Issuance of Environmental Assessment and Final Finding of No Significant Impact for Modification of Exemption From Certain NRC Licensing Requirements for Special Nuclear Material for Waste Control Specialists, LLC, Andrews County, TX
The U.S. Nuclear Regulatory Commission (NRC) has prepared an Environmental Assessment for the issuance of an Order under Section 274(f) of the Atomic Energy Act that would modify an Order issued to Waste Control Specialists, LLC (WCS) on November 5, 2004. In accordance with 10 CFR 51.33, the NRC prepared a draft Finding of No Significant Impact (FONSI) for public review and comment that was issued on July 9, 2009 (74 FR 34983). The public comment period closed on August 10, 2009. NRC received comments from one resident of Texas. The current action is in response to a request by WCS dated December 10, 2007. The November 5, 2004 Order was published in the Federal Register on November 12, 2004 (69 FR 65468). The November 5, 2004 Order, which modified an initial Order issued to WCS on November 21, 2001, exempted WCS from certain NRC regulations and permitted WCS, under specified conditions, to possess waste containing special nuclear material (SNM), in greater quantities than specified in 10 CFR Part 150, at WCS's facility located in Andrews County, Texas, without obtaining an NRC license pursuant to 10 CFR part 70.

Criminal Penalties; Unauthorized Introduction of Weapons
The Nuclear Regulatory Commission (NRC) is amending its regulations to authorize the imposition of Federal criminal penalties on those who, without authorization, introduce weapons or explosives into specified classes of facilities and installations subject to the regulatory authority of the NRC. This action is necessary to implement section 229, ``Trespass on Commission Installations,'' of the Atomic Energy Act of 1954, as amended (AEA).
Agency Information Collection Activities: Submission for the Office of Management and Budget (OMB) Review; Comment Request
The NRC has recently submitted to OMB for review the following proposal for the collection of information under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). The NRC hereby informs potential respondents that an agency may not conduct or sponsor, and that a person is not required to respond to, a collection of information unless it displays a currently valid OMB control number. The NRC published a Federal Register Notice with a 60-day comment period on this information collection on June 30, 2009.
List of Approved Spent Fuel Storage Casks: HI-STORM 100 Revision 7
The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its spent fuel storage cask regulations by revising the Holtec International (Holtec) HI-STORM 100 dry storage cask system listing within the ``List of Approved Spent Fuel Storage Casks'' to include Amendment No. 7 to Certificate of Compliance (CoC) Number 1014. Amendment No. 7 would modify the CoC to add the HI-STORM 100U system to the HI-STORM 100 cask system. The HI-STORM 100U system allows for the underground storage of dry spent nuclear fuel (SNF) by utilizing an underground vertical ventilated module (VVM) that can accept certain multipurpose canisters (MPCs) previously certified for storage of SNF in the Holtec aboveground HI-STORM system. In addition, the amendment would reinstate the decay heat limits for damaged fuel and fuel debris in Appendix B, Technical Specification (TS) 2.4, for the aboveground system that had been inadvertently deleted from Amendment Nos. 5 and 6; incorporate separate TS Appendices A and B for the aboveground system (Apps. A and B) and for the HI-STORM 100U system (Apps. A-100U and B- 100U); revise Appendix B, TS 3.4.5, to be consistent with the required system thermal boundary conditions, as submitted in the applicant's safety analysis report for a fire accident condition, and with Holtec's original (i.e., initial certificate application or Amendment 0) submittal and the NRC's original safety evaluation report; and revise and add certain definitions in Appendix A, TS 1.1, to include the VVM. The amendment will also incorporate minor editorial corrections in the TS for the aboveground system.

