The Recovery Accountability and Transparency Board (Board) previously issued regulations pertaining to the Privacy Act of 1974, Public Information and Requests, and the Board's Official Seal. These are the only Board issued regulations codified in the Code of Federal Regulations. On September 30, 2015, the Board is required by the American Recovery and Reinvestment Act of 2009, as amended, to terminate. After that date, because the Board will cease to exist, there will be no need for the Board's regulations. Accordingly, this final rule removes the Board's regulations from the Code of Federal Regulations effective September 30, 2015.

The Recovery Accountability and Transparency Board (Board) is issuing public notice of its intent to amend a system of records that it maintains subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended; specifically, RATB-11 entitled ``RATB Investigative Files'' is being amended to reflect legislation expanding the purview of the Board's responsibilities, see e.g., Consolidated Appropriations Act of 2012, Public Law 112-74, Sec. 528, 125 Stat. 786, 920 (2011); and Education Jobs Fund, Public Law 111-226, Sec. 101, 124 Stat. 2389 (2010). Accordingly, the Board is making substantive amendments to its system notice to include: amended categories of individuals covered by the system, amended categories of records in the system, additional authorities for maintenance of the system, amended purposes, a new routine use, and amended record source categories. In addition, the Board is renaming the system as RATB-11-Oversight Support as well as clarifying the security classification, system location, storage, retrievability, safeguards, retention and disposal, and system manager. The Recovery Accountability and Transparency Board (Board) proposes a new system of records subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended (Privacy Act or the Act), entitled ``Fast Alert System.'' Under the American Recovery and Reinvestment Act of 2009, Public Law 111-5 (Recovery Act), the Recovery Accountability and Transparency Board (Board) is responsible for coordinating and conducting oversight of covered funds to prevent fraud, waste, and abuse. The Board has determined that, to further its mission of fraud and waste prevention, recipients of Recovery Act funds and those seeking Recovery Act funds should be reviewed against existing public, private, and commercially available information, including but not limited to information regarding past recipients of or those that have sought Federal funds. The Board has further determined that direct participation in such reviews by agency procurement and grant personnel, as well as by Offices of Inspector General and other law enforcement authorities, will improve the efficiency and economy of achieving the Board's mission of preventing and detecting fraud, waste, and abuse of Recovery Act funds. RATB- 9FederalReporting.gov Section 1512 Data System, the system that maintains information on recipients of funds disbursed under the American Recovery and Reinvestment Act of 2009, Public Law 111-5 (Recovery Act), is being amended to reflect post-Recovery Act legislation expanding the purview of the Board's oversight responsibilities, see, e.g., Education Jobs Fund, Public Law 111-226, 124 Stat. 2389, sec. 101 (Aug. 10, 2010) (``[T]he amount under this heading shall be administered under the terms and conditions of * * * title XV of division A of the American Recovery and Reinvestment Act of 2009 (Pub. L. 111-5).''), and to account for data submitted to the Board by methods other than FederalReporting.gov. Accordingly, the Board is making substantive amendments to its system notice to include: new categories of individuals covered by the system, new categories of records in the system, an amended routine use, and new record source categories. To further reflect recent legislation and to account for data submitted to the Board by methods other than FederalReporting.gov, the system will be renamed RATB-9Section 1512 Data System. These exemptions will help ensure that the Board may efficiently and effectively compile investigatory material to prevent and detect fraud, waste, and abuse and perform its other authorized duties and activities relating to oversight of funds awarded pursuant to the American Recovery and Reinvestment Act of 2009, Public Law 111-5 (Feb. 17, 2009) (Recovery Act).

The Recovery Accountability and Transparency Board (Board) proposes two new systems of records subject to the Privacy Act of 1974, as amended (Privacy Act or the Act), entitled ``FederalReporting.gov Section 1512 Data System'' (1512 Data System) and ``FederalReporting.gov Recipient Registration System'' (FRRS). The 1512 Data System will contain information on recipients of funding from the American Recovery and Reinvestment Act, Public Law 111-5 (Recovery Act). Under section 1512 of the Recovery Act, as well as implementing guidance promulgated by the Office of Management and Budget (OMB), recipients are required to report certain data elements relating to their receipt of funds. The 1512 Data System will include data collected from recipients reporting data pursuant to the Recovery Act, and that data will then flow to and be posted publicly on the Web site Recovery.gov, which was also established by the Recovery Act. The FRRS will contain information on individuals who have registered and established accounts to access FederalReporting.gov, the Board's Web- based inbound reporting system. The information maintained by the FRRS includes the first name, last name, phone number, extension, agency code (for individuals associated with a Federal agency), and DUNS number. This information is used to retrieve additional recipient organizational information from the Central Contractor Registry (CCR), Federal Procurement Data System (FPDS), and Dun and Bradstreet database systems. This information will be used to protect and manage access to the individual's account on FederalReporting.gov. In this notice, the Board provides the required information on the systems of records.
