The petition has been submitted in accordance with our regulations concerning the introduction of certain genetically engineered organisms and products. NMFS has received requests from Rio Grande LNG, LLC (Rio Grande) and, separately, Annova LNG Common Infrastructure (Annova) for authorization to take marine mammals incidental to pile driving and removal associated with the construction of two separate LNG terminals in the Brownsville Ship Channel (BSC), Cameron County, Texas. Pursuant to the Marine Mammal Protection Act (MMPA), NMFS is requesting comments on its proposal to issue two separate incidental harassment authorizations (IHAs; one to Rio Grande and one to Annova) to incidentally take marine mammals during the specified activities. NMFS is also requesting comments on possible one-year renewals that could be issued under certain circumstances and if all requirements are met, as described in Request for Public Comments at the end of this notice. NMFS will consider public comments prior to making any final decision on the issuance of the requested MMPA authorizations and agency responses will be summarized in the final notice of our decisions.
