3 AAC 26.640 - Provision of privacy notices

(a) A licensee shall provide a notice required under 3 AAC 26.610 - 3 AAC 26.749 to a consumer in a manner that is reasonably expected to result in receipt of the notice by the consumer.
(b) For annual notices, a licensee may comply with the requirements of (a) of this section by
(c) A licensee does not meet the requirements of (a) of this section by orally explaining the notice.
(d) A licensee shall provide notices required under 3 AAC 26.610, 3 AAC 26.615, and 3 AAC 26.630 in a manner that allows the customer to retain the notice or to obtain a written notice in the future, and that may include
(e) A licensee may provide a joint privacy notice from the licensee from any of the licensee's affiliates identified in the notice, and from any other financial institutions identified in the notice, if the notice accurately reflects the privacy policies and practices of the licensee, the licensee's affiliates, and the other financial institutions.
(f) A licensee may provide a notice on behalf of another financial institution.
(g) If two or more consumers jointly obtain an insurance product or service from a licensee, the licensee may comply with the notice requirements in 3 AAC 26.610, 3 AAC 26.615, and 3 AAC 26.630 by providing a single notice to the consumers.
In 2010 the revisor of statutes, acting under AS 01.05.031, renumbered former AS 21.36.162 as AS 21.36.510. As of Register 196 (January 2011), the regulations attorney made a conforming technical revision under AS 44.62.125(b)(6), to the authority citation that follows 3 AAC 26.640, so that the citation to former AS 21.36.162 now refers to the renumbered statute, AS 21.36.510.
