Source Materials License No. SUC-1593, Amendment 2, Davy Crockett Depleted Uranium at Various United States Army Installations
The U.S. Nuclear Regulatory Commission (NRC) is issuing an amendment to Source Materials License No. SUC-1593, issued to the U.S. Army Installation Command (Army). The Army submitted site-specific Environmental Radiation Monitoring Plans (ERMPs) and site-specific dose modeling that are consistent with the programmatic ERMP and the dose modeling methodology approved by License Amendment 1. All site-specific ERMPs meet license conditions (LCs) 18 and 19. License condition 18 was modified indicating that each site-specific ERMP shall be fully implemented within 6 months of approval of License Amendment 2 and LC 19 was deleted because the Army's submittal met this LC. The programmatic ERMP, dated September 15, 2016, was determined to be identical to the approved programmatic ERMP except for the removal of RESRAD environmental default parameters and has been incorporated into the license by reference.

The U.S. Nuclear Regulatory Commission (NRC) is issuing an Order prohibiting Mr. Curtis Thompson from involvement in NRC-licensed activities for a period of 1 year. The Order also requires Mr. Thompson to notify the NRC of any current involvement in NRC-licensed activities and for a period of 1 year after the 1-year period of prohibition has expired, that he provide a written notice for his first employment offer involving NRC-licensed activities.
Program-Specific Guidance About Exempt Distribution Licenses
The U.S. Nuclear Regulatory Commission (NRC) is revising its licensing guidance for licenses authorizing initial distribution of byproduct material or source material to persons exempt from the requirements (exempt distribution) for an NRC license. The NRC is requesting public comment on draft NUREG-1556, Volume 8, Revision 1, ``Consolidated Guidance About Materials Licenses: Program-Specific Guidance About Exempt Distribution Licenses.'' The document has been updated from the original version to include information on safety culture, protection of sensitive information, and changes in regulatory policies and practices. This document is intended for use by applicants, licensees, and the NRC staff.
Access Authorization and Fitness-For-Duty Determinations
The U.S. Nuclear Regulatory Commission (NRC) plans to hold a public meeting to discuss a rulemaking activity regarding the role of third parties in access authorization and fitness-for-duty determinations. The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of three amendment requests. The amendment requests are for Seabrook Station, Unit No. 1; Virgil C. Summer Nuclear Station, Units 2 and 3; and Limerick Generating Station, Unit 2. The NRC proposes to determine that each amendment request involves no significant hazards consideration. Because each amendment request contains sensitive unclassified non-safeguards information (SUNSI), an order imposes procedures to obtain access to SUNSI for contention preparation.
Southern Nuclear Operating Company, Vogtle Electric Generating Station, Units 3 and 4; Qualified Data Processing System and Safety Display
The U.S. Nuclear Regulatory Commission (NRC) is granting an exemption to allow a departure from the certification information of Tier 1 of the generic design control document (DCD) and is issuing License Amendment No. 60 to Combined Licenses (COLs), NPF-91 and NPF- 92. The COLs were issued to Southern Nuclear Operating Company, Inc., and Georgia Power Company, Oglethorpe Power Corporation, MEAG Power SPVM, LLC, MEAG Power SPVJ, LLC, MEAG Power SPVP, LLC, Authority of Georgia, and the City of Dalton, Georgia (the licensee); for construction and operation of the Vogtle Electric Generating Plant (VEGP) Units 3 and 4, located in Burke County, Georgia. The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to an August 16, 2016, request from Exelon Generation Company, LLC (Exelon or the licensee), from certain regulatory requirements. The exemption would allow a certified fuel handler (CFH), besides a licensed senior operator, to approve the emergency suspension of security measures for Clinton Power Station, Unit No. 1 (CPS); Quad Cities Nuclear Power Station, Units 1 and 2 (QCNPS); and Oyster Creek Nuclear Generating Station (OCNGS) during certain emergency conditions or during severe weather.
Guidance for Developing Principal Design Criteria for Non-Light Water Reactors
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft regulatory guide (DG), DG-1330, ``Guidance for Developing Principal Design Criteria for Non-Light Water Reactors.'' This DG is a proposed new regulatory guide (RG) to provide designers, applicants, and licensees of non-light water cooled nuclear reactors (non-LWR) guidance for developing principal design criteria (PDC) for a proposed facility. The PDC establish the necessary design, fabrication, construction, testing, and performance requirements for structures, systems, and components important to safety; that is, structures, systems, and components that provide reasonable assurance that the facility can be operated without undue risk to the health and safety of the public.

The U.S. Nuclear Regulatory Commission (NRC) has granted the request of Entergy Nuclear Operations, Inc. (Entergy, the licensee), to withdraw its application dated February 4, 2016, for a proposed amendment to Facility Operating License No. DPR-59. The proposed amendment request would have revised the James A. FitzPatrick Nuclear Power Plant (JAF) Emergency Plan to reduce the Emergency Response Organization (ERO) positions that the licensee considers unnecessary to effectively respond to credible accidents following permanent defueling.

