Virginia Electric and Power Company; Surry Power Station, Unit Nos. 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a draft environmental assessment and finding of no significant impact regarding the request for temporary exemption from specific requirements of acceptance criteria for emergency core cooling systems and evaluation models for Facility Operating License Nos. DPR- 32 and DPR-37, issued to Virginia Electric and Power Company (the licensee) for the Surry Power Station, Unit Nos. 1 and 2 (Surry).
Entergy Operations, Inc.; Waterford Steam Electric Station, Unit 3
The U.S. Nuclear Regulatory Commission (NRC) is considering an application for the renewal of operating license NPF-38, which authorizes Entergy Operations, Inc. (the applicant), to operate Waterford Steam Electric Station, Unit 3 (Waterford 3). The renewed license would authorize the applicant to operate Waterford 3 for an additional 20 years beyond the period specified in the current license. The current operating license for Waterford 3 expires at midnight on December 18, 2024.
List of Approved Spent Fuel Storage Casks: Holtec International HI-STORM 100 Cask System; Certificate of Compliance No. 1014, Amendment No. 10; Corrections
The U.S. Nuclear Regulatory Commission (NRC) is confirming the effective date of May 31, 2016, for the direct final rule that was published in the Federal Register on March 14, 2016. The direct final rule amended the NRC's spent fuel storage regulations by revising the Holtec International (Holtec) HI-STORM 100 Cask System listing within the ``List of approved spent fuel storage casks'' to include Amendment No. 10 to Certificate of Compliance (CoC) No. 1014. In addition, the NRC is correcting the direct final rule because it inadvertently omitted Revision 1 to Amendment Nos. 8 and 9 to CoC No. 1014.
Foreign Ownership, Control, or Domination of Nuclear Power, and Non-Power Production or Utilization Facility
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment draft regulatory guide on Foreign Ownership, Control, or Domination of Nuclear Power, and Non-Power Production or Utilization Facility. The NRC is issuing this guidance to provide NRC staff's regulatory position to applicants for, and licensees of, nuclear power reactors and non-power production or utilization facilities (NPUFs), regarding methods acceptable to the staff of the NRC for complying with foreign ownership, control, or domination (FOCD) requirements, including guidance on the subject of foreign financing. This draft regulatory guide may be used in connection with license applications for new facilities, renewal of existing licenses, or applications for approval of direct or indirect transfers of facility licenses.
Draft Standard Review Plan on Foreign Ownership, Control, or Domination, Revision 1
On April 27, 2016, the U.S. Nuclear Regulatory Commission (NRC) solicited comments on the Draft Standard Review Plan on Foreign Ownership, Control, or Domination, Revision 1. The public comment period was originally scheduled to close on May 27, 2016. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments.
Medical Radioisotope Production Facility; Northwest Medical Isotopes, LLC
The U.S. Nuclear Regulatory Commission (NRC) is providing notice of an uncontested hearing and an opportunity to request a hearing on the Northwest Medical Isotopes, LLC (NWMI), construction permit application that proposes the construction of a medical radioisotope production facility in Columbia, Missouri. The NRC staff is currently conducting a detailed technical review of the construction permit application. If the NRC issues a construction permit, the applicant, NWMI, would be authorized to construct its proposed production facility in accordance with the provisions of the construction permit. The application contains sensitive unclassified non-safeguards information (SUNSI).
In the Matter of Entergy Nuclear Operations, Inc., Palisades Nuclear Plant
The U.S. Nuclear Regulatory Commission (NRC) is issuing a Confirmatory Order to Entergy Nuclear Operations, Inc. (Entergy), confirming agreements reached in an Alternative Dispute Resolution Session held on March 25, 2016. As part of the agreement, Entergy will take a number of actions, including: (1) Developing a case study pertaining to the leakage of the Safety Injection Refueling Water Tank at the Palisades Nuclear Plant and training site personnel with an emphasis on lessons learned from the event; (2) sharing facts and lessons learned with the Entergy Fleet and other reactor licensees; (3) reviewing and revising the Entergy corrective action and operability determination procedures to ensure indeterminate and/or changing conditions are addressed, and (4) modifying the current outreach program at Palisades to include wide audience and discussions of the event, plant safety, and current operations.
Applications and Amendments to Facility Operating Licenses and Combined Licenses Involving No Significant Hazards Considerations
Pursuant to Section 189a. (2) of the Atomic Energy Act of 1954, as amended (the Act), the U.S. Nuclear Regulatory Commission (NRC) is publishing this regular biweekly notice. The Act requires the Commission to publish notice of any amendments issued, or proposed to be issued, and grants the Commission the authority to issue and make immediately effective any amendment to an operating license or combined license, as applicable, upon a determination by the Commission that such amendment involves no significant hazards consideration, notwithstanding the pendency before the Commission of a request for a hearing from any person. This biweekly notice includes all notices of amendments issued, or proposed to be issued from April 26, 2016, to May 9, 2016. The last biweekly notice was published on May 10, 2016 (81 FR 28891).
