NMFS issues this notice to establish the effective date of fees to repay the $13,133,030 reduction loan to finance a fishing capacity reduction program in the Southeast Alaska purse seine salmon fishery. NMFS conducted a referendum to approve the reduction loan repayment fees of $13,133,030 to remove 64 permits, which post- reduction harvesters will repay over a 40-year period. NMFS has tendered reduction payments to the selected bidders.

The intent is to provide additional harvest opportunity to the NE multispecies fishery while ensuring sufficient amounts of GB yellowtail flounder are available for the scallop fishery.

The permit applicants are the Washington Department of Fish and Wildlife (WDFW), Idaho Department of Fish and Game, and the Bureau of Indian Affairs (BIA) on behalf of the Nez Perce Tribe (NPT). The proposed permits would expire on December 31, 2017. This document serves to notify the public of the draft EA for public review, comment, and submission of written data, views, arguments or other relevant information before a final decision on whether to issue a Finding of No Significant Impact is made by NMFS. All comments and other information received will become part of the public record and will be available for review pursuant to section 10(c) of the Endangered Species Act (ESA).

NMFS announces the receipt of a petition for rulemaking under the Administrative Procedure Act (APA). The Pribilof Island Community of St. Paul Island, Aleut Community of St. Paul Island-Tribal Government (St. Paul) petitioned NMFS to revise regulations governing the subsistence taking of northern fur seals on St. Paul Island. St. Paul's petition requests that NMFS revise the regulations to allow residents of St. Paul, Alaska to: Take male young of the year (less than 1 year old) fur seals; take a total of up to 3,000 fur seals annually compared to 2,000 currently allowed, including up to 1,500 male young of the year and up to 1,500 sub-adult (1-4 years old) males; hunt or harvest fur seals during a total of 329 days annually, rather than the 47-day harvest season provided for under existing regulations; and take fur seals with firearms, in addition to harvesting (the current method of herding, stunning, and immediate exsanguination, which is allowed under existing regulations). NMFS solicits public comment on all aspects of this request.

NMFS announces that 90 percent of the Trimester 2 longfin squid (longfin) quota is projected to be harvested by 0001 hours, July 10, 2012. Therefore, the directed longfin fishery in the Exclusive Economic Zone (EEZ) will be closed as of 0001 hours, July 10, 2012, and vessels issued a Federal permit are prohibited from possessing or landing more than 2,500 lb (1.13 mt) of longfin for the remainder of Trimester 2 (through August 31, 2012). The directed longfin fishery will re-open for Trimester 3 on September 1, 2012. This action is necessary to prevent the fishery from exceeding its Trimester 2 allocation of 12,490,290 lb (5,666 mt), and to allow for effective management of this stock.
High Seas Driftnet Fishing Moratorium Protection Act; Identification and Certification Procedures To Address Shark Conservation

This action would also amend the definition of illegal, unreported, or unregulated (IUU) fishing for purposes of the High Seas Driftnet Fishing Moratorium Protection Act.

The Gulf of Mexico Fishery Management Council (Council) has submitted Amendment 34 to the Fishery Management Plan for the Reef Fish Resources of the Gulf of Mexico (FMP) for review, approval, and implementation by NMFS. Amendment 34 proposes to modify the income qualification requirements for the renewal of Gulf of Mexico (Gulf) commercial reef fish permits and revise the crew size regulations for dual-permitted vessels (i.e. vessels that possess both a charter vessel/headboat permit for Gulf reef fish and a commercial vessel permit for Gulf reef fish) while fishing commercially. The intent of Amendment 34 is to remove permit requirements that may no longer be applicable to current commercial fishing practices and to improve vessel safety in the Gulf reef fish fishery.

