It is an unfair act or practice for a person

(1) to represent the availability of land without clearly and conspicuously disclosing, with the representation, any limitation on availability, location or quantity of the land;

(2) to use the developer's personnel or others to repeatedly announce that lots are being sold when in fact this is not the case, or to make false repetitive announcement of the same lot being sold;

(3) to represent a utility service as "available" or some similar representation, unless the utility service is installed in the subdivision and ready for use, or the use is assured under financial arrangements made for installation, and these arrangements are disclosed.
