On March 31, 2020, the U.S. Nuclear Regulatory Commission (NRC) solicited comments on a draft regulatory issue summary (RIS) to reinforce the existing requirement that prior to granting or reinstating unescorted access (UA), or certifying unescorted access authorization (UAA) to non-immigrant foreign nationals for the purpose of performing work, licensees shall take reasonable steps to access reliable, independent sources of information, in addition to the information provided by the applicant, to verify the applicant's claimed non-immigration status. The public comment period was originally scheduled to close on April 30, 2020. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments.

The U.S. Nuclear Regulatory Commission (NRC) is amending its spent fuel storage regulations by revising the Holtec International HI- STORM Flood/Wind Multipurpose Canister Storage System listing within the ``List of approved spent fuel storage casks'' to include Amendment No. 4 to Certificate of Compliance No. 1032. Amendment No. 4 revises the certificate of compliance to: Add multipurpose canister (MPC)-32ML for storage and allow the fuel assembly class 16x16D as content for MPC-32ML; add the fuel assembly class 16X16E as content for MPC-37; and make changes to the final safety analysis report to separate the design pressure for the short-term operation from the off-normal condition (to provide clarity in Table 2.2.1), add cautionary notes to Sections 9.2.1 and 9.2.3, update a definition, and replace a test program. These changes are discussed in more detail in the ``Discussion of Changes'' section of this direct final rule.

The U.S. Nuclear Regulatory Commission (NRC) is withdrawing Regulatory Guide (RG) 5.43, ``Plant Security Force Duties.'' RG 5.43 was published in January 1975 to provide guidance to applicants and licensees subject to NRC regulations on the organization of plant security forces and the duties of guards, watchmen, and other individuals responsible for security, as described in their facilities' security plans. RG 5.43 is being withdrawn because it contains regulatory guidance that is out of date and is no longer the preferred method for these applicants and licensees to use to meet the requirements. Future applicants and licensees may use several other more relevant regulatory guidance documents to meet those regulatory requirements.

The public comment period was originally scheduled to close on May 22, 2020. The U.S. Nuclear Regulatory Commission (NRC, the Commission) is issuing an order approving an application filed by the Dow Chemical Company (TDCC) on November 22, 2019. The application sought NRC approval of the indirect transfer of control of Renewed Facility Operating License No. R-108 for the Dow TRIGA Research Reactor (DTRR). The indirect transfer of control resulted from the merger of TDCC with E.I. du Pont De Nemours and Company in August 2017, which established a new parent company, DowDuPont, Inc. Subsequently, in April 2019, Dow, Inc. was formed as a separate company from DowDuPont, Inc. and TDCC became a wholly-owned subsidiary of Dow, Inc. The NRC determined that TDCC remains qualified to hold Renewed Facility Operating License No. R-108, and that the indirect transfer of the license is otherwise consistent with the applicable provisions of law, regulations, and orders issued by the Commission pursuant thereto. The NRC further determined that the indirect transfer of control of the license necessitated no changes to the license. The order is effective on the date it was issued.

The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an amendment to Renewed Facility Operating License No. NPF- 77, issued to Exelon Generation Company, LLC, for operation of the Braidwood Station, Unit No. 2. The proposed amendment would provide a one-time extension of steam generator tube inspections to allow the inspections to be conducted after three operating cycles instead of after the current required two operating cycles. The amendment is necessary to avoid conflicts with the Centers for Disease Control and Prevention recommendations regarding social distancing to prevent the spread of the COVID-19 virus. The amendment also avoids a possible scenario in which expertise required to conduct the inspections is lost because of COVID-19 infections.

This DRG provides guidance for the NRC staff to use in reviewing the Instrumentation and Controls (I&C) portions of applications for advanced non-LWRs within the bounds of existing regulations. The guidance supports NRC's Non-LWR Vision and Strategy, Implementation Action Plan Strategy 3, which involves developing: (1) Guidance for flexible regulatory review processes for non-LWRs within the bounds of existing regulations; and (2) a new non-LWR regulatory framework that is risk-informed and performance-based, and that features NRC staff's review efforts commensurate with the demonstrated safety performance of non-LWR technologies.

