Request for Public Comment on a Commercial Availability Request Under the United States-Mexico-Canada Agreement
On February 20, 2024, the Government of the United States ("United States") received a request from the Government of Canada ("Canada") to initiate consultations under Article 6.4.1 of the United States-Mexico-Canada Agreement ("USMCA"). Canada is requesting that the United States and Mexico (with Canada, collectively "the Parties") consider changing the rules of origin for certain end-use fabrics used in the production of fire hose based on the lack of commercial availability for certain high-tenacity polyester yarns in the territories of the Parties. The yarns are described as high- tenacity polyester yarn, single or multiple, multifilament, untwisted, untextured, and measuring more than 920 decitex, used in the production of fire hose, with or without lining, armor or accessories of other materials. The President of the United States may proclaim a modification to the USMCA rules of origin for textile and apparel products if the United States reaches an agreement with Canada and Mexico on a modification under Article 6.4.3 of the USMCA to address issues of availability of supply of fibers, yarns, or fabrics in the territories of the Parties. The President authorized, in Presidential Proclamation 10053 (July 1, 2020), the Committee for the Implementation of Textile Agreements ("CITA") to review requests for modifications to a rule of origin for textile and apparel goods based on a change in the availability of the textile or apparel good in the territory of the Parties, and to make a recommendation as to whether a requested modification is warranted. CITA hereby solicits public comments on this request to modify the USMCA rules of origin, particularly regarding whether certain high-tenacity polyester yarns used in the production of fire hose can be supplied by the U.S. domestic industry in commercial quantities in a timely manner.

Request for Public Comment on a Commercial Availability Request Under the U.S.-Chile Free Trade Agreement
In June 2015, the Government of the United States received a request from the Government of Chile to modify the U.S.-Chile Free Trade Agreement (FTA) rules of origin for woven fabrics of artificial filament yarn in subheadings 5408.22-5408.23 of the Harmonized Tariff Schedule of the United States (HTSUS) to allow the use of non-U.S. or Chilean filament yarn of viscose rayon classified in subheadings 5403.10, 5403.31, 5403.32, and 5403.41 of the HTSUS. In July 2015, CITA solicited public comments on this request, in particular with regard to whether filament yarn of viscose rayon classified in subheadings 5403.10, 5403.31, 5403.32, and 5403.41 can be supplied by the domestic industry in commercial quantities in a timely manner. No information was received at that time indicating that domestic industry could supply the subject yarns. Subsequently, the United States and Chile have continued to consult regarding the subject rule change. In November 2022, the Government of Chile reiterated its interest in advancing the subject rule change. Given the period of time that has elapsed since CITA initially solicited public comments on this request, CITA is again soliciting public comments to determine if the subject yarns can be supplied by the domestic industry in commercial quantities in a timely manner. The President may proclaim a modification to the U.S.-Chile FTA rules of origin only after reaching an agreement with Chile on the modification and after other domestic processes are completed to implement the modification.

CITA hereby solicits public comments on this request, in particular with regard to whether certain textured and non-textured triacetate filament yarns can be supplied by the U.S. domestic industry in commercial quantities in a timely manner.

The Government of Morocco is requesting that the United States and Morocco (``the Parties'') consider revising the rules of origin for women's or girls' swimwear to address availability of supply of certain knit fabric in the territories of the Parties. SCC is requesting that the United States and Morocco consider revising the rules of origin for certain women's and girls' swimwear to address availability of supply of certain printed and piece-dyed warp knit fabrics of polyester or nylon fibers in the territories of the Parties. The President may proclaim a modification to the USMFTA rules of origin for textile and apparel products after reaching an agreement with the Government of Morocco on the modification. CITA hereby solicits public comments on this request, in particular with regard to whether certain printed and piece-dyed warp knit fabrics of polyester or nylon fibers classified under Harmonized Tariff Schedule of the United States (HTSUS) subheading 6004.10 containing between 3 percent and 41 percent elastomeric yarns, in which the elastomeric yarns were engineered for chlorine resistance, can be supplied by the U.S. domestic industry in commercial quantities in a timely manner. Determination Under the African Growth and Opportunity Act
The Committee for the Implementation of Textile Agreements (CITA) has determined that certain textile and apparel goods from Benin shall be treated as ``folklore articles'' and ``ethnic printed fabrics'' and qualify for preferential treatment under the African Growth and Opportunity Act (``AGOA''). Imports of eligible products from Benin with an appropriate visa will qualify for duty-free treatment.
Interim Procedures for Considering Requests From the Public for Textile and Apparel Safeguard Actions on Imports From Panama
This notice sets forth the interim procedures the Committee for the Implementation of Textile Agreements (``CITA'') will follow in implementing certain provisions of the United States-Panama Trade Promotion Agreement (``US-Panama TPA''). Title III, Subtitle B, Section 321 through Section 328 of the United States-Panama Trade Promotion Agreement Implementation Act (``Implementation Act'') [Pub. L. 112-43] authorizes the President to consider requests from the public for textile and apparel safeguard actions. The President has delegated to CITA the authority to determine whether imports of a Panamanian textile or apparel article are causing serious damage, or actual threat thereof, to a domestic industry producing an article that is like, or directly competitive with, the imported article. CITA hereby gives notice to interested entities of the procedures CITA will follow in considering such requests and solicits public written comments on these interim procedures.

Section 203(o)(4) of the United States-Panama Trade Promotion Agreement Implementation Act (``Implementation Act'') [Public Law 112-43] authorizes the President to establish procedures to modify the list of fabrics, yarns, or fibers not available in commercial quantities in a timely manner in either the United States or Panama as set out in Annex 3.25 of the US-Panama TPA. The President has delegated to CITA the authority to determine whether fabrics, yarns, or fibers are not available in commercial quantities in a timely manner in either the United States or Panama and has directed CITA to establish procedures that govern the submission of a request and provide the opportunity for interested entities to submit comments and supporting evidence for any such determination pursuant to the Implementation Act. CITA hereby gives notice to interested entities of the procedures CITA will follow in considering such requests and solicits public written comments on these interim procedures. CITA will be using the procedures detailed in this notice as of May 14, 2013. DATE: Comments on the interim procedures must be received no later than June 13, 2013 of this notice, either in hard copy or electronically.
Determination Under the Textile and Apparel Commercial Availability Provision of the United States-Colombia Trade Promotion Agreement (“US-Colombia TPA”)
The Committee for the Implementation of Textile Agreements (``CITA'') has determined that certain cotton corduroy fabric, as specified below, is not available in commercial quantities in a timely manner in the territory of either the United Sates or Colombia. The product will be added to the list in Annex 3-B of the US-Colombia TPA in unrestricted quantities.
