Amendment to Regulations Governing the Filing of Proof of Financial Responsibility
The Federal Maritime Commission (``FMC'' or ``Commission'') amends its regulations governing proof of financial responsibility for ocean transportation intermediaries (``OTIs'') required to be filed prior to commencement of OTI services. The amendment reduces the amount of time an applicant has to file the requisite proof of financial responsibility from two years to 120 days, after approval of the applicant's license application. Upon expiration of the 120-day time period, if valid proof of financial responsibility has not been provided by the applicant, its OTI application will be considered invalid. Applications approved prior to the effective date of this Final Rule will continue to be subject to the two-year time period to submit valid proof of financial responsibility.
Agency Information Collection Activities: Submission for OMB Review; Comment Request
In accordance with the Paperwork Reduction Act of 1995, the Federal Maritime Commission (FMC or Commission) hereby gives notice that it has submitted to the Office of Management and Budget a request for a revision of an approved information collection regarding the licensing of ocean transportation intermediaries, as listed below.
Optional Method of Filing Form FMC-18, Application for a License as an Ocean Transportation Intermediary
The Federal Maritime Commission (``FMC'' or ``Commission'') amends its regulations relating to the method of filing Form FMC-18, Application for a License as an Ocean Transportation Intermediary (``OTI''), to provide for optional filing of OTI applications through a new electronic filing system. This optional filing system is intended to facilitate more efficient processing and review of applications for licensing. A filing fee of $250 will apply to new applicants for OTI licensing, and $125 for existing licensees who might want to use the optional electronic filing system to update their licensing records or to submit changes in the licensee's organization for which prior Commission approval is required.
Filing of Proof of Financial Responsibility
The Federal Maritime Commission proposes to amend its regulations governing the filing of proof of financial responsibility for ocean transportation intermediaries by reducing the amount of time an applicant may have to file the requisite proof of financial responsibility upon approval of applicant's license application from two (2) years to 120 days.
