rule entitled, ``Oil and Gas; Hydraulic Fracturing on Federal and Indian Lands'' (2015 rule). With this final rule, the BLM is rescinding the 2015 rule because we believe it imposes administrative burdens and compliance costs that are not justified. This final rule returns the affected sections of the Code of Federal Regulations (CFR) to the language that existed immediately before the published effective date of the 2015 rule (June 24, 2015), except for changes to those regulations that were made by other rules published between the date of publication of the 2015 rule and now, and the phrase ``perform nonroutine fracturing jobs,'' which is not restored to the list of subsequent operations requiring prior approval. None of the changes by other rules are relevant to this rulemaking.

The plats of survey of the following described lands were officially filed in the Bureau of Land Management (BLM), Arizona State Office, Phoenix, Arizona, on the dates indicated. Surveys announced in this notice are necessary for the management of lands administered by the agencies indicated.

This order extends the duration of the withdrawal created by Public Land Order No. 7306 for an additional 20-year period. This extension is necessary to continue the protection of the 3,805.87 acre Howell Canyon Recreation Complex located in Cassia County, Idaho.

The Bureau of Land Management (BLM) is proposing to sell 5.93 acres of public land to resolve an unauthorized use and occupancy in Santa Barbara County, California, to Arc Vineyards, LLC, under the Federal Land Policy and Management Act of 1976 (FLPMA), as amended, at not less than the fair market value of $19,500.

The plats of survey described below are scheduled to be officially filed in the New Mexico State Office, Bureau of Land Management (BLM), Santa Fe, New Mexico, thirty (30) calendar days from the date of this publication.

In accordance with the Federal Land Policy and Management Act of 1976 and the Federal Advisory Committee Act of 1972, the U.S. Department of the Interior, Bureau of Land Management (BLM) Dominguez- Escalante National Conservation Area (NCA) Advisory Council (Council) will meet as indicated below.

Pursuant to applicable provisions of the Federal Lands Recreation Enhancement Act (FLREA), the Bureau of Land Management's (BLM) Royal Gorge Field Office is proposing to begin collecting fees for a Standard Amenity Day-Use Site in the Guffey Gorge Day-Use Area, east of Guffey, within Park County, Colorado. In the 2015 Guffey Gorge Management Plan, the BLM designated Guffey Gorge Day-Use Area as a Special Area, where resources require intensive management and control measures for their protection, and a permit system to achieve management objectives.

In accordance with the Federal Land Policy and Management Act (FLPMA) of 1976 and the Federal Advisory Committee Act (FACA) of 1972, and the U.S. Department of the Interior, Bureau of Land Management (BLM), the Farmington District Resource Advisory Council (RAC) will meet as indicated below.

In compliance with the National Environmental Policy Act of 1969, as amended (NEPA), and the Federal Land Policy and Management Act of 1976, as amended, the Bureau of Land Management (BLM) El Centro Field Office, with the United States Army Corps of Engineers (USACE) as a cooperating agency, intends to prepare a Supplemental Environmental Impact Statement (EIS) for the United States Gypsum Company (USG) Mine Expansion/Modernization Project. The Supplemental EIS will analyze additional alternatives and update technical information in the 2008 USG Mine Expansion/Modernization Project Final Environmental Impact Report (EIR)/EIS. The USACE was not involved in the development of the EIR/EIS, but will be involved with the Supplemental EIS, based on USACE's jurisdiction by law and special expertise, pursuant to section 404 of the Clean Water Act. Scoping is not usually required for preparation of a Supplemental EIS. However, since USACE was not a cooperating agency during scoping of the EIR/EIS, they have requested that public scoping be included for the Supplemental EIS. This notice announces the beginning of the public scoping process for input into the Supplemental EIS. The goal of the scoping process is to solicit public comments, for the purpose of identifying relevant issues that will influence the scope of the environmental analysis, including alternatives, and guide the process for developing the Supplemental EIS.

The Bureau of Land Management (BLM) is proposing supplementary rules for all BLM-administered lands within the Fairbanks District Office administrative site. These proposed supplementary rules are necessary to enhance the safety of visitors, protect natural resources, improve recreation experiences and opportunities, and protect public health.

The surveys, which were executed at the request of the Bureau of Indian Affairs, Rocky Mountain Region, Billings, Montana, are necessary for the management of these lands.

The Bureau of Land Management (BLM) announces the availability of the Record of Decision (ROD) for the Boardman to Hemingway Transmission Line Project (B2H Project) and Approved Land-use Plan Amendments of the Baker and Southeastern Oregon Resource Management Plans (RMPs). The ROD constitutes the BLM's final decision regarding: (1) Approval to grant a Right-of-Way (ROW) to Idaho Power Company to construct, operate and maintain an extra-high-voltage, alternating- current transmission system; and (2) Amending portions of the BLM Baker and Southeastern Oregon RMPs.

The Bureau of Land Management (BLM) hereby provides constructive notice that it will issue an appealable decision approving conveyance of the surface and subsurface estates in certain lands to Chugach Alaska Corporation, an Alaska Native regional corporation, pursuant to the Alaska Native Claims Settlement Act of 1971, as amended (ANCSA).

The Montana Department of Natural Resources and Conservation (State) has filed a petition for classification and application to obtain public lands and the mineral estate in lieu of lands to which the State was entitled, but did not receive, under its Statehood Act. This classification, made under Section 7 of the Taylor Grazing Act of June 8, 1934, partially satisfies the obligation to the State. This Notice also extends the segregation initiated by that application, and the proposed classification published in the Federal Register on October 17, 2016, for the remaining lands included in the State's application to allow continued review to determine suitability.

The Bureau of Land Management (BLM) has examined 28.69 acres of public land located in Kootenai County, Idaho, and found it suitable for classification for lease and conveyance under the provisions of the Recreation and Public Purposes (R&PP) Act, as amended.

In accordance with Section 7 of the Taylor Grazing Act and Executive Order 6910, as amended, the Bureau of Land Management (BLM), Carson City District, Nevada, has examined and found suitable for classification for lease/conveyance approximately 80 acres of public land in Washoe County, Nevada, under the provisions of the Recreation and Public Purposes (R&PP) Act of June 14, 1926, as amended.
