Airworthiness Directives; The Boeing Company Airplanes
Document Number: 2015-08072
Type: Proposed Rule
Date: 2015-04-10
Agency: Federal Aviation Administration, Department of Transportation
We propose to adopt a new airworthiness directive (AD) for all The Boeing Company Model 767-200, -300, and -300F series airplanes. This proposed AD was prompted by a finding that certain barrel nuts installed at the vertical fin may be subject to stress corrosion and cracking. This proposed AD would require either repetitive inspections of vertical fin barrel nuts for corrosion or a magnetic check to identify certain barrel nuts, and corrective actions if necessary. We are proposing this AD to detect and correct corroded and loose barrel nuts that attach the vertical fin to body section 48, which could result in reduced structural integrity of the vertical fin attachment joint, loss of the vertical fin, and consequent loss of controllability of the airplane.

Pursuant to the U.S. Environmental Protection Agency's (EPA) Significant New Alternatives Policy program, this action lists five flammable refrigerants as acceptable substitutes, subject to use conditions, in several end-uses: Household refrigerators and freezers, stand-alone retail food refrigeration equipment, very low temperature refrigeration, non-mechanical heat transfer, vending machines, and room air conditioning units. This action also exempts from Clean Air Act Section 608's prohibition on venting, release, or disposal the four hydrocarbon refrigerant substitutes listed in this action as acceptable, subject to use conditions, in specific end-uses. We are finalizing this exemption for those substitutes, subject to those use conditions and in those end-uses, on the basis of current evidence that their venting, release, or disposal does not pose a threat to the environment.
Airworthiness Directives; GE Aviation Czech s.r.o. Turboprop Engines
Document Number: 2015-07865
Type: Proposed Rule
Date: 2015-04-10
Agency: Federal Aviation Administration, Department of Transportation
We propose to adopt a new airworthiness directive (AD) for certain serial number GE Aviation Czech s.r.o. M601E-11, M601E-11A, and M601F turboprop engines. This proposed AD was prompted by the determination that wear or cracking, and subsequent misalignment of the quill shaft of the engine and the power turbine (PT) shaft, may lead to rupture of the quill shaft, overspeed of the PT, and uncontained engine failure. This proposed AD would require inspection of the reduction gearbox and supporting cone. We are proposing this AD to prevent misalignment and rupture of the quill shaft, which could lead to overspeed of the PT, uncontained engine failure, and damage to the airplane.

Document Number: 2015-07837
Type: Proposed Rule
Date: 2015-04-10
Agency: Fish and Wildlife Service, Department of the Interior
We, the U.S. Fish and Wildlife Service (Service), announce 90- day findings on various petitions to list eight species, reclassify one species, and delist one species under the Endangered Species Act of 1973, as amended (Act). Based on our review, we find that these 10 petitions present substantial scientific or commercial information indicating that the petitioned actions may be warranted. Therefore, with the publication of this document, we are initiating a review of the status of each of these species to determine if the petitioned actions are warranted. The status reviews for two species, the golden conure (which appears in the List of Endangered and Threatened Wildlife as the golden parakeet) and the northern spotted owl, will also serve as 5-year reviews for those species. To ensure that these status reviews are comprehensive, we are requesting scientific and commercial data and other information regarding these species. Based on the status reviews, we will issue 12-month findings on the petitions, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.

