EPA is announcing a listening session to be held on July 9, 2010, during the public comment period for the external review draft document entitled ``EPA's Reanalysis of Key Issues Related to Dioxin Toxicity and Response to NAS Comments'' (EPA/600/R-10/038A). The EPA's draft document and peer review charge are available via the Internet on the National Center for Environmental Assessment's (NCEA) home page under the Recent Additions and Publications menus at https:// www.epa.gov/ncea. This draft document responds to the key recommendations and comments included in the National Academy of Sciences (NAS) 2006 report. In addition, it includes new analyses on potential human effects that may result from exposure to 2,3,7,8- tetrachlorodibenzo-p-dioxin (TCDD).

In accordance with section 122(i) of the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended (``CERCLA''), 42 U.S.C. 9622(h)(i), notice is hereby given of a proposed settlement that is intended to resolve the potential liability under CERCLA of a party for response costs incurred by EPA and/or by the United States Department of Justice on behalf of EPA, in connection with the West Huntington Spill Site, Huntington, West Virginia (``Site'').
Approval and Promulgation of Implementation Plans and Designations of Areas for Air Quality Planning Purposes; Alabama: Birmingham; Determination of Attaining Data for the 2006 24-Hour Fine Particulate Matter Standard

EPA is proposing to determine that the Birmingham, Alabama, nonattainment area for the 2006 24-hour fine particulate matter (PM2.5) National Ambient Air Quality Standard (NAAQS) has attained the 2006 24-hour PM2.5 NAAQS. This proposed determination is based upon complete, quality assured, quality controlled, and certified ambient air monitoring data for the years 2007-2009 showing that this area has monitored attainment of the 2006 24-hour PM2.5 NAAQS. If this proposed determination is made final, the requirement for the State of Alabama to submit an attainment demonstration and associated reasonably available control measures (RACM), reasonable further progress (RFP) plan, contingency measures, and other planning State Implementation Plans (SIPs) related to attainment of the 2006 24-hour PM2.5 standard for the Birmingham, Alabama, PM2.5 nonattainment area, shall be suspended for as long as this area continues to meet the 2006 24-hour PM2.5 NAAQS.
Adequacy Status of the Submitted 2009 PM2.5

In this notice, EPA is notifying the public that we have found that the motor vehicle emissions budgets for PM2.5 and NOX in the submitted attainment demonstration state implementation plans for the New Jersey portions of the New York- Northern New Jersey-Long Island, NY-NJ-CT, and Philadelphia-Wilmington, PA-NJ-DE, PM2.5 nonattainment areas to be adequate for transportation conformity purposes. The transportation conformity rule (40 CFR part 93) requires that the EPA conduct a public process and make an affirmative decision on the adequacy of budgets before they can be used by metropolitan planning organizations in conformity determinations. As a result of our finding, two metropolitan planning organizations in New Jersey (the North Jersey Transportation Planning Authority and the Delaware Valley Regional Planning Commission) must use the new 2009 PM2.5 budgets for future transportation conformity determinations.
