Mr. Eric Epstein, Chairman, Three Mile Island Alert, Inc.; Denial of Petition for Rulemaking
The U.S. Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking (PRM) submitted by Mr. Eric Epstein, Chairman of Three Mile Island Alert, Inc. (TMIA). The petitioner requested that the NRC amend its emergency preparedness regulations to require that all host school pick-up centers be located at least 5 to 10 miles beyond the radiation plume exposure boundary zone to ensure that all school children are protected in the event of a radiological emergency.
Safety Culture Policy Statement Development: Public Meeting and Request for Public Comments; Correction
This document corrects a notice appearing in the Federal Register on January 23, 2009 (74 FR 4260), that informs the public of the public meeting and Request for Comments on topics relating to the development of the policy statement. In addition to announcing the public meeting, the NRC is using this notice to request comments on the topics discussed in this notice. These topics can be found in section D (Topics for Discussion of the Supplementary Information).
Nuclear Ship Savannah; Notice of Receipt and Availability for Comment of Post Shutdown Decommissioning Activities Report
On December 11, 2008, the U.S. Department of Transportation Maritime Administration (MARAD) submitted its PSDAR for the NS Savannah. The PSDAR provides an overview of MARAD's proposed decommissioning activities, schedule, and costs for the NS Savannah. The NS Savannah was brought to power in 1961 and removed from service in 1970. Final reactor shutdown occurred in November 1970 and defueling was completed in fall 1971. The NS Savannah is currently located at the Canton Marine Terminal in Baltimore, Maryland. The PSDAR, dated December 11, 2008, was placed in NRC's Agency-wide Document Access and Management System (ADAMS) with Accession No. ML083500100.
Westinghouse Electric Company LLC; Consideration of Petition in Rulemaking Process
The Nuclear Regulatory Commission (NRC) will consider the issues raised in a petition for rulemaking (PRM) submitted by Westinghouse Electric Company LLC (petitioner) in the NRC's rulemaking process. The petition was dated November 4, 1999, and was docketed as PRM-50-69. The petitioner requested that Table 1 in 10 CFR Part 50, Appendix G, be amended by removing requirements related to the metal temperature of the closure head flange and vessel flange regions. Specifically, the petitioner requested that footnotes (2) and (6) be removed from Table 1.
Raymond A. Crandall; Denial of Petition for Rulemaking
The Nuclear Regulatory Commission (NRC) is denying the petition for rulemaking (PRM) filed by Mr. Raymond A. Crandall on May 17, 2007, and docketed on June 22, 2007 (Docket No. PRM-50-87). In his petition, the petitioner requested that the NRC amend the regulations that govern domestic licensing of production and utilization facilities to eliminate the specific criteria related to the radiological doses for control room habitability at nuclear power plants. The petitioner stated that the current deterministic radiological dose requirements for control room habitability have resulted in several negative safety consequences, including an increased risk to public safety. He requested that the NRC delete the 5 rem whole body dose limit and the 0.05 sievert (Sv) (5 rem) total effective dose equivalent (TEDE) limit specified in the current regulations.

Multi-Agency Radiation Survey and Assessment of Materials and Equipment Manual
The Department of Defense (DoD), Department of Energy (DOE), U.S. Environmental Protection Agency (EPA), and the U.S. Nuclear Regulatory Commission (NRC) are announcing the availability of the final ``Multi-Agency Radiation Survey and Assessment of Materials and Equipment manual'' (MARSAME). MARSAME provides information on planning, conducting, evaluating, and documenting radiological surveys for demonstrating compliance with measurable action levels. The MARSAME manual is a multi-agency consensus document. The agencies previously have sought public comment in order to receive feedback from the widest range of interested parties and to ensure that all information relevant to developing the document was received. The agencies reviewed public comments received on the draft MARSAME as well as comments from a concurrent, independent, technical peer review. Suggested changes were incorporated, where appropriate, in response to those comments.
Regulatory Improvements to the Nuclear Materials Management and Safeguards System; Correction
The Nuclear Regulatory Commission (NRC) is correcting a final rule that appeared in the Federal Register on June 9, 2008 (73 FR 32453). The final rule amended NRC's regulations related to licensee reporting requirements for source material and special nuclear material to the Nuclear Materials Management and Safeguards System. This document is necessary to correct an erroneous amendatory instruction.
List of Approved Spent Fuel Storage Casks: NAC-UMS Revision 5, Confirmation of Effective Date
The Nuclear Regulatory Commission (NRC) is confirming the effective date of January 12, 2009 for the direct final rule that was published in the Federal Register on October 27, 2008 (73 FR 63621). This direct final rule amended the NRC's regulations to revise the NAC- UMS cask system listing to include Amendment No. 5 to Certificate of Compliance (CoC) No. 1015.
Notice of Availability of Model Application Concerning Technical Specification Improvement To Revise Containment Isolation Valve Completion Times (TSTF-498, Revision 1, for Babcock & Wilcox Plants)
Notice is hereby given that the staff of the Nuclear Regulatory Commission (NRC) has prepared a model safety evaluation (SE) relating to the modification of technical specification (TS) 3.6.3, Containment Isolation Valves associated with implementation of BAW- 2461-A, ``Risk-Informed Justification for Containment Isolation Valve Allowed Outage Time Change.'' The NRC staff has also prepared a model license amendment request and a model no-significant-hazards consideration (NSHC) determination relating to this matter. The purpose of these models is to permit the NRC to efficiently process amendments that propose to modify TS Completion Times (CTs) for CIVs. Licensees of nuclear power reactors to which the models apply can then request amendments after confirming the applicability of the SE and NSHC determination to their reactors. Licensees of nuclear power reactors to which the model applies may request amendments using the model application.

Privacy Act of 1974; Republication of Systems of Records Notices
The Nuclear Regulatory Commission (NRC) has conducted a comprehensive review of all its Privacy Act systems of records. The NRC is revising and republishing all its systems of records notices as a result of this review. The revisions are minor corrective and administrative changes that do not meet the threshold criteria established by the Office of Management and Budget (OMB) for either a new or altered system of records.

Agency Information Collection Activities: Proposed Collection; Comment Request
The NRC invites public comment about our intention to request the OMB's approval for renewal of an existing information collection that is summarized below. We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). The NRC hereby informs potential respondents that an agency may not conduct or sponsor and that a person is not required to respond to a collection of information unless it displays a currently valid OMB control number. Information pertaining to the requirement to be submitted: 1. The title of the information collection: ``Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions.'' 2. Current OMB approval number: 3150-0021. 3. How often the collection is required: Upon submittal of an application for a construction permit, operating license, operating license renewal, early site review, design certification review, decommissioning or termination review, or manufacturing license, or upon submittal of a petition for rulemaking. 4. Who is required or asked to report: Licensees and applicant requesting approvals for actions proposed in accordance with the provisions of 10 CFR Parts 30, 32, 33, 34, 35, 36, 39, 40, 50, 52, 54, 61, 61, 70, and 72. 5. The number of annual respondents: 23 6. The number of hours needed annually to complete the requirement or request: 92,281. 7. Abstract: 10 CFR Part 51 specifies information to be provided by applicants and licensees so that the NRC can make determinations necessary to adhere to the policies, regulations, and public laws of the United States, which are to be interpreted and administered in accordance with the policies set forth in the National Environmental Policy Act of 1969, as amended.
