The Federal Retirement Thrift Investment Board (Agency) is making several changes to its death benefits regulations. In particular, it is expanding the requirements necessary in order for a designation of beneficiary form to be valid. This change will also allow participants holding both a uniformed services and civilian account to submit a single designation of beneficiary form which can be used to designate beneficiaries for both accounts. The Agency is also amending its death benefit regulations to allow participants to designate a custodian under the Uniform Transfers to Minors Act as a beneficiary, permit the Agency to defer to state law when a potential beneficiary is implicated in the death of a participant and is subsequently found not guilty by reason of insanity, and require a notary to witness disclaimers of death benefits.

The Federal Retirement Thrift Investment Board (FRTIB) is amending its regulation pertaining to the timing of agency contributions to reflect changes the FRTIB anticipates will be made by the Thrift Savings Plan Enhancement Act of 2009 (Act). The Act provides that Agency Automatic (1%) Contributions and Agency Matching Contributions shall commence immediately. The regulatory amendment is necessary because FRTIB regulations follow current law, which provides that Agency Automatic (1%) Contributions and Agency Matching Contributions shall not commence until the equivalent of the second open season that begins after the employee commenced employment. The FRTIB is setting a August 1, 2009 effective date for this regulation to allow employing agencies sufficient time to make the necessary computer programming changes to implement it.

The Federal Retirement Thrift Investment Board (Agency) proposes to alter a system of records notice in its existing inventory of records subject to the Privacy Act of 1974, (5 U.S.C. 552a), as amended. The proposed changes to FRTIB-1, Thrift Savings Plan Records, are necessary as the system location, system manager, and record access procedures have changed. These changes are also necessary in order to make clear the distinction between information available to beneficiaries and information available to someone handling a participant's estate. Finally, these changes are necessary to allow the Agency to share participant information with agency personnel and casualty assistance officers who are aiding beneficiaries, with consumer reporting agencies when necessary for the Agency to collect a debt owed to it under 5 U.S.C. 3711, and with quality control companies that are verifying documents submitted to lenders in connection with participants' commercial loan applications.