The proposed amendment request would have revised and removed certain requirements in the James A. FitzPatrick Nuclear Power Plant (JAF) Technical Specification (TS) Sections 5.1, ``Responsibility''; 5.2, ``Organization''; and 5.3, ``Plant Staff Qualifications,'' and added additional definitions to TS Section 1.1, ``Definitions,'' once certifications for permanent cessation of operation and permanent removal of fuel from the reactor are submitted to the NRC.
Exelon Generation Company, LLC; Quad Cities Nuclear Power Station, Units 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) has granted the request of Exelon Generation Company, LLC (the licensee), to withdraw its application dated October 20, 2016, for a proposed amendment to Renewed Facility Operating License Nos. DPR-29 and DPR-30, for Quad Cities Nuclear Power Station (QCNPS), Units 1 and 2, respectively. The proposed amendment request would support changes to the organization, staffing, and training requirements contained in Sections 1.0 and 5.0 of the Technical Specifications after the license no longer authorizes operation of the reactor or placement or retention of fuel in the reactor pressure vessel. This proposed amendment also supports implementation of the Certified Fuel Handler training program.

The public comment period was originally scheduled to close on February 21, 2017. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments.

Western Nuclear Incorporated; Split Rock Wyoming Site
The U.S. Nuclear Regulatory Commission (NRC) has received a request from Western Nuclear Incorporated for amendment of Materials License No. SUA-56 to modify the Alternate Concentration Limit for nitrate at the Western Nuclear Incorporated site in Jeffery City, Wyoming. The amendment would increase the nitrate Alternate Concentration Limit at the Southwest Valley Point of Compliance from the current limit of 70.7 milligrams per liter to 500 milligrams per liter. The amendment would also revise the license to remove a specific well as the background well for the Alternate Concentration Limit and expand the proposed Long-term Care Boundary for the site.

Pursuant to section 189a. (2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all notices of amendments issued, or proposed to be issued, from December 31, 2016, to January 17, 2017. The last biweekly notice was published on January 17, 2017.
Dominion Virginia Power, North Anna Unit 3
The U.S. Nuclear Regulatory Commission (NRC) will convene an evidentiary session to receive testimony and exhibits in the uncontested portion of this proceeding regarding the application of Virginia Electric and Power Company, doing business as Dominion Virginia Power and Old Dominion Electric Power Company (Dominion) for a combined license (COL) to construct and operate an additional unit (Unit 3) at the North Anna site in Louisa County, Virginia. Amendment No. 14 will revise multiple items in the technical specifications (TSs) for dry shielded canister (DSC) models listed under CoC No. 1004; most of these revisions involve changes to the authorized contents. The revisions to the Initial Certificate, Amendment Nos. 1 through 11, and Amendment No. 13 will remove language in the TSs that requires a transfer cask (TC) containing a DSC to be returned to the spent fuel pool following a drop of over 15 inches.

Adjustment of Civil Penalties for Inflation for FY 2017
The U.S. Nuclear Regulatory Commission (NRC) is amending its regulations to adjust the maximum civil monetary penalties (CMPs) it can assess under statutes enforced by the agency. These changes are mandated by the Federal Civil Penalties Inflation Adjustment Act of 1990 (FCPIAA), as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (2015 Improvements Act). The NRC is amending its regulations to adjust the maximum CMP for a violation of the Atomic Energy Act of 1954, as amended (AEA), or any regulation or order issued under the AEA from $280,469 to $285,057 per violation, per day. Additionally, the NRC is amending provisions concerning program fraud civil penalties by adjusting the maximum CMP under the Program Fraud Civil Remedies Act from $10,781 to $10,957 for each false claim or statement.
Beaver Valley Power Station, Unit 2; Consideration of Approval of Transfer of License and Conforming Amendment
The U.S. Nuclear Regulatory Commission (NRC) received and is considering approval of an application filed by FirstEnergy Nuclear Operating Company (FENOC), acting as agent for and on behalf of FirstEnergy Nuclear Generation, LLC (FENGen), the Toledo Edison Company (TE), and the Ohio Edison Company (OE) on June 24, 2016, as supplemented on September 13, 2016, and December 15, 2016. The application seeks NRC approval of the direct transfer of License No. NPF-73 for the Beaver Valley Power Station, Unit 2, to the extent currently held by TE and OE, to FENGen. The NRC is also considering amending the renewed facility operating license for administrative purposes to reflect the proposed transfer.

The U.S. Nuclear Regulatory Commission (NRC) is issuing an exemption in response to an October 13, 2016, letter from Duke Energy Progress (DEP), which requested an exemption from certain regulatory requirements that requires DEP to submit an update to the final safety analysis report (FSAR) included in their combined license (COL) application for Shearon Harris Nuclear Power Plant (Harris) Units 2 and 3 by December 31, 2016. The NRC staff reviewed this request and determined that it is appropriate to grant the exemption, but stipulated that the update to the FSAR must be submitted prior to, or coincident with the resumption of the COL application review or by December 31, 2019, whichever comes first.
Regulatory Issue Summary Regarding Certificate of Compliance Corrections and Revisions
The U.S. Nuclear Regulatory Commission (NRC) is seeking public comment on draft regulatory issue summary (RIS) 2016-xx, ``Administration of 10 CFR part 72 Certificate of Compliance Corrections and Revisions.'' The NRC is issuing this RIS to inform addressees of the processes to revise an initial certificate of compliance (CoC) and subsequent amendments (hereafter referred to as CoCs, whether initial CoCs or subsequent amendments) to make administrative corrections and technical changes using the existing regulatory framework.
Biweekly Notice: Applications and Amendments to Facility Operating Licenses and Combined Licenses Involving No Significant Hazards Considerations
Pursuant to Section 189a.(2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all notices of amendments issued, or proposed to be issued, from December 20, 2016 to December 30, 2016. The last biweekly notice was published on January 3, 2016.
