Pacific Island Fisheries; Annual Catch Limit and Accountability Measure for the Commonwealth of the Northern Mariana Islands Bottomfish in 2024-2025
This final rule implements an annual catch limit (ACL) and annual catch target (ACT) for bottomfish in the Commonwealth of the Northern Mariana Islands (CNMI) for fishing years 2024 and 2025. This rule does not revise, add, or remove the most recent current accountability measure (AM) in NOAA's regulations. Under that AM, NMFS will reduce the ACL and ACT in the following fishing year by the amount of the overage if the average catch from the most recent 3 years exceeds the ACL. This final rule supports the long-term sustainability of the CNMI bottomfish fishery.

Notice is hereby given that NMFS received an application for a Federal Endangered Species Act (ESA) incidental take permit from United Water Conservation District (applicant) located in Oxnard, California and the permit application is hereby open for public comment. The permit application concerns the incidental take of endangered Southern California steelhead (Oncorhynchus mykiss) associated with the applicant's otherwise lawful continued operation and maintenance of the existing Freeman Diversion on the lower Santa Clara River, Ventura County, and future proposed activities for expanding the diversion. We are considering issuing a 50-year permit to the applicant that would exempt the applicant's incidental take of endangered steelhead, and are making the permit application and related documents available to the public for review and comment. We will use the comments received, the permit application, and other information required by applicable statute and regulation, to determine whether the permit application meets the criteria for issuing the permit to the applicant. Additionally, we are issuing this notice to advise Federal, State, and local government agencies and the public that we are withdrawing our 2013 Notice of Intent (NOI) to prepare a draft Environmental Impact Statement (EIS) for a previous application from United Water Conservation District for an incidental take permit under the ESA.

Fisheries of the Northeastern United States; Atlantic Bluefish Fishery; Quota Transfers From New Jersey, Maryland, and Virginia to Massachusetts, Rhode Island, New York, and North Carolina
NMFS announces that the States of New Jersey and Maryland and the Commonwealth of Virginia are transferring a portion of their 2024 commercial bluefish quota to the Commonwealth of Massachusetts and the States of Rhode Island, New York, and North Carolina. These adjustments to the 2024 fishing year quotas are necessary to comply with the Atlantic Bluefish Fishery Management Plan quota transfer provisions. Magnuson-Stevens Fishery Conservation and Management Act Provisions; Atlantic Coastal Fisheries Cooperative Management Act Provisions; General Provisions for Domestic Fisheries; Application for Exempted Fishing Permits
The Assistant Regional Administrator for Sustainable Fisheries, Greater Atlantic Region, NMFS, has made a preliminary determination that an Exempted Fishing Permit (EFP) application contains all of the required information and warrants further consideration. The EFP would allow federally permitted fishing vessels to fish outside fishery regulations in support of exempted fishing activities proposed by Blue Planet Strategies. Regulations under the Magnuson-Stevens Fishery Conservation and Management Act and the Atlantic Coastal Fisheries Cooperative Management Act require publication of this notification to provide interested parties the opportunity to comment on applications for proposed EFPs.

This action adds a fishing period, August 6 through August 8, 2024, with a fishing period catch limit of 1,000 pounds (0.45 metric tons (mt)) per vessel, dressed weight. NMFS issues this final rule to implement amendment 126 to the Fishery Management Plan (FMP) for Groundfish of the Bering Sea and Aleutian Islands Management Area (BSAI) and amendment 114 to the FMP for Groundfish of the Gulf of Alaska (GOA). Amendments 126/114 implement an electronic monitoring (EM) program for pelagic trawl pollock catcher vessels and tender vessels delivering to shoreside processors and stationary floating processors in the Bering Sea (BS), Aleutian Islands (AI), and GOA. This final rule is intended to promote the goals and objectives of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act), amendments 126/114, the BSAI FMP, the GOA FMP, and other applicable laws.

NMFS implements an accountability measure (AM) for the commercial harvest of Spanish mackerel in the northern zone of the Atlantic exclusive economic zone (EEZ). NMFS projects that the commercial quota for Spanish mackerel in the northern zone of the Atlantic EEZ has been reached for the 2024-2025 fishing year. According to regulations for Spanish mackerel in the Atlantic, NMFS closes the northern zone for commercial harvest to protect this fishery resource.

