The United States Forest Service (USFS) has filed an application with the Bureau of Land Management (BLM) requesting the Secretary of the Interior to withdraw approximately 240.59 acres of National Forest System lands in the Fremont-Winema National Forest from mining for a 20-year term to protect the integrity, functionality, and the investment of the mine reclamation work completed at the White King/Lucky Lass Mine reclamation project area. On May 11, 2012, the Bureau of Land Management (BLM) published in the Federal Register a proposed rule to regulate hydraulic fracturing on Federal and Indian land. Due to the complexity of the rule and the issues surrounding it, the BLM extended the comment period for 60 days beyond the end of the initial comment period. On May 24, 2013, the BLM published a supplemental notice of proposed rulemaking and request for comment. Key issues in the revised proposed rule include: the use of an expanded set of cement evaluation tools to help ensure that usable water zones have been isolated and protected from contamination and more detailed guidance on how trade secrets claims will be handled. The revised proposed rule would also provide opportunities for the BLM to coordinate standards and processes with individual States and tribes to reduce administrative costs and improve efficiency. This notice extends the public comment period on the revised proposed rule for 60 days beyond the initial comment period.

The BLM has used the comments on that draft to make improvements and is now seeking additional comment on a revised proposed rule. Key issues in this updated draft include: the use of an expanded set of cement evaluation tools to help ensure that usable water zones have been isolated and protected from contamination; and more detailed guidance on how trade secrets claims will be handled, modeled on the procedures promulgated by the State of Colorado. The revised proposed rule would also provide opportunities for the BLM to coordinate standards and processes with individual States and tribes to reduce administrative costs and to improve efficiency.

The Approved Land Use Plan Amendments/Record of Decision (ROD) for Allocation of Oil Shale and Tar Sands Resources on Lands Administered by the Bureau of Land Management (BLM) in Colorado, Utah, and Wyoming was signed by the BLM Principal Deputy Director on March 22, 2013. The ROD constitutes the final decision of the BLM and the Approved Plan Amendments were effective immediately upon its signing. The revocation affects 185.88 acres of public lands withdrawn on behalf of the Bureau of Reclamation for the O'Neil Unit, Pick-Sloan Missouri River Basin Project. The Bureau of Reclamation has determined that it no longer needs the lands for reclamation purposes. This order also transfers administrative jurisdiction of the lands to the National Park Service for management under the provisions of the Wild and Scenic Rivers Act and the Niobrara Scenic River Designation Act of 1991.

This order withdrew approximately 22.51 acres of National Forest System land from settlement, sale, location, or entry under the general land laws, including the United States mining laws, for protection of the Glacier Loop Administrative Site in Alaska. The withdrawal created by PLO No. 7177 will expire on December 20, 2015, unless extended. This notice provides the public an opportunity to comment on the proposed withdrawal extension and to request a public meeting.

The Bureau of Land Management (BLM) is amending its regulations to add provisions allowing the BLM to temporarily segregate from the operation of the public land laws, by publication of a Federal Register notice, public lands included in a pending wind or solar energy generation right-of-way (ROW) application, and public lands that the BLM identifies for potential future wind or solar energy generation right-of-way applications under applicable legal requirements. The purpose of such segregation is to promote the orderly administration of the public lands. Lands segregated under this rule will not be subject to appropriation under the public land laws, including location under the Mining Law of 1872 (Mining Law), for up to two years from the date of publication of notice under this rule, subject to valid existing rights, but would remain open under the Mineral Leasing Act of 1920 (MLA) and the Materials Act of 1947 (Materials Act).
