Malic Acid; Tolerance Exemption

This regulation establishes an exemption from the requirement of a tolerance for residues of malic acid when used as an inert ingredient (buffering and stabilizing agent) on growing crops. Valent BioSciences, LLC, submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of malic acid, when used in accordance with the terms of these exemptions.

This regulation establishes tolerances for residues of rimsulfuron in or on pomegranate and tropical and subtropical, small fruit, edible peel, subgroup 23A. The Interregional Research Project No. 4 (IR-4) requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).

The Environmental Protection Agency (EPA) is planning to submit an information collection request (ICR), ``Renewal of Existing Information Collection Request for Confidential Business Information Substantiation'' (EPA ICR No. 1665.15, OMB Control No. 2020-0003) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act (PRA). Before doing so, EPA is soliciting public comments on specific aspects of the proposed information collection as described below. This is a proposed extension of the ICR, which is currently approved through September 20, 2023. An Agency may not conduct or sponsor and a person is not required to respond to a collection of information unless it displays a currently valid OMB control number.