Amendment No. 7 will modify the CoC to add the HI-STORM 100U system to the HI-STORM 100 cask systems. Office of New Reactors; Final Interim Staff Guidance on Evaluation and Acceptance Criteria for 10 CFR 20.1406 To Support Design Certification and Combined License Applications
The NRC is issuing its Final Interim Staff Guidance (ISG) DC/ COL-ISG-06 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML092470100). The purpose of this ISG is to clarify NRC position on what is an acceptable level of detail and content for demonstrating compliance with Title 10 of the Code of Federal Regulations, Section 20.1406 (10 CFR 20.1406). Regulatory Guide 4.21, ``Minimization of Contamination and Waste Generation: Life Cycle Planning,'' provides an acceptable method of demonstrating compliance. This ISG provides further clarification on the evaluation and acceptance criteria that will be used by NRC staff in reaching a reasonable assurance finding that a design certification (DC) or combined license (COL) applicant has complied with the requirements of 10 CFR 20.1406. The NRC staff issues DC/COL-ISGs to facilitate timely implementation of current staff guidance and to facilitate activities associated with review of applications for DCs and COLs by the Office of New Reactors. The NRC staff will also incorporate the approved DC/ COL-ISG-06 into the next revision of the SRP and related guidance documents.
Notice of Opportunity for Public Comment on the Proposed Model Safety Evaluation for Plant-Specific Adoption of Technical Specification Task Force Traveler-513, Revision 2, “Revise PWR Operability Requirements and Actions for RCS Leakage Instrumentation”
The NRC is requesting public comment on the enclosed proposed model safety evaluation, model no significant hazards consideration determination, and model application for plant-specific adoption of Technical Specification Task Force (TSTF) Traveler-513, Revision 2, ``Revise PWR Operability Requirements and Actions for RCS Leakage Instrumentation.'' The TSTF Traveler-513, Revision 2, is available in the Agencywide Documents Access Management System (ADAMS) under Accession Number ML091810158. The proposed changes revise Standard Technical Specification (STS) [3.4.15], ``[Reactor Coolant System (RCS) Leakage Detection Instrumentation].'' The proposed changes also revise the STS Bases to clearly define the RCS leakage detection instrumentation Operability requirements in the Limiting Condition for Operation (LCO) Bases, eliminate discussion from the STS Bases that could be erroneously construed as Operability requirements, and reflect the changes to the TSs. This model safety evaluation will facilitate expedited approval of plant-specific adoption of TSTF Traveler-513, Revision 2.
State of New Jersey: Discontinuance of Certain Commission Regulatory Authority Within the State; Notice of Agreement Between the Nuclear Regulatory Commission and the State of New Jersey
This notice is announcing that on September 2, 2009, Gregory B. Jaczko, Chairman of the U.S. Nuclear Regulatory Commission (NRC or Commission), and on September 23, 2009, Governor Jon S. Corzine, of the State of New Jersey, signed an Agreement as authorized by Section 274b of the Atomic Energy Act of 1954, as amended (the Act). The Agreement provides for the Commission to discontinue its regulatory authority and for New Jersey to assume regulatory authority over the possession and use of byproduct material as defined in Sections 11e.(1), 11e.(3), and 11e.(4) of the Act, source material, special nuclear materials (in quantities not sufficient to form a critical mass), and the regulation of land disposal of byproduct, source, or special nuclear material waste received from other persons. Under the Agreement, a person in New Jersey possessing these materials is exempt from certain Commission regulations. The exemptions have been previously published in the Federal Register (FR) and are codified in the Commission's regulations as 10 CFR part 150. The Agreement is published here as required by Section 274e of the Act.

The U.S. Nuclear Regulatory Commission (NRC) has prepared an Environmental Assessment for the issuance of an Order pursuant to Section 274f of the Atomic Energy Act that would modify an Order issued to EnergySolutions, LLC (EnergySolutions) on May 30, 2006. In accordance with 10 CFR 51.33, the NRC has also prepared a draft Finding of No Significant Impact (FONSI) for public review and comment. The current action is in response to a request by EnergySolutions dated September 26, 2006. The May 30, 2006 Order was published in the Federal Register on June 13, 2006 (71 FR 34165). The May 30, 2006 Order, which modified a previous Order issued to EnergySolutions on July 11, 2005, exempted EnergySolutions from certain NRC regulations and permitted WCS, under specified conditions, to possess waste containing special nuclear material (SNM), in greater quantities than specified in 10 CFR Part 150, at EnergySolutions's facility located in Clive, Utah, without obtaining an NRC license pursuant to 10 CFR Part 70.
Revisions to Environmental Review for Renewal of Nuclear Power Plant Operating Licenses
On July 31, 2009, the Nuclear Regulatory Commission (NRC) published a proposed rule for public comment that would amend its environmental protection regulations by updating the NRC's 1996 findings on the environmental impacts related to the renewal of operating licenses for nuclear power plants.