On February 29, 2012, NOAA published a notice and request for comments in the Federal Register at 77 FR 12245 on the request of Lockheed Martin Corp. to extend the deep seabed hard mineral exploration licenses USA-1 and USA-4 issued under the Deep Seabed Hard Mineral Resources Act (DSHMRA; 30 U.S.C. 1401-1473) and approve the amended exploration plan for those licenses. No comments were received objecting to the approval of the extension and amended exploration plan. Comments were received only from the Western Pacific Fisheries Management Council (WPFMC) and the United States Department of State. The WPFMC noted that none of the fisheries under its jurisdiction were likely to be affected by any activities outlined in the extension request. The Department of State noted that international recognition of the areas covered by the licenses requires approval by the International Seabed Authority (ISA) and that without accession of the United States to the Law of the Sea (LOS) Convention, the United States cannot sponsor a U.S. company at the ISA. The Department further noted that if the U.S. accedes to the LOS Convention that it would be necessary to make conforming changes to these exploration licenses. NOAA acknowledges and accepts the comments from WPFMC and the Department of State. Under its authority and in conformance with the requirements under DSHMRA and the DSHMRA regulations at 15 CFR part 970, NOAA approved the extension of both licenses for five years along with the amended exploration plan on June 1, 2012. No changes have been made to the terms, conditions or restrictions of the licenses.

The Restoration Plan identifies a restoration approach to compensate for injuries to natural resources in Portland Harbor in the Lower Willamette River. NMFS extends the recreational fishing season for the red snapper component of the reef fish fishery in the exclusive economic zone (EEZ) of the Gulf of Mexico (Gulf). NMFS previously determined the recreational red snapper quota would be reached by 12:01 a.m., local time, July 11, 2012. However, due to severe weather conditions in the central and northeastern Gulf during the first 26 days in June, fishing opportunities were restricted during the beginning of the recreational fishing season. NMFS has projected the quota will not be reached by the current closure date. Therefore, NMFS is extending the recreational red snapper fishing season for 6 days to allow the remainder of the quota to be harvested. The intent of this action is to provide fishermen the opportunity to harvest the recreational red snapper quota, and the opportunity to achieve the optimum yield for the fishery, thus enhancing social and economic benefits to the fishery.

NMFS has received a request to extend the comment period for the ANPR beyond its current 90-day comment period, originally scheduled to end on August 1, 2012. With this notice, NMFS is extending the comment period to September 15, 2012, to ensure there is adequate time for stakeholders and members of the public to comment on the ANPR.

The intent of Amendment 35 is to end overfishing of greater amberjack, modify the greater amberjack rebuilding plan and help achieve optimum yield (OY) for the greater amberjack resource in accordance with the requirements of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act).

NMFS has received a complete and adequate application from the Washington State Department of Transportation/Ferries Division (WSF) for an Incidental Harassment Authorization (IHA) to take marine mammals, by harassment, incidental to pile driving during replacement of the Port Townsend Ferry Terminal Transfer Span. Pursuant to the Marine Mammal Protection Act (MMPA), NMFS proposes to issue an IHA to incidentally harass, by Level B harassment only, 11 species of marine mammals during the specified activity within a specific geographic area and requests comments on its proposal.

Atlantic Highly Migratory Species; Electronic Dealer Reporting System Workshop

On June 28, 2011, NMFS published a proposed rule that considered requiring, among other things, Federal Atlantic swordfish, shark, and tunas dealers (except for dealers reporting Atlantic bluefin tuna) to report commercially-harvested Atlantic sharks, swordfish, and bigeye, albacore, yellowfin, and skipjack (BAYS) tunas through one centralized electronic reporting system. This electronic reporting system will allow dealers to submit Atlantic sharks, swordfish, and BAYS tuna data on a more real-time basis and more efficiently, which will reduce duplicative data submissions from different regions. We proposed to delay the effective date of the electronic reporting requirements until 2013 in order to give sufficient time for dealers to adjust to implementation of the new system and the additional requirements. On December 14, 2011, we conducted an initial training workshop in the Caribbean area in order to introduce the new reporting system to HMS dealers. In this notice, we announce the date and location for additional training workshops in the Caribbean, Gulf of Mexico and Atlantic regions in order to continue introducing HMS dealers to the new electronic system.
