The Department of Defense (DoD), Washington Headquarters Services (WHS) announces that an Environmental Assessment (EA) for the Updated Pentagon Reservation Master Plan is available for public review and comment on or before 14 April 2005. The Master Plan involves the entire Pentagon Reservation to include all the main buildings and sub- buildings within the Pentagon site in Arlington, Virginia, exclusive of the Navy Annex. A separate EA will be distributed for the Navy Annex, also known as the Naval Annex, Arlington Annex and Federal Office Building No. 2 (FOB2). The EA documents an evaluation of the environmental effects of the proposed updated Master Plan in accordance with the National Environmental Policy Act of 1969, as amended (NEPA, 42 U.S. Code 4321 to 4370b); Council of Environmental Quality (CEQ) implementing regulations (Title 40, Code of Federal Regulations, Parts 1500-1508); and DoD Instruction 4715.9, Environmental Planning and Analysis. The EA addresses the potential impacts and mitigation measures associated with the proposed action. Environmental consequences examined include potential impacts on socio-economic conditions, cultural and visual resources, transportation systems, physical and biological resources, utilities and infrastructure, and cumulative impacts. The Pentagon Reservation Master Plan constitutes a policy framework for the long-term development of the Master Plan areaan area of approximately 220 acres within the larger Pentagon Reservation. The Master Plan primarily focuses on the following improvements within the Master Plan area: Implementing new security measures; improving vehicular circulation; consolidating existing surface parking into parking structures; and increasing landscaped areas. On April 5, 2000, the Wendell H. Ford Aviation Investment and Reform Act for the 21st Century (AIR-21) required DOT to provide a technical assistance manual to air carriers and individuals with disabilities concerning their rights and responsibilities under the Air Carrier Access Act and DOT regulations. Several years after the enactment of AIR-21, DOT received funding to develop the Technical Assistance Manual (TAM). This TAM responds to a Congressional mandate and incorporates input from stakeholders. The TAM is being published in the Federal Register to insure a full opportunity for public comment before the document is published in final form.

This document proposes to amend the Department regulations relating to policy and procedures on personal commercial solicitation on DoD installations. The proposed change incorporates current policy letters that were issued since the last publication of DoD Directive 1344.7 in February 1986. These include: policy on use of on-base financial institutions and non-profit, tax exempt, private organizations to provide financial education; limits on the use of commercial sponsorship to obtain personal contact information for solicitation; and required reporting of solicitation policy violations to higher headquarters. The proposed change also includes a new solicitation evaluation form to help installations detect solicitation policy violations. This document will not have a significant impact on the public.

In response to several petitions, the Department of Transportation (the Department) is extending the comment period for 90 days until July 18, 2005, for its NPRM on aviation data modernization published in the Federal Register on February 17, 2005. The Department of Homeland Security (DHS) expects to sponsor a Federally Funded Research and Development Center (FFRDC) to address the need for scientific research to better anticipate, prevent, and mitigate the consequences of biological attacks. The proposed FFRDC will be the National Biodefense Analysis and Countermeasures Center (NBACC) which is a critical component in the overarching Homeland Security national biodefense complex. The NBACC will both coordinate biodefense research activities among various federal agencies and to execute its own research plan. Also required will be technical and program management capabilities to facilitate operation of the NBACC facility.

The Secretary of Health and Human Services is proposing rules for the imposition of civil money penalties on entities that violate rules adopted by the Secretary to implement the Administrative Simplification provisions of the Health Insurance Portability and Accountability Act of 1996, Pub. L. 104-191 (HIPAA). The proposed rule would amend the existing rules relating to the investigation of noncompliance to make them apply to all of the HIPAA Administrative Simplification rules, rather than exclusively to the privacy standards. It would also amend the existing rules relating to the process for imposition of civil money penalties. Among other matters, the proposed rules would clarify and elaborate upon the investigation process, bases for liability, determination of the penalty amount, grounds for waiver, conduct of the hearing, and the appeal process.

The Homeland Security Advisory Council (HSAC) will hold a teleconference for the purposes of receiving reports and recommendations from an HSAC working group and task force, and holding member deliberations. The HSAC will receive reports from the HSAC Working Group on Intelligence and Information Sharing, chaired by Governor Mitt Romney, Governor of Massachusetts; and the HSAC Task Force on the National Strategy for Maritime Security HSPD-13/NSPD-41, chaired by Frank J. Cilluffo, Associate Vice President for Homeland Security, George Washington University. The Romney Working Group will report on the topic of State Fusion Centers, and the Cilluffo Task Force will report on the implementation plan for the National Strategy for Maritime Security. Following each report, the HSAC will hold deliberations and discussions among HSAC members.
