Stagecoach Group PLC & Coach USA, Inc., et al.-Control-Megabus USA LLC
Stagecoach Group PLC (Stagecoach) and its subsidiary Coach USA, Inc. (Coach), noncarriers, and various subsidiaries of each (collectively, applicants), have filed an application under 49 U.S.C. 14303 to acquire control of the newly created Megabus USA LLC (Megabus USA), which is currently owned by co-applicant Independent Bus Company, Inc. (Independent), a wholly owned subsidiary of Coach. Applicants state that currently Megabus USA does not hold federally issued authority. This application is filed on the premise that Megabus USA actually obtains the authority it seeks. Persons wishing to oppose this application must follow the rules at 49 CFR 1182.5 and 1182.8. The Board has tentatively approved the transaction, and, if no opposing comments are timely filed, this notice will be the final Board action.
BNSF Railway Company-Acquisition and Operation Exemption-Union Pacific Railroad Company
Under 49 U.S.C. 10502, the Board is granting a petition for exemption from the prior approval requirements of 49 U.S.C. 11323, et seq., for BNSF Railway Company, a Class I carrier, to acquire and operate approximately 25 miles of rail line of Union Pacific Railroad Company (UP), a Class I carrier, extending from UP milepost 81.1 at Union, CO, to UP milepost 56.1 at Sterling, CO.
Grupo Senda Autotransporte, S.A. de C.V. & Turimex del Norte, S.A. de C.V.-Acquisition of Control-Coach Investments LLC
Grupo Senda Autotransporte, S.A. de C.V. (Grupo Senda), and Turimex del Norte, S.A. de C.V. (TDN) (collectively, Applicants), have filed an application under 49 U.S.C. 14303 to acquire control of Coach Investments LLC (Coach), by acquiring substantially all of the outstanding stock of Coach from David Rodriguez Benitez, Jaime Protasio Rodriguez Benitez, Alberto Rodriguez Benitez, and Maria Elena Rodriguez Benitez (collectively, Rodriguez Siblings). Coach currently controls Turimex LLC (Turimex), a federally regulated motor carrier of passengers. Persons wishing to oppose this application must follow the rules at 49 CFR 1182.5 and 1182.8. The Board has tentatively approved the transaction, and, if no opposing comments are timely filed, this notice will be the final Board action.
Iowa Interstate Railroad, Ltd.-Acquisition Exemption-Great Western Railway Company of Iowa, L.L.C.
The Board grants an exemption, under 49 U.S.C. 10502, from the prior approval requirements of 49 U.S.C. 10902 for Iowa Interstate Railroad, Ltd. (IAIS), a Class II rail carrier, to acquire by purchase a rail yard owned by Great Western Railway Company of Iowa, L.L.C., subject to employee protective conditions. The rail yard consists of approximately 55 acres and 15 tracks, and extends from milepost 0 at 18th Street to milepost 1.6, at Council Bluffs, IA.
Review of Liability of Motor Common Carriers of Household Goods
In the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), Public Law No. 109-59, Sec. 4215, 119 Stat. 1144 (2005), Congress directed the Surface Transportation Board (Board) to review the current Federal regulations regarding the level of liability protection provided by motor carriers that provide transportation of household goods (HHG) and revise the regulations, if necessary, to provide enhanced protection in the case of loss or damage. The Board seeks public comment on the issue.
Arkansas Midland Railroad Company, Inc.-Petition for Declaratory Order-Caddo Valley Railroad Company
In response to a petition filed by the Arkansas Midland Railroad Company, Inc. (AKMD), the Board is instituting a declaratory order proceeding under 49 U.S.C. 721 and 5 U.S.C. 554(e) to determine if the right of first refusal provided in 49 U.S.C. 10907(h), to repurchase a line sold under the Feeder Line Development Program, applies when a transfer of control of a feeder line operator occurs by stock sale. Responses to the petition have been filed by Caddo Valley Railroad Company (CVR); Bean Lumber Company and Curt Bean Lumber Company (Bean Companies); GS Roofing Products Company, Inc. (GS) and CertainTeed Corporation (CertainTeed); and Pioneer Railcorp (Pioneer) (jointly, Respondents). International Paper Company (IP) also has submitted a response. The Board seeks public comment on this issue.
Gregg Haug-Continuance in Control Exemption-Northern Plains Railroad, Inc., Mohall Railroad, Inc. and Mohall Central Railroad, Inc.
The Board grants an exemption, under 49 U.S.C. 10502, from the prior approval requirements of 49 U.S.C. 11323 for Gregg Haug, an individual, to continue in control of three Class III rail carriers: Northern Plains Railroad, Inc. (NPR), Mohall Railroad, Inc. (MRI), and Mohall Central Railroad, Inc. (MHC). Each of the foregoing corporations owns or operates rail lines located in whole or in major part within the State of North Dakota.

Released Rates of Motor Common Carriers of Household Goods
The Household Goods Carriers' Bureau Committee (Committee), on behalf of its member motor carriers, seeks authority to amend Released Rates Decision No. MC-999 by changing the index used for annual adjustments to the minimum per-pound valuation and to the charges for protecting the full value of shipments of household goods.
