Rules of Practice and Procedure for Administrative Hearings Before the Office of Administrative Law Judges
Due to the receipt of significant adverse comment, the Department of Labor is withdrawing the January 11, 2021 direct final rule (DFR) that would have provided for electronic filing (e-filing) and electronic service (e-service) of papers, required e-filing for persons represented by attorneys or non-attorney representatives unless good cause is shown justifying a different form of filing, and required advance notice to the parties of the manner of a hearing or prehearing conference.

Tip Regulations Under the Fair Labor Standards Act (FLSA): Delay of Effective Date
In accordance with the Presidential directive as expressed in the memorandum of January 20, 2021 from the Assistant to the President and Chief of Staff, entitled ``Regulatory Freeze Pending Review,'' this action proposes to delay until April 30, 2021 the effective date of the rule entitled Tip Regulations Under the Fair Labor Standards Act (``Tip Rule''), published in the Federal Register on December 30, 2020. The rule's current effective date is March 1, 2021. WHD seeks comments on this proposed delay, which would allow the Wage and Hour Division additional opportunity for review and consideration of the new rule.
Findings of Research Misconduct
Findings of research misconduct have been made against Yibin Lin, Ph.D. (Respondent), former postdoctoral fellow, McGovern Medical School, University of Texas Health Science Center (UTHealth). Respondent engaged in research misconduct in research supported by U.S. Public Health Service (PHS) funds, specifically National Institute of Allergy and Infectious Diseases (NIAID), National Institutes of Health (NIH), grant R01 AI125216. The administrative actions, including debarment for a period of ten (10) years, were implemented beginning on January 7, 2021, and are detailed below.
