Consideration of Certain Public Utility Regulatory Policies Act Standards Set Forth in the Energy Policy Act of 2005

A brochure entitled ``Preconsideration of Sections 1251, 1252, and 1254 of the Energy Policy Act of 2005'' will be prepared and will be available for public review by September 25, 2006.

The U.S. Department of Energy (DOE), Western Area Power Administration (Western) intends to prepare an environmental impact statement (EIS) for its proposal to participate with Tri-State Generation and Transmission Association, Inc. (Tri-State), to construct the proposed Eastern Plains Transmission Project (Project). Western's participation with Tri-State would be in exchange for capacity rights on the transmission lines. These rights would provide Western with approximately 275 megawatts (MW) of capacity on the proposed transmission system. Western needs this additional transmission capacity to provide more economical, reliable, diverse, and flexible power delivery to its customers. The EIS will address the construction, operation, and maintenance of approximately 1,000 miles of high-voltage transmission lines and ancillary facilities. In addition, the EIS will address expansions of existing substations and construction of new substations, access roads, and fiber optic communication facilities. The EIS will be prepared in accordance with the National Environmental Policy Act (NEPA) and DOE NEPA Implementing Procedures. Because the Project could involve action in a floodplain, the EIS will address floodplain and wetlands impacts under DOE regulations for compliance with floodplain and wetlands environmental review.

The Western Area Power Administration (Western), a Federal power marketing agency of the Department of Energy (DOE), announces the Parker-Davis Project (P-DP) Post-2008 Resource Pool Proposed Allocation of Power (Resource Pool Proposed Power Allocation), developed under the requirements of the Energy Planning and Management Program (EPAMP). EPAMP provides for establishing project-specific resource pools and power allocations from these pools to new preference customers. Western's call for applications was published in the October 1, 2004, Federal Register. Applications received by January 30, 2005, were considered for the Resource Pool Proposed Power Allocation. Western will prepare and publish the Final Allocation of Power in the Federal Register after all public comments have been considered.

The Western Area Power Administration (Western), Department of Energy (DOE), intends to prepare a Supplemental Environmental Impact Statement (SEIS) to construct and operate a transmission line for the Sacramento Area Voltage Support (SVS) Project (Project) in California. The Sacramento Municipal Utility District (SMUD) and the City of Roseville (Roseville) will participate in a joint SEIS and Environmental Impact Report (EIR) to address the proposed construction and operation of about 38 miles of 230-kilovolt (kV), new double- circuit transmission line in the Sacramento, California, area. Western prepared a Draft Environmental Impact Statement (EIS) for the SVS in November 2002 and a final EIS in September 2003. A Record of Decision (ROD) was signed on January 12, 2004. In the ROD, Western made commitments to conduct air, biological, and cultural surveys after funding was secured. SMUD and Roseville have since committed to share in conducting more detailed Project studies and are negotiating funding a voltage support project. Additional alternatives will be analyzed in this SVS SEIS and EIR.

The Western Area Power Administration (Western) is proposing to revise the transmission revenue requirement (TRR) for existing formula rates associated with Reactive Power and Voltage Control from the Central Valley Project (CVP) and other non-Federal Generation Sources Service (VAR Support). The TRRs for transmission service from the CVP transmission system, the Pacific Alternating Current Intertie (PACI), and the California-Oregon Transmission Project (COTP) are assigned a portion of the VAR Support costs under Rate Schedules CV-T1, CV-NWT3, PACI-T1, and COTP-T1 which extend through September 30, 2009. The proposed revision to the TRRs will remove the VAR Support costs from the TRRs. This formula rate will provide sufficient revenue to repay all annual costs, including interest expense, and repay required investment within the allowable period. Western will prepare a rate brochure that provides detailed information on the impact of this rate adjustment to all interested parties. The current base charge and rates expire September 30, 2006. The proposed base charge will provide sufficient revenue to pay all annual costs and to repay investment obligations within the allowable period. The Western Area Power Administration (Western) initiated a formal rate process for the purpose of implementing a multi-system transmission rate (MSTR) by a Federal Register notice published on June 22, 2004. The process was extended by a Federal Register notice on March 3, 2005. The purpose of the extension was to allow Western time to respond to customer requests to develop a customer choice model. Western developed and presented a customer choice methodology in public information and public comment forums held March 29, 2005, and April 6, 2005, respectively. Effective November 28, 2005, Western is withdrawing the MSTR proposal for long-term firm transmission service on the Parker-Davis Project (P-DP), the Pacific Northwest-Pacific Southwest Intertie Project (Intertie), and the Central Arizona Project (CAP). Western has considered all comments in its decision to withdraw its proposal for the MSTR for long-term firm transmission service. Western is, however, studying the conversion of non-firm and short-term firm transmission service on the Parker-Davis, Intertie and Central Arizona projects to a multi-system service. Customer notification will be provided and feedback sought in a separate informal process.

This constraint is designated in the Western Electricity Coordinating Council's Path Rating Catalog and referenced in this notice as ``TOT 3.'' To examine possibilities for relieving the TOT 3 constraint, the Western Area Power Administration (Western) has entered into a Memorandum of Understanding (MOU) with the Wyoming Infrastructure Authority (WIA) and Trans-Elect, Inc. This action is to revise the existing Parker-Davis Project (P- DP) Wholesale Firm Power Service Rate Schedule PD-F6 to include language pertinent to the Lower Colorado River Basin Development Fund surcharge, which the Western Area Power Administration (Western) is legislatively required to assess to P-DP power service customers in the states of Arizona, California, and Nevada beginning June 1, 2005.