Variable Annual Fee Structure for Small Modular Reactors
The U.S. Nuclear Regulatory Commission (NRC) is amending its licensing, inspection, and annual fee regulations to establish a variable annual fee structure for light-water small modular reactors (SMR). Under the variable annual fee structure, an SMR's annual fee would be calculated as a function of its licensed thermal power rating. This fee methodology complies with the Omnibus Budget Reconciliation Act of 1990, as amended (OBRA-90).
PSEG Nuclear LLC; Salem Nuclear Generating Station, Unit Nos. 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) is considering issuance of amendments to Facility Operating License Nos. DPR-70 and 75, issued to PSEG Nuclear LLC (PSEG or the licensee) for operation of the Salem Nuclear Generating Station (Salem), Unit Nos. 1 and 2. The proposed amendments would extend the implementation period for Salem, Unit No. 1, License Amendment No. 311, and Salem, Unit No. 2, License Amendment No. 292, from July 5, 2016 (120 days from the March 7, 2016, date of issuance of the amendments), to prior to Mode 6 entry for the Salem, Unit No. 1, fall 2017 (1R25) outage and prior to Mode 6 entry for the Salem, Unit No. 2, spring 2017 (2R22) outage to align with the outages for the replacement of the source range and intermediate range detectors.
In the Matter of Luminant Generation Company LLC; Comanche Peak Nuclear Power Plant, Unit Nos. 1 and 2, and Independent Spent Fuel Storage Installation Facility
The U.S. Nuclear Regulatory Commission (NRC) is issuing an order approving the direct transfer of ownership and indirect transfer of control of Facility Operating License (FOL) Nos. NPF-87 and NPF-89 and the general license for the independent spent fuel storage installation facility from the current holder, Luminant Generation Company LLC, to as-yet unnamed companies, herein identified as Comanche Peak LLC, as owner, and Operating Company LLC, as operator. The NRC will issue conforming amendments to the FOLs for administrative purposes to reflect the proposed license transfer. No physical changes to the facility or operational changes were proposed in the application. The Order is effective upon issuance.
Containment Shell or Liner Moisture Barrier Inspection
The U.S. Nuclear Regulatory Commission (NRC) is issuing Regulatory Issue Summary (RIS) 2016-07, ``Containment Shell or Liner Moisture Barrier Inspection.'' This RIS reiterates the NRC staff's position regarding American Society of Mechanical Engineers (ASME) code inservice inspection requirements for moisture barriers. The NRC's regulations require, in part, that licensees implement the inservice inspection program for pressure retaining components and their integral attachments of metal containments and metallic liners of concrete containments in accordance with the ASME Code. If a material prevents moisture from contacting inaccessible areas of the containment shell or liner, especially if the material is being relied upon in lieu of augmented examinations of a susceptible location, the material must be inspected as a moisture barrier. The applicable ASME Code sections require licensees to inspect 100 percent of accessible moisture barriers during each inspection period.

The U.S. Nuclear Regulatory Commission (NRC) has issued a regulatory issues summary (RIS) NRC-2016-06, ``NRC Regulation of Radium-226 Under Military Control and for Coordination on Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) Response Actions at the U.S. Department of Defense (DoD) Sites with Radioactive Materials,'' and a Memorandum of Understanding (MOU) between the NRC and the DoD for coordination on CERCLA response actions at DoD sites with unlicensed radioactive materials.
Generic Determinations Regarding the Environmental Impacts of Spent Fuel Storage and Disposal When Considering Nuclear Power Reactor License Applications
The U.S. Nuclear Regulatory Commission (NRC) is denying two petitions for rulemaking (PRMs), PRM-51-30 and PRM-51-31, submitted by Diane Curran on behalf of 34 environmental organizations (the petitioners). The petitioners request that the NRC revise certain regulations that concern the environmental impacts of spent fuel storage and disposal for nuclear power plant license applications. The NRC is denying the petitions because they provide an insufficient basis to consider a rulemaking to revise such regulations.
Dominion Virginia Power; North Anna, Unit 3
The U.S. Nuclear Regulatory Commission (NRC) is giving notice once each week for four consecutive weeks of the North Anna Unit 3 combined license (COL) application from Dominion Virginia Power (Dominion).
