Definition of Unreasonable Refusal To Deal or Negotiate With Respect to Vessel Space Accommodations Provided by an Ocean Common Carrier
The Federal Maritime Commission (FMC or Commission) is issuing regulations to implement the Ocean Shipping Reform Act of 2022's prohibition against unreasonable refusals of cargo space accommodations when available and unreasonable refusals to deal or negotiate with respect to vessel space accommodations by ocean common carriers. This final rule adopts with changes the supplemental notice of proposed rulemaking published on June 14, 2023. This rule establishes the necessary elements for the FMC to apply Federal law with respect to refusals of cargo space accommodations when available. It also establishes the necessary elements for the FMC to apply Federal law with respect to refusals of vessel space accommodations. This rule applies to complaints brought before the FMC by a private party, as well as enforcement cases brought by the Commission.

The Federal Maritime Commission is publishing an updated list of controlled carriers, i.e., ocean common carriers operating in U.S.- foreign trades that are, or whose operating assets are, directly or indirectly owned or controlled by foreign governments. Demurrage and Detention Billing Requirements
The Federal Maritime Commission (FMC) received approval from the Office of Management and Budget (OMB) for an information collection request associated with the final rule for Demurrage and Detention Billing Requirements. This rule announces the effective date for the requirements concerning contents of demurrage and detention invoices. In the final rule published February 26, 2024, we stated we would publish a document in the Federal Register (FR) announcing the effective date of the collection-of-information related sections upon OMB approval. This rule establishes May 28, 2024, as the effective date of the relevant provisions.

This document corrects the preamble to a final rule published in the Federal Register on February 26, 2024, concerning demurrage and detention billing requirements. This correction provides information regarding situations in which vessel-operating common carriers (VOCCs) enter into written contracts with motor carriers that use containers in the transportation of goods.

Request for Information
The Federal Maritime Commission (the Commission) seeks public comment on questions related to maritime data accuracy to continue the process of gathering information to inform possible future Commission activities with a focus on information related to containers moving through marine terminals. In particular, the Commission seeks responses on what data elements are communicated between transportation service providers and importers/exporters. The Commission also seeks information on how changes to information are conveyed and where communication is most likely to break down or information is most likely to be conveyed inaccurately.