The U.S. Nuclear Regulatory Commission (NRC) is granting an exemption to allow a departure from the certification information of Tier 1 of the generic design control document (DCD) and is issuing License Amendment Nos. 177 and 176 to Combined Licenses (COLs), NPF-91 and NPF-92, respectively. The COLs were issued to Southern Nuclear Operating Company, Inc., and Georgia Power Company, Oglethorpe Power Corporation, MEAG Power SPVM, LLC, MEAG Power SPVJ, LLC, MEAG Power SPVP, LLC, and the City of Dalton, Georgia (collectively SNC); for construction and operation of the Vogtle Electric Generating Plant (VEGP) Units 3 and 4, located in Burke County, Georgia. The granting of the exemption allows the changes to Tier 1 information asked for in the amendment. Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.

The U.S. Nuclear Regulatory Commission (NRC) is denying Petition for Rulemaking (PRM)-50-115, ``Petition for RulemakingFire Protection Compensatory Measures,'' dated May 1, 2017, submitted by David Lochbaum and Paul Gunter (the petitioners) on behalf of the Union of Concerned Scientists and Beyond Nuclear, respectively. The petitioners request that the NRC issue regulations that establish acceptable conditions for the use of compensatory measures (e.g., fire watches, surveillance cameras) during periods when fire protection regulations are not met, as well as define the maximum duration that compensatory measures may be relied upon. The NRC staff concludes that the petitioners did not present sufficient new information or arguments to warrant the requested changes to the regulations in light of the NRC's relevant past decisions and current policies. Therefore, the NRC is denying PRM-50-115.

The U.S. Nuclear Regulatory Commission (NRC) is issuing Revision 1 to Regulatory Guide (RG) 8.39, ``Release of Patients Administered Radioactive Material.'' This RG (Revision 1) provides licensees with more detailed instructions to provide to patients before and after they have been administered radioactive material than was in Revision 0. In addition, the guide includes a new section on ``Death of a Patient Following Radiopharmaceutical or Implants Administrations,'' as well as requirements for recordkeeping. Also, Table 3, ``Activities of Radiopharmaceuticals That Require Instructions and Records When Administered to Patients Who Are Breastfeeding an Infant or Child,'' has been revised.

The U.S. Nuclear Regulatory Commission (NRC) is issuing an order approving the transfer to ADP CR3, LLC (ADP CR3) of the licensed authority of Duke Energy Florida, LLC (DEF) under Facility Operating License No. DPR-72 for the Crystal River Unit 3 Nuclear Generating Plant (CR-3) and the general license for the CR-3 independent spent fuel storage installation (ISFSI) to possess, maintain, and decommission CR-3 and its ISFSI. The order also approves a draft conforming administrative license amendment to reflect the transfer from DEF to ADP CR3. The NRC determined that ADP CR3 is qualified to hold the licenses to the extent proposed, and that the transfer is otherwise consistent with applicable provisions of law, regulations, and orders issued by the Commission pursuant thereto, subject to the condition described in the order. The order became effective on April 1, 2020.

Pursuant to section 189.a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all amendments issued, or proposed to be issued, from approximately March 10, 2020, to March 23, 2020. The last biweekly notice was published on March 24, 2020.

Amendment No. 1 makes the following changes: Adds a new basket type (Type 4) to allow for the loading of intact, damaged, or failed fuel; adds another new basket type (Type 5) with low conductivity poison basket plates and low emissivity coated steel basket plates; accepts fuel assemblies with a minimum two-year cooling time, in selected locations within the basket; adds the NUHOMS[supreg] MATRIX design as an alternative to the EOS horizontal storage module design for the storage of spent fuel; and makes additional revisions to the certificate of compliance and the technical specifications for consistency and clarity.

The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of an amendment to Renewed Facility Operating License No. NPF- 47, issued to Entergy Operations, Inc. (the licensee), for operation of the River Bend Station, Unit 1. The proposed amendment would extend the implementation time from May 13, 2020, to September 30, 2020, for the NRC-approved license amendment issued May 14, 2019, associated with revising the emergency action levels (EALs) scheme based on Nuclear Energy Institute (NEI) guidance. The licensee is requesting this extension due to unforeseen circumstances.

On February 4, 2020, the U.S. Nuclear Regulatory Commission (NRC) requested input from its licensees and members of the public to identify outdated or duplicative administrative requirements that may be eliminated without an adverse effect on public health or safety, common defense and security, protection of the environment, or regulatory efficiency and effectiveness. The public comment period originally was scheduled to close on April 6, 2020. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments.
