The Secretary of the Interior (Secretary), through the Office of Indian Energy and Economic Development (IEED), is soliciting grant proposals from Indian tribes for projects to build tribal capacity for energy resource development under the Department of the Interior's (DOI) Tribal Energy Development Capacity (TEDC) grant program. Under the Energy Policy Act of 2005 (Act), Congress appropriates funds on a year-to-year basis to DOI for grants of funds to Indian tribes for use in assessing, developing, and obtaining the managerial and technical capacity needed to develop energy resources on Indian land and properly account for energy resource production and revenues. We will use a competitive evaluation process based on criteria stated in the Supplementary Information section of this notice to select projects for funding awards.

This notice advises the public that the Bureau of Indian Affairs (BIA) as lead agency intends to gather information necessary for preparing an environmental impact statement (EIS) in connection with the Wilton Rancheria's (Tribe) application requesting that the United States acquire land in trust in Sacramento County, California, for the construction and operation of a gaming facility.

This notice advises the public that the Bureau of Indian Affairs as lead agency, with the Mashpee Wampanoag Tribe, serving as a cooperating agency, intends to file a draft environmental impact statement (DEIS) with the U.S. Environmental Protection Agency regarding the Tribe's application for the conveyance into trust of title to lands located in Mashpee and Taunton, Massachusetts, for the benefit of the Mashpee Wampanoag Tribe. This notice publishes the Miami Tribe of OklahomaLiquor Control Ordinance. This Ordinance allows for the possession and sale of alcoholic beverages within the jurisdiction of the Miami Tribe of Oklahoma, increases the ability of the tribal government to control the distribution and possession of liquor on their trust land, provides an important source of revenue and strengthens tribal government and the delivery of tribal services.

This notice publishes the amendment to the Salt River Pima- Maricopa Indian Community Alcoholic Beverage Control Ordinance, Chapter 14, Salt River Pima-Maricopa Indian Community Code of Ordinances to provide consistency with newly amended Arizona State Liquor Law and to enact certain technical amendments. The amended Salt River Pima- Maricopa Indian Alcohol Beverage Control Ordinance, Chapter 14 of the Salt River Pima-Maricopa Indian Community Code of Ordinances was last published in the Federal Register on July 13, 2010 (Vol. 75, No 133, FR 39960-39967). Sections 14-5(c)(4), 14-9(g), 14-18(o) and (t) of the Salt River Pima-Maricopa Indian Community Code of Ordinances shall be repealed and replaced in their entirety, and a new Section 14-12 has been added.

This proposed rule revises a section of regulations governing decisions by the Secretary to approve or deny applications to acquire land in trust under this part. This rule is appropriate to address changes in the applicability of the Quiet Title Act as interpreted by a recent United States Supreme Court decision. This rule revises a regulatory provision the Department added in 1996 to ensure that interested parties had the opportunity to timely seek judicial review of decisions when available under the Administrative Procedure Act. The Department had determined the provision was necessary because, consistent with Federal court decisions at the time, once the Secretary acquired title, the Quiet Title Act precluded judicial review of the Secretary's decision to take the land into trust. The Supreme Court has since held that the Quiet Title Act does not preclude timely Administrative Procedure Act challenges to agency decisions to acquire land in trust unless the aggrieved party claims an ownership interest in the property at issue. This rule revises the regulation to reflect this change in the law and to make other revisions to codify the current process for issuing decisions approving or denying requests to acquire land in trust under this part. It also broadens and clarifies the notice of decisions to acquire land in trust under this part, including broadening notice of any right to file an administrative appeal.

The Assistant SecretaryIndian Affairs made a final agency determination to acquire approximately 151.87 acres of land into trust for gaming and other purposes for the Cowlitz Indian Tribe on April 22, 2013.

The Bureau of Indian Affairs is announcing tribal consultations to discuss draft revisions of the regulations governing the Tribal Transportation Program. The consultations will also cover requirements for proposed roads and access roads to be included in the National Tribal Transportation Facility Inventory and will include an update regarding the ongoing quality assurance review of the facility inventory.