Moreover, a number of provisions in FSMA apply only to facilities required to register, including hazard analysis and risk-based preventive controls and mandatory recall authority. The proposed amendments will further enhance FDA's capabilities with respect to responding to food safety issues, and in addition, provide FDA with information that we can use to focus and better utilize our limited inspection resources.
Changes to Existing Conservation Program Regulations
Document Number: 2015-08008
Type: Rule
Date: 2015-04-09
Agency: Department of Agriculture, Commodity Credit Corporation, Natural Resources Conservation Service
The Agricultural Act of 2014 (the 2014 Act) made several nondiscretionary changes to NRCS conservation programs. These conservation programs have existing regulations that required adjustments. These adjustments include addressing the required review of operating procedures of the State Technical Committee, adding reference of the Regional Conservation Partnership Program (RCPP) to the Watershed Protection and Flood Prevention Act program regulations, adding reference of RCPP to the Healthy Forests Reserve Program (HFRP), expanding the definition of ``acreage owned by Indian Tribes'' under HFRP, revising and simplifying the Regional Equity provision, and adjusting the Agricultural Management Assistance (AMA) Program to correspond with changes to payment provisions under the Environmental Quality Incentives Program (EQIP). Additionally, the Secretary of Agriculture delegated to NRCS administrative responsibility for implementing the Voluntary Public Access and Habitat Incentive Program (VPA-HIP), and internal NRCS administrative changes warrant updating the appropriate delegated official in the Technical Service Provider (TSP) provision. NRCS published an interim rule with a request for comments on August 1, 2014, to implement changes to these NRCS conservation program regulations that were either necessitated by enactment of the 2014 Act, or required to implement administrative streamlining improvements and clarifications. NRCS received six comments on the interim rule. In this document, NRCS issues a final rule to make permanent these changes and to incorporate two minor mandatory changes in two of the affected parts.

Energy Conservation Program for Consumer Products: Definitions for Residential Water Heaters
Document Number: 2015-07956
Type: Proposed Rule
Date: 2015-04-08
Agency: Department of Energy
The Energy Policy and Conservation Act of 1975 (EPCA), as amended, prescribes energy conservation standards for various consumer products and certain commercial and industrial equipment, including residential water heaters. EPCA also requires the U.S. Department of Energy (DOE) to determine whether more stringent amended standards would be technologically feasible and economically justified, and would save a significant amount of energy. Accordingly, DOE established amended energy conservation standards for several classes of residential water heaters in an April 2010 final rule. In this notice, DOE proposes to amend its definitions pertaining to residential water heaters and to clarify the applicability of energy conservation standards for residential water heaters that are utilized as a secondary back-up heat source in solar-thermal water heating systems. Specifically, DOE is proposing to create a definition for ``solar- assisted fossil fuel storage water heater'' and ``solar-assisted electric storage water heater'' and clarify that water heaters meeting these definitions are not subject to the amended energy conservation standards for residential water heaters established by the April 2010 final rule.

Promulgation of Air Quality Implementation Plans; State of Arkansas; Regional Haze and Interstate Visibility Transport Federal Implementation Plan
Document Number: 2015-06726
Type: Proposed Rule
Date: 2015-04-08
Agency: Environmental Protection Agency
The Environmental Protection Agency (EPA) is proposing to promulgate a Federal Implementation Plan (FIP) to address certain regional haze and visibility transport requirements for the State of Arkansas. This FIP would address the requirements of the Regional Haze Rule (RHR) and interstate visibility transport for those portions of Arkansas' State Implementation Plan (SIP) we disapproved in our final action published on March 12, 2012. Specifically, the proposed FIP addresses the requirements for Best Available Retrofit Technology (BART) for those sources for which we did not approve Arkansas' BART determinations, Reasonable Progress Goals (RPGs), reasonable progress controls and a long-term strategy, as well as the interstate visibility transport requirements for pollutants that affect visibility in Class I areas in nearby states. Specific to the reasonable progress controls requirement, we are proposing in the alternative two options for controlling the emissions from the Entergy Independence Plant that is not subject to BART. Under Option 1, we are proposing controls for emissions of SO2, and NOX. If we take final action on this finding, the source will be subject to controls for both pollutants. Alternatively, under Option 2, we are proposing controls for only emissions of SO2 for this planning period. In particular, we are soliciting comments on the alternate proposed Options 1 and 2.

