In this document, the Federal Communications Commission (Commission or FCC) adopts rules to further enable Commercial Mobile Service (CMS) alerting capability for CMS providers who elect to transmit emergency alerts to their subscribers. This Commercial Mobile Alert System Third R&O (CMAS Third R&O) represents our next step in establishing a Commercial Mobile Alert System (CMAS), under which CMS providers may elect to transmit emergency alerts to the public. We take this step pursuant to the mandate of section 602(b) of the WARN Act, which requires the Commission to adopt rules allowing any CMS provider to transmit emergency alerts to its subscribers; requires CMS providers that elect, in whole or in part, not to transmit emergency alerts to provide clear and conspicuous notice at the point of sale of any CMS devices that they will not transmit such alerts via that device; and requires CMS providers that elect not to transmit emergency alerts to notify their existing subscribers of their election.

On September 8, 2008, the Office of Management and Budget (OMB) approved the information collection requirements contained in Sec. 27.1221(f) pursuant to OMB Control No. 3060-1094. The BRS/EBS Fourth Memorandum Opinion and Order, released on March 20, 2008 (FCC 08-83) and published in the Federal Register on May 8, 2008, 73 FR 26032, stated that the revision to 47 CFR 27.1221(f) will be effective upon OMB approval. This document announces the effective date of that published rule. Accordingly, the information collection requirements contained in that rule became effective on September 8, 2008.

Issuance of this proposal responds to a recent law that revised the Postal Service's business model and gave the Commission new oversight responsibilities. Comments will assist the Commission in developing final rules.

On July 28, 2008, the U.S. Nuclear Regulatory Commission (NRC) issued a notice for public comment of a Draft Generic Environmental Impact Statement (Draft GEIS) that identifies and evaluates on a programmatic basis, the potential environmental impacts from the construction, operation, aquifer restoration, and decommissioning at in-situ leach (ISL) uranium milling facilities located in particular regions of the western United States (73 FR 43795). In that notice, the NRC also provided information on eight public meetings to be hosted by the NRC that would allow the NRC staff to present an overview of the Draft GEIS and to accept oral and written public comments on the Draft GEIS from interested members of the public. In light of the continuing unusual and exigent circumstances in the financial markets, the Board has adopted, on an interim final basis, a regulatory exemption for member banks from certain provisions of section 23A of the Federal Reserve Act and the Board's Regulation W. The exemption increases the capacity of member banks, subject to certain conditions designed to help ensure the safety and soundness of the banks, to enter into securities financing transactions with affiliates.

The Commodity Futures Trading Commission (``Commission'') has amended the regulation concerning the registration of firms located outside the U.S. that are engaged in commodity interest activities with respect to trading on U.S. designated contract markets (``DCMs'') and U.S. derivatives transaction execution facilities (``DTEFs'').\1\ The amended regulation codifies past actions of the Commission's staff to permit certain foreign firms that have confirmed relief from registration as futures commission merchants (``FCMs'') in accordance with the regulations to introduce to registered FCMs certain U.S. customers in connection with trading futures and commodity options listed on, or subject to the rules of, a U.S. DCM or DTEF without having to register as an introducing broker (``IB'') pursuant to Section 4d of the Commodity Exchange Act (``Act''). The Commission also has revoked the regulation regarding quarterly reporting requirements for foreign futures and foreign options transactions.
