Record of Decision for the Department of Homeland Security Headquarters Consolidation at St. Elizabeths Master Plan Amendment in Southeast, Washington, DC
Pursuant to the requirements of the National Environmental Policy Act of 1969 (NEPA), 42 U.S.C. 4321-4347, the Council on Environmental Quality Regulations (40 CFR parts 1500-1508), and the GSA Public Buildings Service NEPA Desk Guide, dated October 1999, on May 17, 2012, GSA issued a Record of Decision (ROD) to the DHS Headquarters Consolidation at St. Elizabeths Master Plan Amendment Final Environmental Impact Statement (EIS), to implement alternatives for a new 750,000 gross square foot Federal Emergency Management Agency (FEMA) facility plus parking on the St. Elizabeths East Campus; improvements to the Martin Luther King, Jr. Avenue (MLK Avenue) in front of and south of the campus to Alabama Avenue; and improvements to the interchange of Malcolm X Avenue and I-295. Under the provisions of the Paperwork Reduction Act, the Regulatory Secretariat will be submitting to the Office of Management and Budget (OMB) a request to review and approve an extension of a previously approved information collection requirement regarding preparation, submission, and negotiation of subcontracting plans. A notice was published in the Federal Register 77 FR 9658, on February 17, 2012. No comments were received. This information collection will ensure that small and small disadvantaged business concerns are afforded the maximum practicable opportunity to participate as subcontractors in construction, repair, and alteration or lease contracts. Preparation, submission, and negotiation of subcontracting plans requires for all negotiated solicitations having an anticipated award value over $650,000 ($1,500,000 for construction), submission of a subcontracting plan with other than small business concerns when a negotiated acquisition meets all four of the following conditions. 1. When the contracting officer anticipates receiving individual subcontracting plans (not commercial plans). 2. When the award is based on trade-offs among cost or price and technical and/or management factors under FAR 15.101-1. 3. The acquisition is not a commercial item acquisition. 4. The acquisition offers more than minimal subcontracting opportunities. Federal Acquisition Regulation; Updated Postretirement Benefit (PRB) References
DoD, GSA, and NASA are proposing to amend the Federal Acquisition Regulation (FAR) to remove references to specific paragraphs in an accounting standard that were deleted in the Financial Accounting Standards Board's (FASB's) Accounting Standards Codification (ASC) of Generally Accepted Accounting Principles (GAAP). The immediate and delayed recognition procedures for the initial application transition obligation in paragraphs 111, 112, and 113, respectively, of superseded Financial Accounting Standard (FAS) 106, are obsolete and no longer exist in the authoritative GAAP (the ASC). DoD, GSA, and NASA, therefore, propose replacing the current references with replacement criteria for determining the allowability of the transition obligation, when converting from pay-as-you-go accounting for postretirement benefits (PRBs) to an accrual method of accounting for the purposes of government contract cost accounting.

Federal Acquisition Regulation; Prohibition on Contracting With Inverted Domestic Corporations
DoD, GSA, and NASA are issuing an interim rule amending the Federal Acquisition Regulation (FAR) to implement a section of the Consolidated Appropriations Act, 2012, that prohibits the award of contracts using appropriated funds to any foreign incorporated entity that is treated as an inverted domestic corporation or to any subsidiary of such entity.
