Hazardous Materials: Modernizing Regulations To Improve Safety and Efficiency
PHMSA is publishing this ANPRM to solicit stakeholder feedback on initiatives PHMSA is considering that may modernize the Hazardous Materials Regulations and improve efficiencies while maintaining or improving a current high level of safety. To fully engage with stakeholders, this ANPRM solicits comments and input on questions related to 46 distinct topics under consideration. Any comments, data, and information received will be used to evaluate and potentially draft proposed amendments.
Pipeline Safety: Gas Pipeline Leak Detection and Repair
On May 18, 2023, PHMSA published a Notice of Proposed Rulemaking (NPRM) in the Federal Register titled: ``Pipeline Safety: Gas Pipeline Leak Detection and Repair.'' PHMSA received requests to extend the comment period for stakeholders to have more time to evaluate the NPRM. PHMSA is therefore extending the comment period to August 16, 2023.
Hazardous Materials: FAST Act Requirements for Real-Time Train Consist Information
PHMSA proposes amendments to its Hazardous Materials Regulations to require all railroads to generate in electronic form, maintain, and provide to first responders, emergency response officials, and law enforcement personnel, certain information regarding hazardous materials in rail transportation to enhance emergency response and investigative efforts. The proposal responds to a safety recommendation of the National Transportation Safety Board and statutory mandates in The Fixing America's Surface Transportation Act, as amended, and complements existing regulatory requirements pertaining to the generation, maintenance, and provision of similar information in hard copy form, as well as other hazard communication requirements.
Hazardous Materials: Information Collection Activities
In accordance with the Paperwork Reduction Act of 1995, PHMSA invites comments on information collections pertaining to hazardous materials transportation for which PHMSA intends to request renewal and extension from the Office of Management and Budget. PHMSA published a 60-day comment period soliciting comments on these information collections in the Federal Register on March 22, 2023, and did not receive any comments.
Hazardous Materials: Notification of Termination of Certain Explosive Classification Approvals Due to Non-Compliance With the UN Model Regulation Test Series 6(d) Requirement
PHMSA has terminated the Explosive (EX) classification approvals listed below. PHMSA published a Federal Register Notice on May 4, 2021, notifying the approval holders listed below that PHMSA intended to terminate their approvals for failure to provide proof that the approved explosives successfully completed the UN Test Series 6(d) of Part I of the UN Manual of Tests and Criteria. The notice advised approval holders that they must either show why their approvals should not be terminated or apply for a modification of their approval prior to June 3, 2021.

Hazardous Materials: Adjusting Registration and Fee Assessment Program; Notice of Public Meeting
PHMSA's Office of Hazardous Materials Safety will hold a public meeting to solicit input on potential adjustments to the statutorily mandated hazardous materials registration and fee assessment program. The potential adjustment of fees may be necessary to fund PHMSA's national emergency preparedness grant programs at the newly authorized level in accordance with the Infrastructure Investment and Jobs Act of 2021.

Pipeline Safety: Gas Pipeline Leak Detection and Repair
PHMSA proposes regulatory amendments that implement congressional mandates in the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2020 to reduce methane emissions from new and existing gas transmission pipelines, distribution pipelines, regulated (Types A, B, C and offshore) gas gathering pipelines, underground natural gas storage facilities, and liquefied natural gas facilities. Among the proposed amendments for part 192- regulated gas pipelines are strengthened leakage survey and patrolling requirements; performance standards for advanced leak detection programs; leak grading and repair criteria with mandatory repair timelines; requirements for mitigation of emissions from blowdowns; pressure relief device design, configuration, and maintenance requirements; and clarified requirements for investigating failures. Finally, PHMSA proposes expanded reporting requirements for operators of all gas pipeline facilities within DOT's jurisdiction, including underground natural gas storage facilities and liquefied natural gas facilities.
Hazardous Materials: Adoption of Miscellaneous Petitions and Updating Regulatory Requirements
On March 3, 2023, PHMSA published a notice of proposed rulemaking (NPRM), entitled ``Hazardous Materials: Adoption of Miscellaneous Petitions and Updating Regulatory Requirements (HM- 219D),'' proposing changes to update, clarify, improve the safety of, or streamline various regulatory requirements. In response to a request for an extension of the comment period submitted by Worthington Industries, PHMSA is extending the comment period for the HM-219D NPRM for an additional 45 days. Comments to the HM-219D NPRM will now be due by June 16, 2023.

PHMSA proposes amendments to the Hazardous Materials Regulations (HMR) to update, clarify, improve the safety of, or streamline various regulatory requirements. Specifically, this rulemaking responds to 18 petitions for rulemaking submitted by the regulated community between May 2018 and October 2020 that requests PHMSA address a variety of provisions, including but not limited to those addressing packaging, hazard communication, and the incorporation by reference of certain documents. These proposed revisions maintain or enhance the existing high level of safety under the HMR while providing clarity and appropriate regulatory flexibility in the transport of hazardous materials.

The Pipeline and Hazardous Materials Safety Administration is correcting the final rule that appeared in the Federal Register on December 27, 2022. The final rule made editorial revisions and clarifications to the hazardous materials regulations including the hazardous materials table. The corrections address several errors to the hazardous material entries in the hazardous materials table.