Vogtle Electric Generating Station, Units 3 and 4; Southern Nuclear Operating Company, Main Control Room Emergency Habitability System (VES) Design Changes
The U.S. Nuclear Regulatory Commission (NRC) is granting an exemption to allow a departure from the certification information of Tier 1 of the generic design control document (DCD) and is issuing License Amendment No. 48 to Combined Licenses (COLs), NPF-91 and NPF- 92. The COLs were issued to Southern Nuclear Operating Company, Inc. (SNC); Georgia Power Company; Oglethorpe Power Corporation; MEAG Power SPVM, LLC; MEAG Power SPVJ, LLC; MEAG Power SPVP, LLC; Authority of Georgia; and the City of Dalton, Georgia (together ``the licensee'') for construction and operation of the Vogtle Electric Generating Plant (VEGP) Units 3 and 4, located in Burke County, Georgia. The granting of the exemption allows the changes to Tier 1 information asked for in the amendment. Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.
Disposition of Information Related to the Time Period That Safety-Related Structures, Systems, or Components Are Installed
The U.S. Nuclear Regulatory Commission (NRC) is seeking public comment on a draft regulatory issue summary (RIS) to inform nuclear power reactor licensees of existing requirements related to dispositioning information pertaining to the capability of safety- related structures, systems, and components (SSCs) to perform their safety-related functions in nuclear power plants. The draft RIS addresses instances where a licensee becomes aware of credible information pertaining to the time period that a safety-related structure, system, or component is installed that may negatively impact its ability to perform its safety-related function or functions. Licensees must address this information consistent with their licensing basis and applicable NRC requirements.
PSEG Power, LLC and PSEG Nuclear LLC; PSEG Site
The U.S. Nuclear Regulatory Commission (NRC) has issued early site permit (ESP) number ESP-005 to PSEG Power, LLC and PSEG Nuclear, LLC (PSEG). In addition, the NRC has prepared a summary Record of Decision (ROD) that supports the NRC's decision to issue ESP No. ESP- 005.
Fuel-Cladding Issues in Postulated Spent Fuel Pool Accidents
The U.S. Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking (PRM or the petition), PRM-50-108, submitted by Mr. Mark Edward Leyse (the petitioner). The petitioner requested that the NRC require power reactor licensees to perform evaluations to determine the potential consequences of various postulated spent fuel pool (SFP) accident scenarios. The evaluations would be required to be submitted to the NRC for informational purposes. The NRC is denying the petition because the NRC does not believe the information is needed for effective NRC regulatory decisionmaking with respect to SFPs or for public safety, environmental protection, or common defense and security.
Geologic Repository for the Disposal of Spent Nuclear Fuel and High-Level Radioactive Waste; Department of Energy; Yucca Mountain, Nye County, Nevada
The U.S. Nuclear Regulatory Commission (NRC) has issued the final ``Supplement to the U.S. Department of Energy's Environmental Impact Statement for a Geologic Repository for the Disposal of Spent Nuclear Fuel and High-Level Radioactive Waste at Yucca Mountain, Nye County, Nevada,'' NUREG-2184. This supplements the U.S. Department of Energy's (DOE) 2002 Environmental Impact Statement (EIS) and its 2008 Supplemental EIS for the proposed repository at Yucca Mountain in accordance with the findings and scope outlined in the NRC staff's 2008 Adoption Determination Report (ADR) for DOE's EISs. The scope of this supplement is limited to the potential environmental impacts from the proposed repository on groundwater and from surface discharges of groundwater.

Embedded Digital Devices In Safety-Related Systems
The U.S. Nuclear Regulatory Commission (NRC) is issuing Regulatory Issue Summary (RIS) 2016-05, ``Embedded Digital Devices In Safety-Related Systems.'' This RIS clarifies the NRC staff's position on existing regulatory requirements for the quality and reliability of safety-related equipment with embedded digital devices. Furthermore, the purpose of this RIS is to raise awareness that there may be potential safety issues from a postulated common cause failure (CCF) if an undetected software error should occur in embedded digital devices located in multiple trains of redundant safety equipment in nuclear facilities.
STP Nuclear Operating Company, South Texas Project, Units 1 and 2
The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a draft environmental assessment (EA) prepared under the National Environmental Policy Act of 1969 (NEPA) and NRC regulations. This EA summarizes the results of the NRC staff's environmental review, which evaluates the potential environmental impacts of issuing license amendments and granting regulatory exemptions in response to a request from STP Nuclear Operating Company (STPNOC, the licensee) for Facility Operating License Nos. NPF-76 and NPF-80, for South Texas Project (STP), Units 1 and 2, respectively. The license amendments and regulatory exemptions would allow STPNOC to make changes to the STP licensing basis to incorporate the use of both a deterministic and a risk-informed approach to address safety issues discussed in Generic Safety Issue (GSI)-191 and to close Generic Letter (GL) 2004-02.