Endangered and Threatened Wildlife and Plants; Proposed Listing Determinations for Ten Species of Giant Clams Under the Endangered Species Act
We, NMFS, have completed a comprehensive status review of seven species of giant clams (Hippopus hippopus, H. porcellanus, Tridacna derasa, T. gigas, T. mbalavuana, T. squamosa, and T. squamosina) in response to a petition to list these species as threatened or endangered under the Endangered Species Act (ESA). Based on the best scientific and commercial data available, including the Status Review Report, and after taking into account efforts being made to protect these species, we have determined that H. porcellanus, T. mbalavuana, and T. squamosina are in danger of extinction throughout the entirety of their respective ranges, T. derasa and T. gigas are in danger of extinction in a significant portion of their respective ranges, and H. hippopus is likely to become an endangered species within the foreseeable future throughout a significant portion of its range. Therefore, we propose to list H. porcellanus, T. mbalavuana, T. squamosina, T. derasa, and T. gigas as endangered species and H. hippopus as a threatened species under the ESA. We have determined that the fluted clam, T. squamosa, is not currently in danger of extinction throughout all or a significant portion of its range and is not likely to become so within the foreseeable future. Therefore, we find that T. squamosa does not meet the definition of a threatened or an endangered species under section 4(a) of the ESA. Further, we propose to exercise the discretionary authority of section 4(d) to extend the prohibitions of section 9 of the ESA to the proposed threatened species, H. hippopus. At this time, we do not propose to designate critical habitat for the three species proposed to be listed that occur within U.S. jurisdiction (H. hippopus, T. derasa, and T. gigas) because critical habitat for these species is not yet determinable. Using the authority of section 4(e) of the ESA, we also propose to list T. crocea, T. maxima, T. noae, and T. squamosa as threatened species due to the similarity of appearance of products derived from these species (e.g., meat, worked shell products, and pearls) to those derived from the six aforementioned species proposed to be listed based on their extinction risk. We propose a special rule to define activities that would and would not be prohibited with respect to these four species in order to mitigate the substantial enforcement challenge associated with this similarity of appearance concern. We solicit information to inform the final listing determination and to inform a future proposal for any determinable critical habitat.

Endangered and Threatened Wildlife; 90-Day Finding on a Petition To List the Alabama Shad as Threatened or Endangered Under the Endangered Species Act
We, NMFS, announce a 90-day finding on a petition to list the Alabama shad (Alosa alabamae) as threatened or endangered under the Endangered Species Act (ESA). The petitioners also request that we designate critical habitat. We find that the petition presents substantial scientific or commercial information indicating that the petitioned action may be warranted. Therefore, we are initiating a status review of the Alabama shad to determine whether listing under the ESA is warranted. To support a comprehensive status review, we are soliciting scientific and commercial information regarding this species from any interested party.

The South Atlantic Fishery Management Council (Council) will hold two virtual public hearings pertaining to Amendment 55 to the Fishery Management Plan (FMP) for the Snapper Grouper Fishery in the South Atlantic Region. This amendment establishes a Scamp and Yellowmouth Complex, establishes a rebuilding plan, catch levels, sector allocations, management measures, and accountability measures for the new complex. The amendment also updates the composition and catch levels of the Other South Atlantic Shallow Water Grouper Complex.

This rule implements changes to fishing year 2024 recreational management measures for Gulf of Maine (GOM) cod and GOM haddock. The measures are necessary to ensure the recreational fishery achieves, but does not exceed, fishing year 2024 catch limits for GOM cod and GOM haddock. Recreational measures for Georges Bank (GB) cod will remain unchanged in fishing year 2024.

Amendment 8 Revisions to Essential Fish Habitat in the Fishery Management Plan for U.S. West Coast Fisheries for Highly Migratory Species
The Pacific Fishery Management Council (Council) submitted to NMFS Amendment 8 to the Fishery Management Plan (FMP) for the U.S. West Coast Highly Migratory Species (HMS) July 15, 2024. If approved by the Secretary of Commerce (Secretary), these Amendments would update essential fish habitat (EFH) provisions in the existing HMS FMP. This Amendment is intended to promote the goals and objectives of the Magnuson-Stevens Fishery Conservation and Management Act (MSA) which requires periodic review and revision of EFH components of FMPs as warranted based on available information.

This action is necessary to prevent exceeding the 2024 total allowable catch (TAC) of Pacific cod by vessels using jig gear in the Central Regulatory Area of the GOA.
Establishing an Advisory Council Pursuant to the National Marine Sanctuaries Act and Solicitation for Applications for the Lake Ontario National Marine Sanctuary Advisory Council
Notice is hereby given that NOAA is establishing a national marine sanctuary advisory council for the Lake Ontario National Marine Sanctuary (LONMS). The new advisory council (council) will replace the pre-designation advisory council which was established September 17, 2019 and which expired upon the designation of LONMS. The council will provide advice and recommendations to ONMS regarding the sanctuary management plan and will serve as liaisons between the sanctuary and constituents and community groups. As a result, ONMS is adding the council to the list of established national marine sanctuary advisory councils. ONMS solicits applications to fill council seats on an as needed basis and is currently seeking applicants for seats on the LONMS Advisory Council. NMFS approves and implements the 2024-2026 specifications for the Mackerel, Squid, and Butterfish Fishery Management Plan, as recommended by the Mid-Atlantic Fishery Management Council. This final rule sets the 2024 Illex and longfin squid specifications, and projects the 2025 Illex and 2025-2026 longfin squid specifications. This rule also reaffirms the 2024 butterfish and Atlantic chub mackerel specifications and the previously published projected 2025 chub mackerel specifications.