The Environmental Protection Agency (EPA) is establishing air quality designations in the United States (U.S.) for the 2012 primary annual fine particle (PM2.5) National Ambient Air Quality Standards (NAAQS) for five areas in Georgia and neighboring counties in Alabama and South Carolina. The EPA is also changing the initial designation of one area in Ohio, two areas in Pennsylvania, one area shared between Indiana and Kentucky, and one area shared between Kentucky and Ohio for the 2012 PM2.5 NAAQS. These states have recently submitted complete, quality-assured, and certified air quality data for 2014, and based on that data the EPA is finalizing appropriate initial designations for these areas. Lastly, the EPA is making one minor technical amendment to correct an inadvertent error in the initial designation for a county in Pennsylvania with respect to the 2012 PM2.5 NAAQS.

Effluent Limitations Guidelines and Standards for the Oil and Gas Extraction Point Source Category
Document Number: 2015-07819
Type: Proposed Rule
Date: 2015-04-07
Agency: Environmental Protection Agency
EPA proposes a Clean Water Act (CWA) regulation that would better protect human health and the environment and protect the operational integrity of publicly owned treatment works (POTWs) by establishing pretreatment standards that would prevent the discharge of pollutants in wastewater from onshore unconventional oil and gas extraction facilities to POTWs. Unconventional oil and gas (UOG) extraction wastewater can be generated in large quantities and contains constituents that are potentially harmful to human health and the environment. Because they are not typical of POTW influent wastewater, some UOG extraction wastewater constituents can be discharged, untreated, from the POTW to the receiving stream; can disrupt the operation of the POTW (e.g., by inhibiting biological treatment); can accumulate in biosolids (sewage sludge), limiting their use; and can facilitate the formation of harmful disinfection by-products (DBPs). Based on the information collected by EPA, the requirements in this proposal reflect current industry practices for unconventional oil and gas extraction facilities, therefore, EPA does not project the proposed rule will impose any costs or lead to pollutant removals, but will ensure that such current industry best practice is maintained over time.
Endangered and Threatened Wildlife and Plants; 12-Month Finding on a Petition To List Humboldt Marten as an Endangered or Threatened Species
Document Number: 2015-07766
Type: Proposed Rule
Date: 2015-04-07
Agency: Fish and Wildlife Service, Department of the Interior
We, the U.S. Fish and Wildlife Service (Service), announce a 12-month finding on a petition to list the previously classified subspecies Humboldt marten (Martes americana humboldtensis), or the (now-recognized) subspecies of Humboldt marten (Martes caurina humboldtensis), or the Humboldt marten distinct population segment (DPS) of the Pacific marten (M. caurina) as an endangered or threatened species under the Endangered Species Act of 1973, as amended (Act). The petition and this finding also address populations of marten from coastal Oregon, which recent genetic analyses indicate are likely to be the same entity as the current classification of Humboldt marten. We recognize a coastal DPS of the Pacific marten (which includes coastal Oregon populations of marten and the current classification of Humboldt marten) and find that this DPS is not warranted for listing at this time. However, we ask the public to submit to us any new information that becomes available concerning the stressors that may be impacting the coastal DPS of Pacific marten or its habitat at any time.
Designation of Areas for Air Quality Planning Purposes; California; San Joaquin Valley; Reclassification as Serious Nonattainment for the 1997 PM2.5
Document Number: 2015-07765
Type: Rule
Date: 2015-04-07
Agency: Environmental Protection Agency
The Environmental Protection Agency (EPA) is taking final action to reclassify the San Joaquin Valley (SJV) Moderate nonattainment area, including areas of Indian country within it, as a Serious nonattainment area for the 1997 PM2.5 national ambient air quality standards (NAAQS) based on EPA's determination that the area cannot practicably attain these NAAQS by the applicable attainment date of April 5, 2015 and in response to a request from the SJV Air Pollution Control District that we reclassify the area. As a consequence of this reclassification, California must submit a Serious area plan including a demonstration that the plan provides for attainment of the 1997 annual and 24-hour PM2.5 standards in the SJV area by the applicable attainment date, which is no later than December 31, 2015, or by the most expeditious alternative date practicable, in accordance with the requirements of part D of title I of the Clean Air Act.
